    Two months? I'm just calling a locksmith and getting back into my house that same day. If the locksmith won't do it, then I'm just going to home depot and doing it myself. None of this two month bullshit.

      No need for a locksmith...for what appears to be a 4 digit combination lock. I remember my parents giving me locks they forgot the combos for as a kid. Its not hard to try every possible combination on a 3/4 digit lock. It just takes a little time.

    There should be a law that if the lender does this and is found to be wrong the loan is settled and the home is free to the borrower.

    It's amazing that the banks can do this, but a squatter can break into your home and you have to go through a lengthy legal process to get them out!

    When they mess up like this not only should they give the property back but they should also be required to clear any debt owed to them, I guarantee that you will be seeing a lot less of these "accidental foreclosures"

    Isn’t it crazy how mortgage rates continue to rise with higher imports and declining exports? meanwhile the FED is yet to lessen cost. Something will eventually break if they keep raising interest rates and quantitative tightening

      indeed the mkt & economy has gone berserk, price of great assets like real estate, dividend paying stocks, or gold never comes down easily, in my humble opinion, buy what you can afford today, and working with a financial advisor certainly helps

    This issues can be resolved in about 5 minutes with a grinder. If you have proof that your home payments are up to date, dont let anythint or anyone try to bar you from entering your home.

      Even if behind and forclosing eviction notice required in all 50 states as keeping owners from contents of the home is a crime.

    The mortgage holder lied, they do not have the right to even come on your property if you are not in default.
    They need to be charged with breaking and entering plus burglary, that will end this crap real quick.
    And never pay in advance unless you have written statement that they are taking it off the next due date, most lenders will screw you by taking advance payments off the end of the loan or applying it to the principle so you still have to make the next month payment.

      You both are right, because some people have to travel a lot with work, and sometimes they pay up a few months in advance, so always make sure they are paying it towards the payment.

    make it a law that when banks ( etc) does this the morgage is no longer valid for the bank, as in it gets paid by the bank.....tht will stop it

    Judges say to cut the lock off, immediately get into the house, THEN contact your mortgage company (servicer)... For example Housing Court Judge Patrick M. Carney -- explicitly informed people that find a lock on their door to do precisely that.

    i honestly would have kicked the door in reconnected the utilities myself and made the bastards pay for it ..and if anyone tried to remove me ,people would have been shot ,,it would have been the right thing to do actually ....

    In Texas in case of a lock-out for non-payment the landlord/manager has to post a notice with a phone number and has to LET THEM IN within 4 hr of being called.
    Its essentially a tool to be used to ensure the landlord/manager can face to face confront the person who didn't pay, for discussion of what will be done about overdue payments and future payments.
    You have to do one lock-out before commencing eviction proceedings which can take 3 months to a year (while the scumbag renters don't pay at all and they trash the place, rip out all the plumbing and wires to sell for scrap and take up the floors, destroy all the sheet rock and fill the building with feces and hazmat)
    You couldn't get me to be a landlord again. Renters are scum.

    Chase Bank called me, two years after I sold my house, to tell me they were going to foreclose on me. I laughed and told them to go ahead as I don't own the house anymore. The person that called me was confused and didn't understand what I was telling them. I told them that I sold the house to a couple that wrote a check for the house and they did not have a mortgage with them or any other bank. I told them to go ahead and try to foreclose on it as I needed a good payout in court when they lose.

      they probably misspoke, but if that is what happened it could probably have caused this mess. I actually paid my mortgage up through the end of next year, but the bank manually adjust those dates down to 3 months. It just takes them a while. So I would actually receive receipts from the bank telling me that my next due date isnt until the end of next year, but then suddenly my due date will change to 3 months from when I made the payment since that's their policy. Incidentally though, technically, I shouldn't be responsible for the mistakes of their system. I don't push it though because I know that it would be a headache to deal with regardless.
      with most banks they don't have those types of quarks. If you pay ahead for a number of years it gets recorded as a principal only payment. The size of your payments don't change, but the interest you ultimately pay significantly goes down and this results in the loan being paid off sooner. If a consumer confuses a principal only payment with paying ahead this can result in a foreclosure.

    If I had this happen to me or to my mum, no attorney would take the case without a retainer of several thousand dollars. That is why it is a big risk to buy a house this day and age in this country because of this and deed/title thieves. You can't get a break. I have been a victim of it three times and it wasn't because I wasn't behind on my payments. Couldn't get an attorney and kept losing in court as a result. The last one, we are still fighting pro se the alleged new owners of the park.

      I agree. This is a matter for a crowbar. And I would have busted that lock off my door in short order and then called the police so they could return the lock to the owner. All the while having the paperwork in my hands showing I was not in default on my loan.

You break the lock illegally placed upon your property to gain access then call the police so they can return the lock to its rightful owner; all the while having paperwork in hand that shows you are not in default.

    while i get it, people are frustrated at the incompetence of the lenders, but to say you need a gun and shoot first ask questions later is pretty much making people think you have the qualifications for being a immoral cop. if you want to get ahold of a banks ass, simply hire a lawyer, and have said lawyer come out if you see the foreclosure people walk up. try and get it settled in court and also to never take out a loan for anything period.

    I live in Northern Alabama and I found out shortly after i moved here that if you have an outstanding bill that you avoiding to pay the company can send cops to try an make you cough up the money or they will dock your paycheck till it's paid off.

    Same thing happened to me after i came back from war, they changed my lock so i kicked the door till i broke it, very next morning i went to the office we had about an hour of discussion till they saw i was up to date on my payment. They apologize and came chanhe the door up. They avoided me suing them

    I don't know the laws in the other states..but Oregon requires landlords to hold- and release upon request-anything left behind for 6 full months! Why are these guys able to load everything into dumpsters and destroy? I think the law needs to be addressed!!
