My husband was threatened and attacked outside our home by a group of guys out of a crowd that was there. The man who instigated the altercation wouldn’t let my husband come inside to avoid the conflict so they attacked him knowing he had a knife and when my husband said he didn’t want to use it, they went for him anyways. 7 guys attacked and hit him so he used the knife to get him off of him. No serious injury but some cuts on them and they kept trying to get him until the police showed up. The aggressor yelled that he had a knife so he was arrested. He’s never been arrested before and we’re very scared of what to come even tho he was in self defense, we are not sure what to do.

Last Friday. I went to a neighbors house to have a few drinks. Somehow the conversation went sour and the neighbor cocked his gun. I felt in fear of my life so I went to my house and grabbed my wife’s pistol, and when I went to clear it they called the cops on me and said I pointed the gun at them and threatened them. That never happened. I never physically or verbally threaten anyone with the gun. Now I have a potential 2nd degree felony with a deadly weapon charge over my head.

How is this even possible that they added possession of a firearm during commission of a felony but there was no other crime committed besides pointing the gun. Which would be only Aggravated assaulte. It would be different I I committed a separate crime while having a gun. But the only allegation was pointing the gun. And the cops are alerted of it a week after it happened and it happened in family house hold. And the complaining witness choose not to do anything about it and choose to call the cops on a separate matter like a mental health breakdown. Than the cops refuse to take said individual to a mental health hospital than are told about the indicent in hopes to be taken to a hospital. Instead a affertdavit is written up and a warrant is issued the next day for AGG ASSAULT W DRADLY WEAPON? And this happened in Dallas county
This sounds like a difficult case for the prosecutor to prove. Many cases where there are no injuries and the so-called threat was reported a week later, make a reasonable person question whether the event took place and whether they were actually in fear for their life. This is why it is important that this information be presented to a grand jury to potentially no bill the case. Hope this helps.
Same thing happened to me I supposedly pointed a gun at someone and they reported it a week later, the “victim” got his whole family to go and support him and the cherry on top is that him and his brother jumped me and threatened me with a knife and did damage to my car but the police didn’t do anything cause again he had his whole family back him up and I ended getting arrested for aggravated assault…oh and by the way the victim owns a gun and I don’t but apparently I was carrying a gun that day

@@4208jason the system is totally wrong, I admitted I wanted to harm myself after my mother yelled and pushed me to the ground when I got up my mother was in the way pushing me from leaving the room she was blocking me in so I accidentally cut her leg then they slapped me with aggravated assault charge and sent me to a mental hospital even when she said she didn’t want to press charges. They charged me a MINOR with mental illness on a serious charge which makes me want to harm myself even more. It’s so messed up.

In North Carolina you CANNOT present or display a weapon (gun knife etc). Gotta keep your cool and your camera phone 🤳.

Every state is a little different in terms of how they word their Penal Code but it should be similar. I practice in Texas exclusively.
