    Pretty sure Amazon cannot sell those. Lootboxes where you get more or less value than exactly what you pay for should qualify as gambling, and I am pretty sure Amazon is not licensed for that kind of thing and neither are these sellers, so this is flatly illegal.

    • @thiagopepper
      @thiagopepper 2 года назад +73

      @@OnceShy_TwiceBitten i think that TCG booster packs are a bit different. The manufacturer doesn't sell singles. You can't buy a $200 Alternate Art Charizard V or a Base Set Charizard directly from Pokemon Company International, so they don't have a MSRP. You can argue that all cards are worth about the same to the publisher because they are, essentially, equally sized printed pieces of cardboard. They only have different values in the secondhand market. But GPUs aren't all equal to the manufacturer, they have different costs, sizes, parts and materials, and because of that, different MSRPs.

    • @thiagopepper
      @thiagopepper 2 года назад +15

      Think about it like weight: all booster packs weigh the same. They all have, roughly, the same quantity of material. But a 3090 has a lot more components and materials used than a 710 GT. Hell, just in the heatsink alone you can see a difference in the quantity of copper and aluminum used, and how that would definitely affect pricing.

    • @reladox8517
      @reladox8517 2 года назад +6

      @@thiagopepper I think it’s more along the lines of the packs having a set value. For example, if you wanted to buy a magic the gathering Ikoria booster pack, despite the fact that you don’t know what cards you’re getting inside, an unopened booster pack from that set is worth around $5, and if you don’t open it then it will retain that value. This graphics card “mystery box” on the other hand sends you one of many different products with different prices, they’re not sending you a product that no matter how many times you open it will have a single definable value, and even worse it looks like they aren’t giving a full list of all the options you could get, aren’t giving exact chances for each item, and haven’t verified that the rates are actually what they state.
      Now, you could try and argue that with card booster packs you still don’t know what you’re getting, I mean after opening one the cards inside could have a total value anywhere from less than $1 to over $1000, so wouldn’t that be considered gambling too? Well, not exactly, at least not anything that Amazon would be responsible for, they’re selling you a pack of cards with a set value and you know exactly what you’re getting, 1 pack of whatever set you’re ordering; now sure you can open that pack, get all the individual cards, and then take them each at their individual value, but you could have left the pack sealed and it would have stayed worth whatever a pack from that set is. Now, when people start selling mystery cards where they give you opened cards at random, or even self made packs from cards they had already opened, that gets back into the territory where it might not be allowed; especially because while companies like MTG and Pokémon can be held accountable for the rates of cards inside of packs, and they have done all the necessary paperwork and followed all the rules to produce these packs and sell them, none of those things apply to these random “mystery box” sellers on Amazon

      well, if you get the right guy amazon work fast with audit and closing shops. I managed to have a shop close for "suspicious of fraud".
      Basically I was buying an xmas present for my brother (an epson xp2100) that was underprice. Like it was 70€ instead of 90, but since the xp2200 was behind the corner I said "well, they are cleaning the surplus". Make the payment and in like less than a minute I got 3 email from amazon:
      the second one was "we got your money, but the product was out of order by the time you clicked "buy". you'll get your money back in 7 days". There were 10 printers ready to go.
      the first one was about "we tried to get yor money but there wasnt enough on your card. No charge was applied on your card": I did just recharge 80€ just to be sure
      the third one was from the vendor that said "there was a problem with your order cal me at this number". It was an american phone number, land line. I'm italian.
      contacted the vendor with amazon self help. sended him screenshots of the payments, of the mails, ecc. He erased the chat history in ten minutes flat.
      called an operator on amazon with their chat. He recovered the erased chat and screenshot. he did see that a lo tof people got the same problem. He did speed up the refund (three days), put an audit call on the shop and suspended ASAP the shop on "suspicious of multiple frauds". Basically this f**ker had a bot clean the disponibility queque each time someone tried to buy something (so your transaction was canceled), then send a fake amazon message that there wasnt money from another account with a name in ascii characters that resembled the word amazon (so you tough it was your fault) and a message in his shop name to contact him and sell you his things without amazon as intermediary. And of course without warranties nor certain that you WOULD get the things, the cheapest, non trackable, non inusred shipping, etc etc. I dont think he'll ever manage to open another shop in amazon from all the blacklists he will have got on his name XD

      There are laws though. They can't outright lie or at least they need to be careful with that as they could get charged with false advertisement.
      So companies use vague wording and have use big print on some parts and small print on others to try to mislead consumers without outright lying.
      The most important thing to keep in mind is that companies are organizations created to make money. So if you are buying a product of theirs you are giving them more money than they used to give you what you purchased. So if you get something that's worth more than what you paid for then you need to assume they screwed over many times that number of customers by giving them less than what they paid for to make profit.

      Well, it's ok if they're transparent about it - if they offer you a $20 box of, say, 10 items all of which are second-hand and were lying in a storehouse somewhere, there's no issue imho. A tinkerer's paradise, so to say. It's when they claim ridiculous percentages of certain items that just cannot be correct due to their value. And if the mystery box is supposed to contain some "brand new" stuff, that's is doubly fishy since it looks just like a gimmick to get more people to risk it.
      On the other hand, buyers should consider basic economics. Why would they sell brand new stock in a mystery box for $100, when they can easily sell it at full price the normal route? How much junk do they need to sell to break even? No, only used junk that no one really wants is put into these mystery boxes, cause underselling something is better than throwing it away and paying recycling fees on top of that.

Once all the listings from the seller are sold, seller stops listing shit, or at least they appear to have stopped. Reality is they just create another seller and continue from there. It is not rocket science, has been done for years. You cannot sue a company that doesn't exist or has filed bankruptcy, because these types of scammers would open a "company" on the name of a random person whose ID they stole, and then IRS goes to check the person and it is an 89 year old lady that cannot even see yet alone operate a computer and open a company online, I have seen it with my own eyes.

That's part of what a FBA-seller has to agree to.
    EDIT: Should add, if the seller also sells the product via a Marketplace-listing (sold and shipped by the seller with the frankly unspeakable name) then a potential buyer would have a much harder way to fight this purchase. I showed this video to a guy I know in Amazon's customer service and he recommended sending it back.
    He pointed out that despite the bullet point that says they don't allow for returns, a bit below the "Add to cart" and "Buy now" buttons there is a line that says "Return policy: Eligible for return, refund, or replacement." The fact that it was missing that screw, he'd arrange a return due to it missing parts. Other reasons for a return could be defects or damage. Likely you could return it for any reason you want, though there may be a return shipping cost deducted based on the reason for the return.
    The best part is that if it gets returned and refunded, the seller doesn't get paid for the sale.

      For the record, I'm building gaming rigs since '92 and I never once bought a part from Amazon...in my case Newegg helped me build my business so I'll stick with them...

Honestly every time I do I think about how Bezos is getting my money but in reality I have learned to ignore it. I drink coke, eat at McDonalds and use amazon, if I started thinking about if everything I am doing is lining billionaire's pockets I would go crazy and frankly I am too insignificant to pretend like I will make a difference anyway.
      I am personally in the UK so I wouldn't use Newegg but we do have other places. I am just used to Amazon plus I have prime (which to me is actually quite good as I use it often to watch prime shows/movies). But didn't Newegg have some controversy recently? Specifically with returns? Which honestly is another reason I like Amazon as their returns policy is seemingly really great from my perspective. Not saying all others are bad but can you blame me with sticking to what works?
      I have a low threshold for stress. Building my first build PC was extremely stressful, even though every where I looked they said it was easier than it looked. It took me a long long time to get the confidence to finally buy and build. Amazon is just an extra thing I don't need to worry about.

As for the political angle you make reference to: I am all too aware of Amazon's woke cancer and leftist politics. No one is more against that garbage than I am. I buy from Amazon because their market presence is too strong to ignore when I actually have to live within my budget. And as much as I hate to say anything positive about Amazon, I find pricing on all types of products (including tech) is very competitive and their product return policies are generally consumer friendly. As for Newegg (and their predecessors): I also shop and buy from Newegg---including $1000 on this current build. I imagine every tech shopper does business with Newegg? But as GN recently highlighted, their business practices are far from angelic. Very far. I like the fact some consumers refuse to buy from Amazon, and will fight to defend their right to make that free-market decision. My own free-market purchasing decisions are no less important.

They aided in the scam if it was clear that it was impossible that they had been shipped goods that were representative of the range of outcomes listed on their website. There has to be some duty of care. I also think this is clearly tantamount to gambling and the prevailing laws should apply too.
      Ultimately this is the problem with globalization. There is no true legal jurisdiction so it is just a breeding ground for scammers and criminals, as effectively there are no consequences, so people are just going to give it a go. Though I have never really lost any money on Amazon (scammed), they have a ton of 3rd party sellers using their site as a store front, and some of these 3rd party companies have very unsavory business practices. No matter how much trouble you had with an order, Amazon will simply NOT do anything to crack down on them, or ban them from doing business via Amazon. I suspect nothing changes for (2) reasons, (1) no matter who you speak to at amazon, you word is never going to make it to corporate, the real people in charge that make changes. (2) It's pure greed, Amazon is not going to bite the hand that feeds them. Unless I really know the 3rd party company, the only way I make purchases on Amazon is if...the product is listed as fulfilled and shipped by Amazon.

It's amazing how much weird generic Chinese stuff is getting there and being promoted or magically showing thousands of positive reviews, when the products are clearly bad... One thing i just can't stand and understand is when the vendors chnage the publication entirely and they are selling something totally unrelated to what's being discussed in the reviews... Reviews on Amazon are censored. I bought a new battery to fit my mobile phone a few years back, marked by Amazon as an authentic manufacturers battery. It was sold by Amazon not a third party trader and it was a fake. It works OK, and lasts nearly as long as a genuine one, but it was a cheap Chinese clone and twice the price of the other cheap Chinese clones. I left a review stating all of this and it was deleted within 24 hours. I managed to get it put back by complaining, but it left me wondering how many other reviews are deleted, and how many other people argue about it to get them put back, as I did. I have no figures but I am very wary of Amazon's review system now.
