Income and Assets After Your SSDI or SSI Award

  • What does Social Security say about non-employment income you earn after approval or about assets you may own or acquire? Possible offsets to your disability payment will depend on the type of disability you are receiving.
    If you have been approved for SSDI, you do not need to worry much about non-employment income - such as passive income from rental property, long term disability payments, or income from a trust. Your SSDI payment is a function of your earnings record and the law does not call for an offset to your SSDI monthly payment.
    Similarly there are no asset limits which apply in an SSDI case. This means that you can own a house, car, boat, paintings or any other asset without any threat of offset.
    SSI claimants, however, face different rules. Since SSI is a needs based (welfare) program, there are a variety of income and asset limitations that apply. If you exceed either, your SSI payment will be offset and your monthly payment will be reduced.

    John! thanks so much for videos on how to win at SSDI, my daughter fell and broke her ankle in several places. She lives with us, ( mom & dad) and has fighting for many years now. And my sister is living with us, going to start the battle with SSDI.

    I've been on SSDI for over 15 years, and this info sounds right. Strangely we can get misinformation from Social Security themselves when we call them. I even got a bill from them for $16,000 for 'overpayments' even though I'd followed everything they'd told me on the phone.

      K's Thought Palace I was wondering, How much Passive income can I make while on SSDI?? Lets say I own a 4 unit property and each unit pays me $650...If I can prove I dont do any repairs, do I kerp my SSDI?..

    Reason I say after one has been on SSI is it seems everything online says sure, one may own a car per ability to get on SSI but it never says what happens if one does not have a car so one is on SSI a while then finally is somehow able to get that needed car. Is that after the fact of having qualified for SSI disability & getting a car then a problem? Anyone disabled who can drive is in desperate need of a car so it seems they are being punished if they buy a used car for 5k which is of course over that 2k. Not like going out to buy a new 40k car but no one is likely to get a car that actually works for under 5k so I'm using 5k as example of person on SSI 2 years or longer going to buy a car then. It would be the only car but it was not there going in SSI.

    I was approved for SSI for four months so I can make it financially until I start getting SSDI. That is what the letter said. I have a phone interview next week with SSI to discuss financial and residence issues. I have not had any income in three years and only own an old mobile home that is in mine and my sisters name. No other assets at all. Is this a normal procedure? The letter said partial favorable, but onset date for SSI said only the past four months. SSDI said march of 2017 even though my attorney asked for it March of 2016. Is this the partial favorable decision? Thanks!

    Are there any issues with Buying rental property AFTER already being awarded SSDI Benefits ,and of course receiving the passive rental income? or does any status change because the rental property was purchased after being awarded?.Would this put me in a "self Employed status" even if i'm not performing any SGA?

    How long does it take special need trust to be set or done ? Few months or few days, for example My Mother on ssi and I would plan to help her out because she might win car accident case and she is on ssi ? So she is 75 years and I don’t want her to loos her benefits via ssi so how long does process will need to be set?

    It may not be a problem with SSDI itself but it can affect if your eligible for help paying Medicare, also from what I read depending on the state you live in owning a vehicle is something they take in consideration if your trying to get help with it or prescription plans . you really gotta watch everything and keep your receipts!

    I'm on SSDI & sold some personal belongings [records, electronics used gear] I received a 1099-k because it reached over the Illinois State threshold-$1K.
    IS selling personal affects allowed w $910 threshold/monthly? I received help where I could to facilitate but still limited because of my ailments. Will filing a return trigger an SGA test from SSA? Granted, most of the items were at a loss but some had profits over < $400 cause they're collectables? Do I retain counsel?

    I was approved for SSI, my question is I had a private insurance Aflac to cover me if I became disabled, I was paid for two years from this insurance company. My case took three years to be approved will this tax free insurance premium affect on what I get for SSI, can they count these payments against me. Thank you

    My mom has been receiving SSI for more than 10 yrs and recently qualified for a car loan but I am a cosigner on the loan. Will she come under investigation if she doesn't report it. And if she has to report it how will her benefits be affected?

    I qualified for SSI the same day my divorce went thru. The marital house is on the market, when it sells I have 30 days to spend the money and show no assets, with the exception of 1 car and a dwelling that I am living in. SSI says because my ex lives in the house and I don't, I can't receive my 1st payment until it is sold and the money spent. I qualify for a loan but I have to have received 1 check from SSI in my bank account. I am in a catch 22. Can I put a down on a home, with my children and me as the owner to get the loan or can I buy my son's old bravada for all my money? Trust me it isn't worth 1000 which meets their asset requirement. I know I can't give it away. I feel my only option is to rent a room at some swanky hotel with room service and throw a huge party till I'm broke. That would leave me no assets and being homeless.

    i am getting so many different answers so i hope you can help. I get ssdi and sold some artowork left in a storage unit after my grandmother passed. it sold for just over $12k im being told i need to report it to the irs as income and im also being told that it can be filed as investment income

      I would talk to your tax preparer about what and how to report. I would think that proceeds from the sale of an asset would not count as employment income, however.

    Thank you. And this might be a tad off topic. If an SSDI recipient chooses to return to work, they make over the allotted ticket to work income; it is clear that the case will more than likely be closed. With regards to the medical condition, what will happen if a year later there is a medical relapse? Would the individual need to reapply? Also, if the individual is awarded a winfall; will the funds need to be turned over to SSDI ~~ within the nine-month trial period? And what if the windfall arrived after the SSDI case is closed, are they still required to pay any money to SSDI? Do you work with such cases?

      Yep. For SSDI (Disability) Writing a book is an sga. (Significant work act.)
      It would be like saying you can't do anything physical to earn anything, then you go and do a bunch of yard work. Which is a type of job.
      If you have any ability to do anything they will try to cut you off.
      For SSI they take off $1 for every $2 you earn. Until you have no more income from SSI. With a small exception of about $64 for hobbys that might pay a little.

    We visited the Social Security administration office and they told us that That Because I worked 12 months that the SSI would lower what my husband would receive in Social Security disability so bottom line Social Security disability is affected by how much I worked and whether or not he gets SSI included in that

    So if I'm understanding you right, income earned in passively from things like renting out property and such is fine. I'm wondering if this also applies to stocks (particularly anything that pays dividends, or if you just buy/sell them), REITS, and that sort of thing. I would also presume that interest on savings and CDs (Certificates of Deposit) would be okay too. I'm curious since I know you have to pay taxes on interest from savings, and dividends (capital gains tax). What I think I'm really confused on would be something like a REIT (Real Estate Investment Trust). Since the way you get paid on those is from what I understand treated very differently and taxed differently. I'm guessing at the very least it may raise some questions and potential review (even though you aren't working or anything). I am asking in terms of if you are on SSDI to be clear. SSI I am fairly positive it is NOT okay. If you could give me your input, I would be very grateful. Have a nice day.

      Yes, unearned income (passive income) from stocks and other investments is generally not considered the product of "substantial gainful activity and therefore won't count as work earnings. Obviously if you set in front of a computer monitor all day and trading stocks is your business then that would look like earned income. The more income that shows up on your earnings record the more likely that SSA will ask questions. You are correct about the impact of passive income on SSI. Basically I think you have an accurate understanding of passive income and SSDI from what you wrote.

      Thanks for your prompt reply. I was reading about REITs and how they are considered for tax purposes was what got me thinking. Since you can buy them like stocks, but you still aren't working or anything and they basically just are a way to invest in real estate without major exposure. The other things I presumed to be fine, but I'd rather ask someone who is more knowledgeable. On a side note, have you done any videos on what is defined as "substantial gainful activity"? I have been doing some research on the topic and for income purposes there are two numbers (aside from being blind or something else) that show up. One tends to be higher than the other. I think this would be a great topic to bring up in a future video. I'm trying to remember what they were, but they more or less dealt with how much you could make. If I remember right, one was like 7xx or 8xxish, and the ceiling was approximately 10xx - 11xx dollars. Aside from that, keep up the good work. I enjoy watching your videos. They are very informative and well done. Thanks again for answering my question in a prompt and professional manner.

    I have been approved for SSI. I live with my parents and don't own the house or own a car or truck. The house is paid for. I do get food stamps. While these things are true while I was working I paid my parents 90% of my income for bills. Will all of these factors effect how much I get?

      Jonathon Ryback as you’ve probably found by now it absolutely will decrease the amount you receive. SSI seems to believe that all parents are readily willing and able to pay for their adult children. They are totally ignorant of the unhealthy relationship dynamics this causes. It’s absolutely horrible and inhumane of SSI to treat the most vulnerable among us in this way.

    For SSDI what about independent day trading while you are waiting for a hearing and after being approved for benefits? It is not employee W-2 income for SSDI. If it can be done from a reclined position say a few hours a day on a lap top from home? My understanding is, it is treated like any other investment income (stocks, real estate etc.) being that there is a chance of loss as well as gain. and how do you respond to a judge if it is asked at your hearing because net earnings are found reported on a 1099B?

      I think that the judge will focus on the nature of the activity you are doing. Obviously day trading does require a certain level of concentration, attention to detail and persistence. These are all characteristics of competitive employment. On the other hand the time expended is not consistent with full time work. At best, earnings from day trading and evidence that you have the capacity to concentrate for extended periods of time will muddy the waters. Some judges might conclude that your day trading is "substantial activity" and use that to deny your claim. I would focus on the limited amount of time spent at any one time and the control you have over your work environment to differentiate from full time work.

      Day trading on a steady basis might very well considered work. Not worth the effort or risk. If you're successful you lose your SSDI benefits.... If you're not.... You lose your benefits after they were paid to you. Sounds like a bad idea!

      You will get payment letters from SSA setting out how much your monthly benefit will be and how much your lump sum will be.

    What is the limit one can earn while receiving disability in 2017? I'm thinking of starting an on business like affiliate marketing. Would it be considered a job, and have my benefits cut? Thanks for your time.

      For SSDI cases, the earnings limit in 2017 is $1,170. This is not the same as a trial work period month, which is $840 in 2017. Affiliate marketing would be considered earned income I believe. My experience has been that if SSA sees consistent reporting of income, month after month, your file could be flagged for a continuing disability review. See also www.ssa.gov/pubs/EN-05-10095.pdf.

      If you register a company and get income then you are doing an SGA. (Significant Gains Act.) It will trigger an audit and likely lose benefits. Unless you are on the Ticket to Work program. It gives you 3 years with no audit trigger.
      So you really need to commit to get things rolling. And if things work out you will lose SSDI but you are making your own income now. Which is the whole point of Ticket to Work.
      One exception is if you are in a partnership and you can show you do less than 20% of the work for the company. In other words, if your partner is running it, and you just guide them with general knowledge, then it 'might' work. But that is a loophole that will likely be closed. And you will still be audited regularly.

    My court date was Apr 12th and my lawyer cancelled. She said that she had given them specific dates she wouldn't be available and they gave hearing on that date. Does this really happen? Also I've been waiting for over 18 months now and I live with mother. I'm 46 years old. Should she have had my mother and I sign a loan of ISM in the beginning? She said I have to go through her for the contract and it's only valid from the day it was signed. She also said we cannot get any retroactive payment. Any help would be greatly appreciated

      My experience has been that SSD judges are less receptive to records from foreign countries. Objective tests like MRIs or CT scans will still carry weight but records in foreign languages are not going to help you very much.

      Be careful of the asset limits SSI has... and remember, since SSI is a welfare program any assets you have or receive must be reported and will be taken into account for your continued eligibility to receive benefits. Buying and owning a $50,000 vehicle is going to be an issue.

    My father is planning on setting up a trust for his property and his money. My question is if I'm named as trustee along with my stepsister is it counted against me if say the trust pays off my house? I only owe about 40000$ on my house now. I'm not planning on him dying anytime soon( Lord please) but don't want to do something that is going to get my medical or checks cut off. I'm on ssi

    I am getting social security survivor disability checks from my husband dying and me having major health issues. I have 2 lawsuits going. One is for overtime pay I did not receive when i was working. The other we will not go into. How will this effect my social security disability? I also want to sell my home and get a truck and a motorhome bought right out. How will this effect my social security. The home I'm in is just too much for me to care for anymore.

    If (my wife) is approved for SSDI, is she still able to sell her Makeup which she makes $50-$400 a month. Its really normally close to like $150 per month as an average. Or can she continue this while waiting for approval. she is currently on FMLA, short-term disability.

    What if he did not have a car when he got SSI but he needs one of course so he somehow got 5k or something for used car then bought while on SSI? Say a relative gave him 5k to buy one car after he was on SSI disability? Does that count the same way as just one car like if he had it before he got SSI or does he just lose SSI because he later got a car to help him get to the doctor etc? Interesting things but is very sad how it all works for those in real need. Seems like can't even buy a car if you don't have one after receiving SSI for some time.

    What if you inherited the house in a living will an you brother was the executor of the will and co-signed for my mother ps second motgage after she passed I didn’t know what to do so I paid the bank for 8 years before my brother bothered to probate and he didn’t do what was in the will or the promissory note and I lost the house to forclosure and noe I’m on disability and have no where to live and can’t afford a place to live it has caused mental trauma

      Not that I’m aware of.. SSDI is not a welfare based, only when you are working & receiving income that will trigger a review.

    I have a friend on SSDI. She will receive her mothers house, but is concerned about affording taxes and upkeep on it. Can she rent it? Can she sell it and buy something like a double and rent half?

      My guess is that if you have extremely high unearned income that may prompt questions from SSD about whether you are really engaged in substantial activity to produce that income.

    I've just won a mental health disability case. I haven't even received my first payment yet. I have been working short, irregular hours during the period I claimed disability and made slighty over $1000 a year. Because there was so much scrutiny by the judge over this, I'm afraid to continue working at all anymore. I wouldn't want it to jeapordize me down the road. If I continued working in any capacity, would this be unwise for the sake of getting compensated? What are the rules on this? Thank you.

      I do not think so. However, my practice focuses on representing people trying to qualify for disability. I do not get involved in income and assets issues. This would be a better question for a CPA or an elder law attorney.

    I have a couple ventures in mind that may end up paying a substantial amount of money. The emphasis is may be realized. I am thinking about having my kids set up a trust in all of their names. Everything is going to them when I die anyway, I do not know the best course of action that keeps the royalties and so forth out of my name but in my control. (Inventions, several books ready to publish, etc... hobbies turning towards realization.) We are on Medicaid. Will this keep the government away from the recovery of funds from our estate? I also stand to inherit a substantial amount of money as well as income properties. Ideas?

    Is it true that if you win SSI , do they try to keep your back pay? I've been living with a friend for past 9 years because I am not able to work and my life has been a nightmare!! Now I'm hearing that Ssa will use that as a resource and deduct money from my back pay for having a place to live Is this true?? I won my SSI December 2019 and I'm still waiting to have this interview regarding who gave me what so that they can take it from me:(

      SSI will offset your benefits for room, board and other non-cash help you have been receiving. These are called the "deeming rules." One thing you might want to do is have a written agreement with your friend whereby you agree upon a monthly rent and monthly loan for food and necessities and you agree to repay this money upon receipt of your SSI.

    I was awarded SSI over 6 months ago and have yet to see any benefits my lawyer seems to be severely mentally disabled and is unable to properly speak to SSI on my behalf what can I do I went to the office signed all of their paperwork I have no funds no income no assets whatsoever and they keep coming up with these random pieces of papers for me to fill out that keep asking me about my income and assets I have no money whatsoever that's why I applied and was awarded SSI but the financial department will not do their job what can I do

      Did you pay enough into the system with work history to get SSI at all?
      Some people only get $80 because they haven't worked enough. Some get nothing. Maybe they're trying to figure that out with work history.

      I’m sure it would kick you right of SSI. Someone helped me pay my rent for 3 months just before I was approved because my landlord wouldn’t help me get on General Assistance. They consider that income and even though I do not have help with rent they are deducting it from my monthly pay. It’s a horrible spot to be in. It’s horrible to be treated like a criminal and expected to live on $600 a month.

      @@elsagrace3893 Get an ABLE account and have them put the money there. It's tax exempt and SSI, Medicare, Medicade, etc... all ignore it as an asset. It has an age restriction of 26 though. Very unconstitutional with the ageism and no reason for it. It needs to be fought in court to change that. It also has a limit of $100k until SSI see's it as an asset. So it won't buy much of a house.
      There is also SNT (Special Needs Trust) made for a similar purpose with no age restriction if you have a disability, but it is more strict on what you can use it for.

      Normally 25% of any retro benefits capped at $6,000. Paid directly to your representative by SSA should you get a favorable decision. Therefore most won't take cases that are losers.

      A spouse's income can been used to offset your SSI. This is called "deeming." You may want to find an accountant or elder law attorney who can run the numbers for you.
