Teller won a copyright suit over the use of his "Shadows" pantomime years ago, so the illusion isn't copyrightable, but the routine is. The big issue is that expressions can be copyrighted, but ideas can not. Because of this both magicians and comedians have very tight internal standards regarding thievery, and sometimes in the case of magicians revealing specific methods. Interesting stuff.
