I think they were wrong to say "mistake of fact." It should have been factual impossibility (impossibility in fact). Mistake of fact deals with negating mens rea requirements. But what do I know, I'm just a lowly 1L. :(
Isn't mistake of fact a defense if the facts as you believed them, if true, would not have constituted a crime? Not necessarily a complete defense, but at least a mens rea defense? Also, I thought "substantial step" was MPC attempt. Isn't common law the "all but the last step"?
Your crim law professor is wrong. Mistake of fact is not a defense when, if the facts were as the actor believed them to be, a crime would have been committed. The pickpocket here is guilty of at least an attempt.
