How to Add GDPR Options to a MailChimp Sign Up Form

- In this video, I show you how to add GDPR options to a MailChimp Sign Up Form. GDPR stands for the European Union General Data Protection Regulation. The Regulation begins May 25th, 2018. Over the last month or so there has been a significant push for businesses that in the EU or have clients/customers/email subscribers/etc. who are EU citizens to be in compliance with the new regulation.
MailChimp rolled out GDPR options last week as part of their Spring update.
How it works
Enable GDPR Options in List Settings
Edit the GDPR Options in the Form Builder Settings
Create Segments from your GDPR Options
Create a campaign, using the Subscriber Alert GDPR Theme to Email Your Contacts asking them permissions for consent to opt in to your GDPR Options you've set up
Once opted in, you will need to send emails to those segments who've opted to receive the information.

Larry, might you have an update on the opt-in links to MailChimp? I have a WP.org site and the optin plugin I have only uses embedded forms. Desperately trying to figure out the best course of action and research is getting me nowhere! Thanks for any help you can provide.
IGNORE!! Me again. Just to let you know, I used the regular URL for the signup form in my Optin Plugin and it worked. No need for embedded. Well I didn't expect THAT after an hour of research! In case anyone's reading this and having the same head-scratching moment, I'm using Optin Forms by FancyThemes. Phew! Thanks again Larry.
That is the strangest thing from MailChimp to not to include GDPR options in the embedded form. I use a plugin from Ibericode (MailChimp for WordPress) to embed the MailChimp form. I'm waiting for an update to their plugin to use on my and client websites. Thanks again Sue!

Great video Larry, have set up MC for GDPR as you describe and following making a test list where a mock user selects the checkboxes they want, I went to test with a mock follow up email. It seems you can only choose one drop down (subset) at a time. It's rather clunky and time consuming, have you found a work-around?

I believe Belgium is in the EU so yes, you must comply with the GDPR. I suggest going to a GDPR source closer to home for specific Belgium requirements to double opt-in.

Do you know if it is possible to send those from the EU to a different sign-up form than those people not in the EU? (I have a lead magnet and would like to send those in the EU to a different sign-up form that those that opt-in outside the EU. Is that possible in Mail Chimp?)
I don't believe so In order for that to work MailChimp would need to capture Geolocation/IP address to determine if they are visiting in an EU country before someone fills out the form, however, MailChimp only captures Geolocation/IP address (if available) only after the form has been filled out.

You know, what bothers me about these GDPR forms is, that you can't put a link to the privacy policy into the legal text. You can put it somewhere else, but then it's not stored in the snapshot that Mailchimp creates from the GDPR fields at the time when the user signs up.

Do you mean the embedded form for new subscribers? The GDPR options are not supported for the embedded form so you may want to add some language what they are signing up for and that by completing this form they are giving consent to a) be on the list and b) to be sent emails with X content type.
Larry Snow Yes, I mean the optin I have on my homepage. So, I would need to add that text underneath the option form? Also, would I need to now change that list from my original to the new segmented list? This is confusing ;)
Larry thanks for your video. It is so helpful. I did all that you are suggesting and my segments for all the lists are working. Today, I faced an issue with my subscribers. They appear as opted-in by me (admin) and not by their free will. Please tell me what might went wrong.

Not quite how that occurred. When I check mine, it says opted in via email. Did you send the themed campaign GDPR subscriber alert for your subscribers to opt in?
Hi Larry, Great video. Do you know how long it will take before the Segment lists are updated? I noticed that the list didn't automatically update in your video. When I tested it myself I had the same issue.
I also noticed that when I set up the options as groups they update automatically

Terrific video, Larry! I do have a question... what if we segment by email and advertising, but in our email newsletter we also "advertise" our services? Do you know what is considered "advertising"?
Hi Pamela, thank you! The options and messaging are up to you. Be as specific as possible so that your contacts know what to expect and that they can opt in or out at anytime. So instead of a general category of “advertising” use a specific option like some advertising in the newsletter but not retargeting for Facebook.
Hi Larry. Great video. Very precise and clear. I have a problem using the GDPR feature, because we keep consents in our AutoDesktop system. However, we want it to be possible to give/take consents in MailChimp as well. So I need to be able to import consent changes from our AutoDesktop system into MailChimp to keep the two systems synchronised. However, when importing I cannot assign consents to the contacts, when I use the GDPR feature. So instead, I have created a Consent Group with subgroups. This works very well, but am I following a wrong road here? will this give me problems, I cannot foresee right now?
How many are you importing at a time? If minimal, you can tick the gdpr options manually for each person you imported, which then will add them to the segmented list. You may want to ask MailChimp or Autodesk this specific question

Thank you for this excellent video. Just one question. If a recipient doesn't mark a check box I have to delete its contact details. Do I have to do this manually or is there a possibility to get this done automatically by mail chimp?

I've followed all the steps you set out but the update profile link in my test email doesn't show the Marketing Permissions section at the bottom only the Name / email update section. Any idea what I'm doing wrong?
As mentioned around the 8:18 mark in the video it won't work if you send a test email or preview. I suggest creating a temporary test list like I did in the video to make sure everything works.

Just 2 questions:
1- Re: Email option only: I am a small business growing with only a monthly newsletter and updates when needed such as a book or course launch.
I added the GDPR field, I signed the agreement, but in the opt-in form, the options (checkboxes), I only have email. I wrote ''email me updates and news''.
it's OK to have only one option, correct?
2- Re: Campaign: why would I need to send a campaign to my segment if they are the ones that checked the box ''email'' already?
That's a big question mark for me.
I would think that campaign should go to all the current lists.

Hi Rachel - thanks for the feedback, I really appreciate it. It's OK to have one option. The subscriber alert campaign you will send to all on your list to get consent and understand what you will be doing with their information. Consent creates segments (permissions) - those that said yes (checked the box) - if they didn't check the box you should not be emailing them. Going forward then, when you send out a regular campaign you will need to send only to the segment of the people who said yes.

But, regarding the alert campaign, my question specifically is if you have to send it to the new list (so, those who actually received the opt-in (GDPR proof) and therefore had a chance to check the box?
or, is the campaign meant for the existing list who signed up without consent?
I ask because to me, (and I may be wrong), this new opt-in (with GDPR checbox) is enough as consent, since it's all explained on the signup form. Or am I wrong?
Secondly, with this new optin form, can I still use single optin though?

Hi Rachel - the GDPR alert campaign is for those who are already on your list and have not given consent. For someone new joining the list, they would be filling out the sign-up form - using the "eepurl" link (or you can use the pop-up form) that have the permissions check boxes. Using this scenario, I see no reason why you couldn't continue to use single opt-in.
For example, would a single option to check that says "E-mail me updates, news, marketing campaigns and ads." also work?
I wouldn’t recommend one catch all GDPR option.

If you only have US subscribers and will continue to only have US Subscribers I don't see the need to add GDPR options at all.

I don't believe we do. You can receive a summary of who/how many joined your email list.

Not compatible with the MailChimp embedded form option. I don't think we'll ever see GDPR options in the embedded form. Hopefully MailChimp will prove me wrong. You can use the pop-up sign up form and the sign-up form link.
Hi Larry. I have completed the sign-up form as per your instructions. Great! so I am all set to send out re-consent to my existing list. But what about new people to sign-up? My embedded sign-up form in my my wordpress site still does not not take you to the GDPR friendly form. How can I show new people to sign up from my website? Thanks!!
That's what I'm waiting for as well Gianni. I use the MailChimp for WP plugin from Ibericode. They are working on an update to the plugin that will include GDPR options. Until then, I suggest adding language on what people are signing up for, how you will use their information, and by signing up they are giving consent for you to send emails. Once Ibericode updates their plugin I'll do a video on it.

Hi Larry, i've updated all my forms and sent campains to get the consent from my users. Thanks for the help! One question, do you know a way to make the new GDPR fields mandatory? I only use one field "e-mail", if this field isn't ticked of, i can't use the subscription for anything. I feel like it's my followers/customers that just forget about the field. I'm getting new subscribers these days without the consent, it's a waste of mine and their time :-/

Great video but What happens if someone doesn't want you to store their information but you have to on there invoice for HMRC
Legally, I'm not sure. I think in some instances you need to keep records of customer purchases. You may want to consult the GDPR regulation.

I created segments and when I go to view them it shows as 0 contacts (goose eggs), even though when I create a campaign for a segment it clearly shows number of subscribers. Does it take time to propagate the segment preview list?

letisha malakooti MailChimp recommends one list with segments to avoid duplication and better organization of your list. A side benefit is you’ll pay less since you won’t be paying for duplication.
Hi Larry, thanks for the video, much appreciated. I'm having a problem when trying to preview the segment for "Marketing Permission is Email". It gives zero results despite the fact that certain subscribers have opted in. The segment does work, however, when creating a new campaign and choosing this segment in the "To" field as I can preview the recipients and it shows the correct people. Have you noticed this or had a similar problem by any chance? Thanks
Hi Eoghan - Yes! It took several minutes up to perhaps 30 to 45 minutes in some instances to see anyone in the permissions segments.
Do you really think it's necessary to split "Email" up into different types of mails they get? Can't I just get the consent for "Email" and then send them a mix of updates and some marketing stuff?

Great video Larry. Thanks. I'm creating my first list with MailChimp and I live in Europe. I am a children's book author and will try to build my list so I can tell my readers/audience when my books will be published, where to buy them, etc. I won't be selling anything from my website for now. Do I need to add the GDPR consent for emails and adverts? What do I put in the description? 'I will use the info you provide to be in touch with you and provide updates about my upcoming books and events.' Would appreciate your feedback.
Hi Eleanor, yes you need GDPR consent for emails collection. You'll also need a strong privacy policy for your website. I can't recommend what to add on either of those there are lots of resources for legal advice in web searches.

What if you are just building your list from scratch? There is a field I have to check when manually adding a contact that says I have to already have permission?

The sign up form does not have GDPR? After you enable GDPR you have add the options in the form builder/sign up form and save your changes.
It is nice video but the problem is the users can subscribe on the sign up form even if they not check any marketing checkbox permission. They even get a mail that the subscribe was successful. I think these opt in checkboxes should be required fields.
Why they can subscribe if they not checked any permission? I think it is not allowed by GDPR.
Good question. Why does the embedded form option from MailChimp not contain GDPR options? I'd suggest you contact MailChimp for an answer.
MailChimp ignored adding GDPR options in the embedded form - so if you use it - technically yes anyone can subscribe without opting in to GDPR

Hi Carol - If you're asking about how many existing subscribers opened the GDPR email and took action, then look at the Report for that email to view opens and clicks. Also, check the GDPR segments and compare it to your overall list to get a ballpark figure of those that have accepted GDPR. If you're asking about receiving notification of new subscribers, then select the appropriate audience, then select Settings in the Manage Audience drop-down list. On the next page, click Audience Name and Defaults link. Scroll to the bottom of the page where you'll see the New Subscriber notification.
Hi Larry, thanks for video. I'm new to mailchimp and you skipped the part I was watching the video for. The link you have listed for the 'Update settings' (with web address) is what? Goes where? I thought it would link back to mail chimp account to notify me who subscribed. I'm completely misunderstanding something, if you can help, or maybe you have a video explaining this? TX
When sending out the "alert themed" email to your subscribers, the update settings link allows your subscribers to update their information and where they can opt into the GDPR marketing permissions that you've set. If you wish to get notified of new subscribers who join your email list go to List -> Settings -> List name and defaults, scroll to the bottom for notification options. I'm pretty sure you do not receive a notification if someone on your list updates their information or opts into GDPR permissions.
Ah thanks, I understand the web address url they require a link for in update settings button, is just going to a pre-made 'web url' from mail chimp for that persons email..... i dont have to insert my own website or anything there. i like it *|UPDATE_PROFILE|*

Just the Update Profile shortcode should work for your current subscribers to opt in to the GDPR options.
Hi, thanks for the vid. One question: You get a subscriber with his email ... but he doesn't check the "email" checkbox in the marketing permission ... now you have "subscriber" that you basically are not allowed to contact with your newsletter, because he didn't give you consent for email marketing... so his subscription is basically useless? am I missing something?
You can email the person to remind them they didn't select a GDPR option by sending them the GDPR subscriber alert template theme.
HI Larry, I enjoyed your video, although it was a bit fast for me as I am totally new to all of this! What I didn't get was the last bit: I have built my GDRP form: how do I send it out to my list, who haven't yet opted in (hence wanting to send them the form)? You show how to write an email and say that you cannot embed your gdrp form: so I am lost what to do (and panicking cos I haven't got long) thanks.
No need to panic. We're all in this together. For anyone new joining your list using the MailChimp embed form, I'm not a lawyer, but until there is a better more detailed way, I suggest adding explicit language to the effect of giving consent and a link to your privacy policy.
I think I haven't been clear. I have a mailing list I have been mailing for several years, some of it was inherited and some people gave permission. That list has been on Thunderbird on my computer. I have imported it into Mailchimp. Now I need to get explicit permission. Ah Ok. Start about at the 6:28 mark of the video. I walk you through the steps of creating a specific themed (subscriber alert) campaign to send to existing subscribers so that they can give consent by opting into the marketing permissions segments that you have created.
I am working my way through it: do I mark my list as subscribers even though they haven't subscribed?
Next I have got to the GDPR template - I have spent hours (cos I am slow here!) building my form for GDPR. I am now completely confused where that form fits in with this template? Also, if people click on subscribe, where does that take them, and how do I edit what I am offering. Sorry Larry, I am still really confused! Thanks so much for your help.
This wasn't quite what I was expecting (but thank you all the same!). I know how to add the options in the back-end, but how do I get them to display in an HTML version of the subscription form on your own website. Mailchimp don't appear to allow you to force the permissions checkboxes. This means people sign up but, if they don't click the 'preferences' button, they don't actually give permission to sign up to anything in particular. Has anyone found a work-around for this? Thanks.
Thanks Paul. So bizarre that MailChimp didn’t add the GDPR options to the embedded form. You may want to try setting up groups and adding group checkboxes to the embedded form.
Hi Larry - great runthrough. I have setup the GDPR fields and made it all ready for future consents and for collecting new permissions for existing recipients.
However, as to the existing recipients I have one concern when asking them to update/resubscribe. I fear that many of them will click on the link, see that their information is up-to-date and then simply clicking submit without ticking any of the boxes in the GDPR-form. What I mean is that I may end up with a lot of recipients who would actually still like to recieve my emails but they only check their own contact-info and fail to notice that they need to check the box(es) if they want to recieve emails.
Do you have any suggestions on this, other than trying to highlight that they have to make a choice before just clicking "Subscribe to list"? In my case, the optimal solution would be to make so the checkboxes are mandatory and they cannot click subscribe before having chosen either "I wish to continue receiving email" or "I no longer wish to recieve emails". But this mandatory option is not available :(

I completely understand your point. Are focused attention span is less than a gnat these days, especially when it comes to scanning on the web. I would stress the importance of making sure to tick permissions box and outlining the steps (1.2. 3.) they need to do. If you're not getting the desired response you can continue to email them at set intervals and mentioning that they will stop receiving your great content, tips, etc. if they don't check the permissions.
There is a way to make the checkbox a 'required' field by adding some code, I saw it yesterday somewhere but now can't find it, there is a way though! If I find it I will post it!
Update: the code I saw was for integrating it with Wordpress....
You had mentioned that Mailchimp's GDPR options are not available for embedded forms (which doesn't make much sense, does it?) A workaround might be to use something like Gravity Forms that integrates with Mailchimp and add those fields in manually. Do you see any problems with that?
Hi Pam - no it doesn’t make any sense at all! since that is the majority of use case for the sign up form. I use Ibericode’s mailChimp for WordPress plugin for embedded option - they are working on adding GDPR options. I don’t know enough about Gravity Forms to comment on your workaround - sorry

If you add your list into a 'group' similar to a segment then the check box will work in the embedded form.....
Hello, one thing, how do you connect that list you made with this "UPDATE SETTINGS;' as when I follow all you say suddenly I dont get that new SETTINGS< it shows different list...you also don't show how you connected that list with that email you send them to ask them to stay with you, so how to do it? thanks

Hi I changed the link in the BUTTON "Update Settings" which now points to new LIST SIGN UP with GDPR ( which you created in the beginning of this video) and now it works, but you don;t mention doing it that way, or yes?,...I think like this its easier..thanks alot anyway :-)

Thanks for replying so promptly. I’ve done all that and it says my list is GPDR enabled but when I then go to the forms it still hasn’t added the GPDR bit at the end of the form. I recall someone saying it doesn’t work if your forms are embedded but I don’t know what that means.
Hard to say what is the issue is; if it isn’t on the sign up form, not embedded, the form builder, then I suggest you contact MailChimp

You shouldn't have it "pre-ticked". You need your mailing list to tick it for themselves.
On your video it was pre-ticked on 9:11 min Email checkbox is pre-ticked and advertising is not, I would like to have the same but on mine, ones are both not ticked
It was checked off already because I had already accepted permissions for that GDPR option in a previous test email. I was explaining how to add another permission segment. Sorry if that was confusing.
I was thinking, would it be the same if I just wrote above the e-mail fields on my embedded form something like:
"By entering your e-mail you agree to subscribe to our newsletter and receive news, updates and marketing campaigns on your e-mail."
Isn't that better than adding checkboxes?

Sending a test email or previewing the update preferences email won't work. I suggest creating a small test list with which to test the process.

Hello Larry, I have seen examples of mailings in which the receiver of the mail just has to click on a button directly in the mail "Confirmation to receive newsletter". There is no link to a sign-up form. The mail is created with mailchimp. How does it work when we want to do it this way? thanks in advance.
That sounds like the Double Opt-In method. To be compliant with GDPR you still need a new subscriber to complete the content permissions. I'm unsure if the double opt-in method can do that.

Since the GDPR fields are not read-only (I can check the e-mail check-box for any of my contacts if I want, or manually modify the values whenever I want), how can those fields be a consent proof? Moreover, if I send a consent campaign, and my clients start completing the consent form, I don`t see this activity tracked in the history of my contacts. Therefore, I don`t understand how do you prove that Mr. X gave you the consent for emails (for example)? How do you prove that Mr. X checked the box, and that you haven`t checked the box yourself? Hi Matei - thanks for watching the video and commenting. The consent activity is in the time and date in the permissions segment. However, there is nothing that says Mr. X said no. Yes, I see what you're saying about the ability to check off the permissions and editing any contact information. Have you tested to see if you check off a consent permission when editing a contact does it add a person to the permission segments? If it doesn't then there's your proof of permissions - time and date in the segments. If it does add them, then I'd suggest checking with MailChimp support.
Yes, of course, you can manually uncheck the GDPR FIELDS anytime you like, and you get this message: "Mission accomplished. Permission fields updated". This is completely absurd, because you`re ot the one who permit it or not, but the clients you are asking for. And yes, the contacts dissapear or appear in the segment, if you check or unchech the boxes.
At this moment, I don`t see how do you obtain consent with the mailchip method. There`s no proof that I got that consent from my customers, and the approach is completely useless.
any news on this since Matei, in the same boat now, its hard to decide if to send a re consent email when its not actually being recorded. So in theory we could just be deleting customers of our list for no point when its not being record, plus I feel not everyone will see the re consent email that would have opted in, I miss emails all the time from companies I want to here from just because my email gets buried. Of course I want to stick with the rules though. whats your thoughts on this?
really I feel it should have been the other way round that people have to choose to unsubscribe, many people miss legitimate emails they want, sometimes it comes down to luck if the email is seen in the 1st place due to how many emails come into an inbox these days. It kinda feels like your throwing a stone into water and asking your list if you see the rock in the water you can survive on my list if you want. lol
For existing subscribers, it is tricky for sure. I'm not a lawyer, I can't advise you one way or another, I just showed you what MailChimp offers. Hi Larry, can you tell me the reason that once I embed the small embed subscription (enter E-mail / subscribe), the next item that a subscribe will get is the "thank you for subscription" message and not the general sign up form? It seems the order is wrong since I have activated the GDPR option for subscription. Thanks
The GDPR options do not work/will not show in the MailChimp Embedded Form. In your case, I'd suggest using the double opt in email to add in GDPR language and such (GDPR options will not be in the double opt in email either).
I really have tried all possible options and I was not able to find a satisfying sequential order of subscription notifications/subscription forms etc. My impression is that If someone enters the E-mail and press subscribe that the next form or link is the subscription form (including GDPR disclosures) and than followed there comes the "thank you for subscription" E-Mail.

Nope. The GDPR options are specifically for the Sign Up Form (web link) and the Pop-up form and I've yet to figure why MailChimp opted not to add the options to the embedded form.
It is annoying also with the double opt in as I have to confirm the subscription in the mail and receive the subscription confirmed link where I can "continue to the website" or "manage preferences", but I want to have the preferences for my customers directly. :-) Sorry for spamming....
Can you add the GDRP options on a Mailchimp Landing Page?
MailChimp should, but unfortunately no. I suggest adding language on what people are signing up for, how you will use their information, and by signing up they are giving consent for you to send emails, and link to your privacy policy.

I've tested the pop-up with GDPR options works just fine for me. GDPR options will only show for Top or None image alignment. Also, make sure after you generate the code to click the Publish button. I did a video on how to setup the MailChimp pop-up, in general, and many people have complained that the pop-up doesn't work. It could be a variety things. Such as web page builders, where you place the code, other plugins interfering with the pop-up code, theme options, etc.

WordPress and the MailChimp pop-up code don't get along (although I never had a problem on my website). Many people have complained that the pop-up doesn't work. There are people who are much smarter than me, that have created a possible fix for this incompatibility. I suggest searching RUclips for MailChimp popup fix.
