What you should do as soon as you recieve the first letter of hoa compliance is; file it away, contact a/your lawyer, and draft a reply letter stating that you do not fall under hoa jurisdiction, and any further letters or fines may lead too charges of harassment and further legal action

Why would anyone allow a construction company to tell a landowner they should contact the HOA if they want the work to stop? You should sue the construction company and make them sue the HOA. A business owner would stop immediately if they felt their business was at risk. When the cop said, "this is a civil matter", I would tell them I'm pressing charges against the construction company for trespassing. Trespassing is NOT a civil matter. That would have stopped the work immediately without waiting for a cease-and-desist order. I wouldn't care who hired the workers, I would go after the workers directly. Let them sue the HOA.
Allow the HOA to build the parking lot. Then every night there are cars, have them towed from a company at least 100 miles away. Then file a lien on each vehicle, the owner and the HOA for not paying $100/day parking permit fee.
No construction company will continue working on it project when a dispute is announced.
