Thank you clarifying the two protective thresholds. I have 20 months before my 20% ankles are "safe," so limping along until then to file for a rating increase.
That blank check you signed has always been blank since the beginning.
Good evening love your videos. I just have 1 question what does it mean when you get a difference in opinion on your VA letter and how long does it take for them to make the decision?
Im at 15 years beyond service connections, and 55 yrs old. 100%
Thanks for another informative video!! Would you please consider doing a video about claiming parents as dependents? The information available online is very limited, vague, and only give information for spouses and children as dependents. I haven't had any luck finding veteran groups or blogs with other veterans who could share their personal experience when claiming parents as dependents.
Where can we find VA appellate case law?
What if I'm 80% combined, but paid 100% TDIU Permanent and Total? I'm 63 years old. Can I be reduced? I don't have any current appeals or claims other than a request for my military medical records. It's listed as a Freedom of Information Act claim on my VA.gov. Does that constitute a new claim they could use to re-evaluate or reduce me?
What if you get 100 percent Total and Permanent, and you have an appeal waiting to be sent to a judge to look at that was secondary to your other claims like Gerd or hypertension, can they call you back in for C&P exam and lower one of your claims?
Yes they can. Then they can lower some of your other ratings. I would suggest that you keep GERD and HYPERTENSION as a back up. If they ever find reason to reduces your other ratings then you have these to submit. I’m 100 P&T. I will not submit anything else. I will have them established in my medical records. But at 100 P&T they take care of all your health issues anyway.
Is there a way to redraw those appeals that are waiting to be sent to a judge, I never requested an appeal they just showed up when I was checking VA.Gov

I am 76 and have been service connected since 2016. On my original letter the said my condition eas permanent and no future exam was marked. Can my benefits be eliminated? My disability is 20^.
Will the 10 year Rule start over if you get a percentage increase after let's say 11 years? Also, if you are awarded a new claim, will that start your time over as well?
🔥
What does this mean for a 100% rating that is issued as “total and permanent”? Can it be reduced?
Yes it’s never safe
I'm 100% P&T. What that means is that there are no scheduled examinations in the future. The condition(s) is considered static with no likely improvement over time. While they can reduce a rating they have a higher bar to prove your condition(s) have sustained improvement over time. Age is also a factor. They pretty much stop looking at your C-File once you hit 55. However, should someone be dumb enough to file a new claim while they are 100% P&T, the VA can look at all of your ratings and can propose reduction(s). And of course, they can reduce any rating if fraud is involved.
Yes, it means you aren't subject to routine revaluation.
@@daveb2280 There are many situations when someone should make new claims after 100%. SMC is amazing and well deserved if you rate it. If you have everything you need for a claim and you know you'll win, file.
@@daveb2280 they can't reduce your rating after after 20 years at same rating
what about the non service connected?
Non service connected can get a pension and travel pay to VA etc. I know, because before I got my service connected rating I received VA pension.
I've been 90% since 2010, then was finally awarded 100% P&T in Dec 2021. How does this work.
Good question. I think you're good
I thought it was 5yrs.
