- A 13-year-old boy carrying a "realistic appearing" replica firearm has died after being shot by police in New York state, US authorities have said.
The shooting happened after two youths were stopped by officers investigating robberies in Utica on Friday evening.

If he had been shot at that point, ie when he pointed the gun then it is a justifiable act by the police however he seems to have been tackled to the ground by one officer who had him under control when the second officer decided to shoot him. Maybe something is not clear in the video otherwise the shooting was not justifiable.

One youth bolted from police,drew a pistol from his waistband which was a Glock duplicate airgun. Pointed it at police as he ran into the dark .Upon seeing a weapon in the youths hand he was fired upon. Who is responsible for a 13 year old youth running the streets and commiting felonies?

13 year olds are too young to give consent so they are not responsible for ANYTHING they do regardless of circumstances. Apparently this young fellow will have to serve as an example to other youths about consequences of making decisions.

I think it's mostly questionable if the shot was necessary because of the moment when the shot was fired. The young boy was already brought to the ground.... Since there is no good footage of this moment we can't tell if the 13 year old still had the gun in his hand.

@@mariokrings That's the point though. We have the benefit of hindsight and watching video, and even WE have trouble being able to tell. The cops are having to make the split-second decisions in the moment, not knowing the gun /threat wasn't real. If we have trouble knowing how "under control" he was on the ground here, what reasonable person expects the cops to have known or hesitated as it was happening in the dark?
Maybe just don't run from then point guns at police?

To a cop there is no such thing as a toy firearm. They must assume any firearm, replicas included, are lethal and act accordingly to neutralize the threat. Cops quite simply don’t have the luxury of determining the lethality of any firearm pointed at them.

Can't really ague if someone runs away and shows a gun. Pretty sad really. It's a harsh penalty to pay but I don't think we can allow people to think they can run from police and produce a gun and not get punished for it. Crims already get away with way too much these days.

My 13 yr old son wasnt allowed out of the house weeknights, and he had a strict curfew any other night, plus I HAD to KNOW personally WHO he was with ALL the time. so he had very little time to get into trouble. at age 40 he told us, he had NO complaints about the way he was raised. and he raised his teens the same way. NONE of them ever ran with iffy friends or got into trouble, ever.

So the boy ran, stops, turned the cop, show a gun, he ran again, then he was knocked to the ground, and then shot? That doesn’t match what is shown in the video.
