    This judge was so jerky to that poor doctor. He’s clearly a softspoken man, a gentle personality; speaking at that level doesn’t come naturally to everyone. How about you upgrade your audio and AC in that 300 year old courtroom?

    They aren’t trying to convict her of drinking and driving. They are trying to convict her of motor vehicle manslaughter while driving under the influence and leaving the scene of an accident causing injury and death.
    So far they have proven that everyone was drinking and driving and it was snowing. They haven’t shown me that Karen was the party responsible for John’s death.

      The drinking and driving is part of it though, being under the influence of alcohol. But I agree there hasn't been any evidence to prove beyond a reasonable doubt that she is responsible for John's death.

      I thought so as well! Other than the “My cousin Vinny” paramedic…I feel like it’s been a sea of people who have been up to some shady type behavior. The BAC guy at least was honest about the fact that his test could be discounted if the samples weren’t good. Appreciated that.

      His honesty was the worst possible thing for the prosecution. Not only was he 100% willing to agree that all of his work would be worthless if the information he was given was wrong, he also demonstrated what an honest witness looks like. Dude buried the Alberts & McCabes without even knowing it

    The biggest bomb part of part 2 was when Lally handed the dvd disc of footage to the IT witness and IT witness said he never saw the disc and didn't make the disc hahha, i hope the jury caught that

      That was hilarious. In a not-so-Perry-Mason moment, Lally shows the guy a DVD that he had never seen before and proceeds to ask him about it. . .and then plays said DVD. . .and said DVD has no footage of Karen's SUV, establishing the fact that the library camera is able to capture footage of an intersection, which would be relevant but for the fact that a key part of the footage is mysteriously missing. Crushing it, Lally. Crushing it.

    My wife works in drug testing and collection. She is listening in on the calculations and she is flipping out. She has yet to have a court accept this calculation, she has to come in and testify with breath alcohol because it is the only way the court accepts calculations. Blood testing is thrown out. She is beside herself. She also helps with NDASA, National Drug and Alcohol Screening Association. She says even this good witness is giving bad facts. She says basically blowing out his butt. She is ONLY agreeing with you, Peter. She loved how you broke this down. Said great way to say it!

    I live on Cape cod. Where Brian Higgins lives is not near an entrance to the base. He's actually in my neighborhood. I used to do Jen's sister in laws hair. They were selling their narrative out here days after John was killed.

    My dad in the ER was at a .49 and he was able to still hold a conversation, was walking, and relatively coherent. He was a closet alcoholic that we knew was bad but had no idea just HOW bad. That was the day I realized just how bad his alcoholism was. We lost him less than 6 months later. Still breaks my heart we didn’t realize how bad it was soon enough.

      She should walk. Even if she actually did hit him. If someone can be convicted by the evidence presented in this sh*t show of a trial everyone should be very scared.

      Unless the prosecution has something up their sleeve then she should walk, no time in jail. If the jury finds her guilty for any of the charges then it lends to my belief that juries go into trials (realizing it or not) biased to thinking the defendant is guilty because "there must be enough evidence for the police to think this person did it and the state to bring charges"
      I've seen some trials where there was no way the defendant should have been convicted and they were. I'm worried for her because I don't believe she did it (again, unless the prosecution has some serious evidence they have up their sleeve) and I'm worried she's going to get manslaughter or a lesser charge just because the jury doesn't want to give the prosecution nothing.

      @@JohnR-it1dj what I’m surprised about is that people are arguing that the state actually has a case against her. That’s absolutely terrifying to me.
      I don’t know if she did it or not. But what I know for sure is that the commonwealth hasn’t convinced me of anything other than it was snowing.

    The judges’ demands for him to speak up just makes him more nervous and affects the perception of credibility. I’ve never seen a trial where the judge is so involved asking questions and interjecting .

      Well none of the witnesses remembered much once in redirect. Everyone said they were lying. Crossexamnesia was the joke. Now that trial is focused on alcohol, their testimony is not believed because they drank excessively.

    You wanna hang a person on a “guess” of what their blood alcohol level was at a certain time? As a juror, I wouldn’t put too much weight on this.

    All these police officers drink at a few bars and then go home and drink. Who’s to say Karen didn’t go home and drink????? Her alcohol level at 9 am is not indicative of anything!!!!!

    I was wondering if Karen having MS could affect alcohol metabolism and yes, I was thinking about all the different things that could affect different peoples metabolism. They didn’t get into that at all.

    Do you remember the bartender testified that a tall glass is used for non alcoholic beverages and short glasses used for alcohol. The Albert’s testimony is that she took a tall glass with a clear liquid

    Is there proof she was drinking right up to Midnight at the bar? No one has testified to this not even a bar tender. No one even bought her a drink. No one knew what clear liquid was in her glass? Could be water or soda. Who knows. I can totally understand her blacking out in the am. I lost my boyfriend and found him dead in the middle of the road from car crash. I was in so much shock i cant remember much at all. I don't remember anything for weeks after ward. I was acting crazy and said so many crazy things. I get this big time...

      I'm sorry for your loss, but I think your experience is what everyone (including the people she was with looking for him) is missing. When you're in a situation like that, you don't act rationally. The things you say don't mean anything. The fact all they have is that Karen was concerned she may have hit him is starting to get under my skin.

    My first time watching your channel, I was told by a personal friend of yours about it. Unless we know the actual time of arrest, the time the warrant was obtained and the time the blood was drawn, it should all be inadmissible ! With that said, in my 25+ yrs in police work as both a police officer and a detective, I can unequivocally state that the injuries Police Officer John OKeefe sustained were not from being struck by any vehicle, he was assaulted !

    From the public library footage, it shows the time to be at 12am. You can still see the grass on the ground, and the CW is saying that around 30 minutes later John was already dead on the ground. Even when the sped the time on the footage to 5am, there isn't that much snow on the ground or even on the cars.
    Multiple people testified that they couldn't see him bc he was covered with snow, after leaving the Albert's home. I hope the jury noticed that.

    The problem with finding the range of BAC you have to know the last drink time. How do we NOT know KR didnt drink after going home? This BAC extrapolation would be an issue for me

      Exactly. That’s why people run away from their cars when drinking and getting into an accident or hitting something. They can run Into a corner store- grab a beer; and go back saying they were panicked and have bad anxiety and needed to get a drink to calm down. They then can’t prove what alcohol was consumed when- so how this can be logical, I’ll never understand.

      As one who drinks, I can tell you, they are like everyone else who drinks. They like it. Its a lifestyle, a whole family lifestyle. I think there are many cop families who partake in the drink quite often.

      How they all weren’t charged with DUI’s is beyond me. They were all drunk. And all self admitted driving! Any one of them could have hit John. But I don’t think John was killed by a vehicle as his injuries are not consistent with a MVA.

    My thought on the BAC evidence: if there is a time when day drinking is acceptable, it's after you find your boyfriend dead on his coworker's lawn. I don't even drink, and I would find that entirely understandable.

    The man in the polo who talked about the metabolism of ETOH was stellar. Credible, pleasant demeanor, made eye contact with the jury, and stuck to the technicalities and the facts. 🤘
    The IT guy was so smug. How are people so ok with at the least deceit when someone's life is on the line? That town is overrun with dirty, unscrupulous people - it's unbelievable.

      I don’t disagree but I think we have to (somewhat) put personalities aside. Some people are more confident speaking publicly. I can tell you if I was on that stand, even being 100% innocent, I would be an absolute mess. Red-faced, sweating, fumbling words & id mostly likely forget how to spell my last name lol

    How about when she asked the doctor who first examined John at the hospital about his injuries and did he have any from the neck down. He said he didn’t know, so she had to go bone by bone til he finally agreed there was no injuries on that part of his body. It was hysterical! Just say, as per my report there were no injuries below the neck with the exception of scratch marks on the arm.

      His report doesn’t say because, he didn’t order test for those assessments. He isn’t denying this injury or admitting this injury. He is saying he didn’t test for it which is common in healthcare. That is not the place to fully exam a deceased person, They look for enough to stabilize the patient. CPR was continued until the stopping point the it is called. Even though everyone there knew he was dead long before he arrived at the ER.

    It's says a lot about how messed up this case is when we're thrilled to bits to hear a witness ( not the one from the hospital but the other lab guy) who is willing to answer questions clearly and without attitude.

    I used to work in a detox center as a counselor. I have seen 0.4 to 0.42 for people brought in for detox. These people typically had a very high tolerance though and were not as “smashed” as you might think. One girl in her late 20’s looked almost normal. You could tell she had been drinking but you probably would have never guessed a 0.4 bac. She filled out the paperwork on her own and was able to answer questions. It’s pretty crazy all the different variables that affect BAC and functioning. These people required significant medical detox to avoid seizures and death. Of course I have seen people come in with liver damage and they have a 0.3 bac after a few drinks because their liver can’t discharge the alcohol at the rate of a normal liver. A reverse tolerance.

      My ex was this way. He was a 2 fifth a day drinker. He walked normally and for the most part, appeared to people who didn't know him, as sober. Bac when a couple DUIs were .42 and .34.

    One of my biggest questions related to the BAC issue is whether the calculations factored in how her medical conditions and medications may have impacted alcohol metabolism. There are some medical conditions (besides those mentioned) that can falsely elevate BAC and some meds can slow alcohol clearance. Do you expect defense will have their own expert on this issue?

    There was this bizarre smirk on the last witnesses face - what was up with that. Was he happy that the footage was not preserved? So weird. The attitudes from some of the witnesses on this case have been really strange. I mean, someone's life is at stake, and a person died, can't they take finding the truth seriously?

    Thank you Peter for keeping us updated on this trial. 💗 My issue with the BAC calculations is the fact that Karen Read’s blood wasn’t initially drawn for that test, it was drawn for a CBC, basic blood work, etc. so there is a chance that alcohol swabs were used which could have further skewed the results when they later tested her blood serum for BAC. We also don’t know if she had a drink after she got home that night and other factors. She also has MS, Crohn’s, etc. so I am sure that would impact her as well.

      Alcohol swabs do not enter the blood stream to skew the bac levels lol. Firstly, pure alcohol would not be metabolised and therfore couldn't be viable, secondly, how does alcohol rub from a swab not only evaporates upon skin contact, so how on earth would enough liquid rubbihg alcohol enter the syringe to be mistaken for blood alcohol content? This is wishful thinking if ever I heard it lol

      If you need an alibi, leavinga party and going home, alone, to go to bed (what BH said he wanted to do) is a TERRIBLE alibi but going into your work where people will see you is a much better alibi if you're trying to scramble one together last minute.

    This morning I was half listening to another crime podcast about another case. I woke all the way up when they talked about pig DNA on the victim’s body. They straight up said it was from the doggie treats the victim’s dog had consumed. The pig DNA in this case could be a sure enough smoking gun.

    Blood alcohol level tests can be affected by some medications. I haven’t had any alcohol since 2016, but the combination of pain meds & chemotherapy I am on could show some funky blood alcohol, lol. Isn’t Karen an MS patient on certain meds?

      one of the biggest issues is that because they don't relate, they tend not to listen and instead discredit and invalidate real experiences and symptoms from patients. Intelligence goes out the window when you don't take into account the words of the patient because you don't have all the variables. Then you have doctors who refuse to test completely because they don't want to "waste time" or think they already know it all. It's rather un-intelligent...

    The problem with finding the range of BAC you have to know the last drink time. How do we NOT know KR didnt drink after going home? This BAC extrapolation would be an issue for me. Also if an alcohol swab was used that also can make alcohol content invalid

    If her blood test was taken several hours after she drank alcohol, and she returned .081 to .083, then one hour earlier, she would have tested at greater than .09, and two hours earlier at .1 BAC or greater. The body metabolizes alcohol at a fairly constant rate, and testing hours after being in custody clearly shows she was intoxicated at the time of arrest. Frankly, she was absolutely hammered.
    You don't increase BAC hours after your last intake. Your BAC will react in under an hour to the addition of alcohol to your system, and after the alcohol intake is ceased, your BAC will decrease as your liver and organs metabolize the alcohol.

    I hope the defense has an expert for this. I’m an engineer. I’ve done a lot of research. Just the simple fact that there is SUCH a wide range is telling in itself. If you’re not quite sure when a person enters the elimination phase, that is a major PROBLEM with using this method of extrapolation. I’ll leave it there.

    I agree 💯. Brian Albert testified that he drank beer from 3pm until he drove home @ approximately 1am. That's 10 hours of alcohol consumption. Karen's blood alcohol indicates that she continued to consume alcohol after John was injured & found deceased. FYI if a hospital lab gets an abnormally "high" result for a blood test. They repeat the test to verify that the results are accurate. What happened to designated drivers, calling for a ride, taxi &/or Uber rides? RIP John O'Keefe 🙏💖⚖️

    Alcohol is metabolized in several pathways, one of which is CYP450. The CYP450 is impacted by medications you take, and genetic factors can make you a slow or fast metabolizer. Crazy!

      I will also add that people can request a swab test that breaks down how you personally metabolize the majority of neurological drugs.

      💯 this factor was driving me bananas listening to those experts! It’s already been established that KR has MS & other medical conditions. The impacts medications & medical conditions have on ETOH clearance should be more than reasonable doubt!

      @@PsychJustice the man in the company shirt was very smart and could simplify complex concepts very well. He also didn’t backtrack on things when asked. But he confirmed what the tests showed, as well as where there were still limitations (as any good scientist would).

    I haven't ever had a DUI, but I know II have been completely intoxicated. It is to where I don't even remember how I've gotten home. There have been times that I remember having to close one eye because I couldn't see straight. And now i'm not proud of it It was very stupid. It was when I was in my late teens. Early 20s. I don't drink anymore, but yeah. I'm just glad nothing horrible happened to anyone else and myself.

    This is definitely one of the most interesting cases I have been glued to in a long time. So divisive on so many levels. I hope the jury makes the right decision. I am leaning that the prosecution is not supporting their case thus far.

    The DUI Guy takes a very good look at Day 18s afternoon testimony.
    He’s an attorney and this is his area of expertise. He makes claims he helped Karen’s defense team prepare for the cross of the state’s expert BAC witnesses.

    It would bug me as a juror, that KR was the only one tested for drinking. That entire group was drinking. And from what I’ve heard well past than when KR went home!

      she was transported to the hospital - I believe it was stated a drug test was part of the standard procedure.

    93 mg/dL is not equal to 0.093, it's not a direct conversion as the next witness will explain. You have to put the 93 mg/dL into formula that takes conversion factors into account.

    The excellent information that was presented by he admitted the time of Karen’s last drink wasn’t known or asked. The time of last drink was the type of information that would change the outcome of blood test for alcohol. In essence the alcohol level test is invalid. Right?

    Read was backing out of a driveway during a snowstorm (if we're going with it was an accident theory). She wasn't going fast enough to injure someone to point of their death. His injuries aren't even close to being consistent with a car hit.

    A moment of levity, if I may - slowing down the playback speed so witnesses don't sound rushed leaves Peter sounding a little tipsy. It amused me this afternoon.
    As for the difference between witnesses, I definitely would have been dozing off with the Doctor's testimony. When I did jury service, I very nearly did fall asleep because one witness was overexplaining and overcomplicating a report. I just couldn't focus and switched off. The extrapolation witness was easy to listen to (even inserting little comments like "spin it really fast" when the word "centrifuge" was mentioned). I like that he didn't expect the jury to know what he was talking about, so he simplified it for them.

    That range is hellacious! Over 100% swing! 😂Unbelievable in my opinion. She has medical issues and on medication etc. wonder what factors that could cause. Also, who’s to say she didn’t drink after she got to Officer O’Keefe’s house??
    Your example reminds me of Chris Albert’s DUI homicide case- killed a college student and fled. Turned himself in 3 days later with his lawyer who is this Judge’s brother.
