      Um, ending birthright citizenship would hurt Indian Americans whose parents were not born in the U.S. Meanwhile, both Vivek and Nikki have implied that African Americans who have been here for 400 years should be deported because we somehow aren't as patriotic. Why? Because we have fought and died in every single American War and dared criticize America for not living up to "All Men Are Created Equal?" That is appalling and insulting. My family fought/marched with Dr. King for people of color to enjoy the rights they now have. We welcome Indians, but we do not welcome their anti-blackness or the threat of casteism to everyone's very hard-won civil rights. Moreover, this country will always let anyone who is not white know they are not. Vivek thought he could keep his job with Trump after saying white Americans are lazy and dumb. He is going to find out that due to that statement he will not be appointed to fill Vance's Senate seat. He also will not be elected Governor of Ohio. Both "dumb" black and white Americans will unify to make sure he never even wins a school board election.

      Irrespective of oil sanctions on Iran, India should buy some oil from Iran to save the shipping costs.. Because of US sanctions Indian govt is paying more shipping costs..its indirectly impacting our economy.. If the female foreigner becomes pregnant and gives birth in the United States, her child will automatically become a US citizen. Nobody else in the world does this.

    she said any baby born in the US is a citizen regardless of the ...STATUS OF THEIR PARENTS. That's not exactly what the constitution says. India doesn't have unconditional birthright citizenship. No country probably has. Why should the US have UNCONDITIONAL birth right to citizenship?

      At present, the US does grant birthright citizenship. India is exceptionally exclusionary on this matter. The UK had it for many years, until Dame Thatcher changed it. Recall that C.R. Das saved Sri Aurobindo from possible execution by arguing that he was a British citizen by birth as he was born on a British ship.

      @@sdutta8 the constitution doesn't include the text "...REGARDLESS OF THE STATUS OF THEIR PARENTS..." or any such absolute stipulation. Just because the constitution was interpreted in a certain way since 1787 doesn't mean there can be no justification for unambiguous interpretation of birthright citizenship.

      One of the parent have to be a greencard(permanent resident)or American citizen then their children would be borned American citizen. Not all babies borned in a country get automatic citizenship.

    This was mainly intended for "Unauthorized workers", primarily the illegal immigrants from South American or other countries. And that is only fair. But The H1b just got hit as a result of collateral damage. It's sad because people (legal non-immigrants) plan a their life around this. Buying house, investments, choosing schools and colleges their kids will go to, tuition and so much more. Now they have to re-think all of that and take bigger steps that was not on the plan (perhaps moving back to their home country).

    If the parents came here undocumented or a temporary status, they're offspring should not be given citizenship but it's not the fault of the children but the parents has to be held accountable. I think the supreme Court May side with Trump.

    He mentioned that babies of undocumented and illegal immigrants wont get citizenship rights - which makes all the sense.
    However who is legally here on an extended visa will get the citizenship. Also they are going to break down on the process where people would travel during pregnancy and deliver their baby in the US. That right will also be most likely be revoked as people misuse it.

      @@darrenclayton8246 There is nothing like "temporary residency". you are basically on temporary visa for defined time frame to stay and work and not pathway to permanent resident status. There are very few possibilities to get a green card once you cross the border into the USA. Most green card applications are processed in country of applicant. Take everything thing that you hear from the family, friends and agents with a grain of salt.

    Nita Ambani gave birth to Isha and Ananth in USA. May be to get a good ivf care. Even Isha Ambani gave birth in USA with ivf. It is not nice for those who paid taxes for decade or more. They must consider them as gc takes 20 years. The pregnant women who are on work visas couldn't stop worrying about it. Most of them studied and worked for over a decade here in US but due to country backlog the GC is still looking at 2012 filled applicaytions and now it would take 30-100 years to get GC. The kids will not have a proper identity if this starts and there is no meaning in the taxes paid and work done for decades for people with work visa. ALCU gave good explaination in law suit. You can make a video on it.

    I think this is long overdue. What other country allows people who come on vacation or as a temp worker to have a child and then get chain migration for an entire family?       There is a very strict limit on H1B visas and green card is severely restricted since India gets very less quota. So many H1B people as well as students have come back in the last 15-20 years. Developing the nation doesn't happen in a vacuum. It requires a corruption free administration, less bureaucracy, good administration, efficient legal system, protection of private property, and a strong judiciary.

    It is applicable to visitors visa holders like B1B2 and illegal immigrants. Not applicable to F1,J1,H1.
    Currently diplomats children born in USA do not get citizenship. for eg Indian diplomat stationed in New York delivers a baby, the baby gets Indian citizenship not US.

Asylum seekers from different cultures and religions were granted citizenship without completing the required background checks or having the proper intention of their mass influx/invasion of arrivals, and no criminals, illegal immigrants, or refugees would have smuggled into the US or Europe if they or their children had not been granted citizenship. However, if their presence in a foreign country is deliberately planned, they or their children would never confront or kill residents on the street for the benefit of other countries, regardless of the political climate in their own country.

    As an Indian living in US for the last 24 years and now an American citizen- I have felt that this is one of the greatest countries in the world if not the best. This country was built by immigrants and is great because of them and also because it has been accepting of them. That all will change if Trump succeeds in his efforts. It might be beneficial for India as there may be less brain drain in future…who knows. But it will be a difficult 4 or more years for anyone who has even a little bit of empathy for others. Please pray for us.

    That is NOT the law. It's a bit more complex than that. ".... and the jurisdiction thereof..." Those words are key. The 14th Amendment does not give birthright citizenship to a child born of certain kinds of parents, such as foreign diplomats.

    I migrated to Australia 12 years ago and have always understood and respected the policy regarding citizenship here. After acquiring my permanent residency, I then got citizenship. I do find the system in US and Canada regarding birthright citizenship a lot liberal than what we have here.

    I am on work visa in the US. I think it is fine either way for me. American citizenship or not, we aren’t too worried for future kids.

      You will be when the deportations start no ? Because Trumps clause in the executive order specifically includes children of people with temporary visas, which is the H1B. Your kids, will be stateless.

    With regard to the bounds and limits of constitutional birthright citizenship, Seattle federal district judge John Coughenour has done all of us a favor because it is high time that the federal judiciary issued a contemporary opinion on the limits of birthright citizenship. The TRO just granted by John Coughenour is only a tiny first step in a legal process that, now started, seems likely to last for several years and ultimately result in a U.S. Supreme Court ruling. Naïve people seem to think that the executive order that starts this litigation is just an idol gesture. I believe that it was cunningly initiated with full knowledge that the order's long term consequence will be a fresh U.S. Supreme Court interpretation of the bounds and limits of U.S. constitutional birthright citizenship.

    Americans have observed, for the past few decades, federal litigation that attempts to limit other constitutional rights, about which the political middle left is vehement. For example, it is a hallmark of current middle left American politics to claim that the right to keep and bear firearms "shall not be infringed" doesn't really mean what its plain text clearly says it means, and therefore seek restrictions and prohibitions on second amendment firearm rights.

    Given the logic the political left applies to the second amendment, birthright citizenship should not be absolute or unlimited either. The current administration's new executive order seeks to limit birthright citizenship to newborn children with at least one U.S. citizen, or permanent legal resident non-citizen, parent. Stated another way, pursuant to this new executive order, newborn children of illegal border crossers, or with two non-citizen parents, would not be entitled to birthright citizenship. Although the new executive order likely has limited endurance, once the federal courts have issued rulings on this controversy, those federal court rulings will be the undeniable permanent law of the land.

    It is my impression that once the matter of these limits on birthright citizenship make it to the U.S. Supreme Court in a few years, given the current makeup of the U.S. Supreme Court, the U.S. Supreme Court will uphold the limits on birthright citizenship expressed in this new federal executive order. If the U.S. Supreme Court issues such a ruling, the recent practice of birthright tourism, in which pregnant foreign mothers travel to the U.S on tourist visas in the 9th month of their pregnancy so that their baby can be born in the U.S., will instantly grind to a screeching halt.

    It makes me feel betrayed. My one son is an American citizen and my other won't be?. I've followed the law, done what is asked of me. I pay my taxes. I work hard. Yet I am subject to green card discrimination. And now this. For all those who tell us to come back to India, you really have no right to tell me what to do. You can live your life as you please and as you deem necessary but what do you get out of shitting on people like me who have chosen to emigrate to United States.

      You don't have green card. You are just here, that does not mean you have immigrated. Paying taxes and abiding by law of the land where you are has nothing to do with your right to citizenship. It doesn't entitle to citizenship. There are millions of non-citizens who earn billions in USA and invest in property and market for which they must pay taxes, that don't entitle them to green card, citizenship, birth right. You may do whatever you want but there are consequences.

    As jobless Indian once before 18 years, I used to look with awe , the serpentine queue outside American Embassy at Chennai. After Trump's Order, such queues would look like one gathered to receive Umemployment doles❤❤

    Monday’s order sets out the parameters by which a person can claim a birthright.
    It states that if one parent was “unlawfully present in the United States” and the other was not a citizen or a “lawful permanent resident at the time of said person’s birth”, the child cannot claim birthright.

      I first time went to BAPS swaminarayan temple in Texas and it was really big and beautiful.
      I often goes to minakshi temple, hanuman temple and Sai baba temple in Houston, Dallas and austin area.

    A US Constitutional amendment is not needed to eliminate birthright citizenship. A US Federal Circuit Court split should be created, then SCOTUS can rule. End of story.

      Pls educate yourself. The courts will only arbitrate the constitutional validity of this order. Even if the SCOTUS agrees on the order, its will only be good for the term of that president only. For permanency, the congress and states have to ratify.

    The last 6 words in the 1st sentence of 14th Amendment requires a parent to be a resident of a State in the United States. "of the State wherein they reside"
