as a 17 year old, with the limited knowledge that i have, i'd just say, death sentence or not should not be the question. the real problem is the fact that so many of these crimes happen and most of them aren't even reported. Out of the ones that are reported, only some of them reach the point where the criminal is actually found guilty. The problem is the judicial system, the police system, the problem is lack of cctv cameras, guards, street lights and what not. And for the judicial system, if we're able to streamline the process, and make sure that right decisions are taken (which is not as easy as it sounds), and the guilty is given proper punishment, people will think twice before committing such crimes.

Even in crimes and in court verdicts women are treated unfairly ?

His internal organs were damaged and he was bleeding continuously. He had to undergo dialysis and part of his tongue had come off because of the poison greeshma had given. The poor guy could not even drink water. Even on his deathbed, he tried to protect her until he couldn't. As for greeshma, she didn't seem to have an ounce of remorse about the crime she committed. She had said that she is 24 now and that she will come out by 38 after serving her life sentence. What sets this case apart is that it is not a random murder, but a first degree premeditated senseless murder done for personal gains. Please study the case before arriving at conclusions.

The Judge of Sealdah Court was very prudent in sentencing Sanjay Rai with life imprisonment and not with capital punishment, knowing fully well that he may not be the real culprit. So that if ever the real criminals are found,there is some scope of redress. The CFSL and DNA reports indicate more are involved, with no comments from CBI.. Trial had been started without the visera report for unknown reasons. CBI has been vocal and proactive ,demanding capital punishment to Sanjay, but did not show such proactiveness in the investigation process and has failed to identify and book the real culprits and the mastermind, for whatever reasons. The lower court also pointed out to the lapses of the premier investigating agency. CBI is yet to disclose the status reports submitted by them at SC, reading which ex CJI and another Judge had commented it is very disturbing and that he has not seen such lapses on the part of kolkata police in 30 years of practice.

Court cannot demarcate the rarest of rare case in a watertight compartment. Cases depend on the facts. Also, a judge should not get swayed by the media and hand out a death sentence. Such cases often have a scapegoat victim because the media coverage led to public outcry and the police had to put the blame on someone. This is how the police works in India. (I am not saying he is not the rapist, just that you can never be sure w the indian police)
In my opinion, remove the death sentence and shift to life sentences because the justice system can be biased in reality. Streamline grass roots notifying and addressing abuse of any form where the process of filing complaints are digitised and followed up by a competent support team. Have strong awareness programs in our education system and counsellors established in schools that can detect and guide individuals. The govt. also can subsidise equipment’s related to security that can further reduce inaccuracies and process cases faster at the lower level. Define some guidelines in terms of a warning and fine for people sitting in positions of responsibility and visibility who mobilises the masses for a negative intent.
There is no such thing as a perfect system - every system is fallible. The reversal argument is bogus. For example, if someone commits a crime that gives him two years imprisonment, and only after the completion of his sentence he is able prove his innocence, then also the punishment cannot be reversed. Should we try to build a system that gives better protection to people and also the innocent accused ? Yes. Can we afford it? that is not so certain. Justice and policing is expensive and the country needs to balance this need with other things that it has to do. On the other hand, no nation in the world is immune to large scale corruption by politicians, we just have to live with it. It is the job of the public to ask for the things they care about during elections - the public gets what they prioritise in a democracy. Would your vote change based on how the punishment is given in certain types of cases? If not, it will never be on the radar of any politician.

U missed something ! Our police to civilians ratio contributes to the crimes, the police in major cities are overworked and that often leads to inefficiency.
This is really a very sad assessment of India as a functional democracy! I believe this is needlessly harsh. Elections are being routinely engineered hence outcomes are not really indicative of the people's will.

Well analysed. The case can definitely be moved to the higher courts unless the prosecutors and/or defendants do not file an appeal. Has there been a move for an appeal, especially when there is such a public outcry? Another reason to keep the convicted alive is to appear as witness increminating any others who are also party to the crime. Sadly, none of the others remanded have been so far charged for even abetment or any other offence!

Honestly, if we take a step back and look properly at all the factors responsible for horrible crimes like this one happening, there would be consequences for many more in society, including the government and hospital authorities. We also really need to be educated, as a public, on ethical problems and concerns that arise from the ‘call for blood’. It’s incredible to me that a democratic country like India, still hasn’t abolished the death penalty altogether. As a parent, as a woman, as a working woman, I won’t be satisfied until change happens at the societal level including reduction in mysogyny, equality in workplaces, a government committed to and responsible for safe public spaces and effective policing.

Justice never changes.Judge alone changed justice from state to state for the same crime committed.
In Kerala State justice is offered as death sentence.
In West Bengal state, justice is delivered as life imprisonment.
But the crimes committed are one and the same.

Not for the death penalty. Have read about so many people being acquitted because they were found innocent later especially due to advancements in forensic science. In this case, still not convinced he was the only perpetrator.
Capital punishment is hardly a deterrent to rape. Look around you!And then there's the political class. Just last year the rapists/killers of the utterly gruesome Kamduni case were SET FREE by Kolkata high court even after being given death penalty by the lower court. Mamta's police made sure that there were not enough evidence for the death penalty to hold. Here too, Mamta shrieking "fansi chai" is the biggest joke since it was her government police and health dept that destroyed all evidence and are still sheltering the culprits. Sanjoy ray was just a very convenient pawn in the whole scheme of things. Won't be shocked if he walks free after moving to the higher courts.
Yup that's what this guy isn't the only culprit..... definitely not the main one.....the investigation on this case shouldn't be done with..... otherwise the actual culprits would be allowed to live freely without facing any consequences for such a heinous crime.

You have hit the nail on the head. I agree the judiciary and the police along with the politicians need to be more transparent and show some will on cleaning our (obviously) not good enough system. If the system is good and transparent, I am sure judiciary will never be giving death sentence since they have full information and no doubt is there in a judges mind when he is giving out the verdict. The reason that politicians are screaming for death penalty is to shut the case down..any case, after which everyone is stoic and silenced with lingering doubt that was this true?!!. Our system is always in search of a scape goat and not the truth. A temporary fix. That's exactly the reason the death penalty acts as a double edged knife. We all know our country may never be good enough for the removal of death penalty.
The Judge of Sealdah Court was very prudent in sentencing Sanjay Rai with life imprisonment and not with capital punishment, knowing fully well that he may not be the real culprit.
So that if ever the real criminals are found,there is some scope of redress. The CFSL and DNA reports indicate more are involved, with no comments from CBI.. Trial had been started without the visera report for unknown reasons. CBI has been vocal and proactive ,demanding capital punishment to Sanjay, but did not show such proactiveness in the investigation process and has failed to identify and book the real culprits and the mastermind, for whatever reasons.
The lower court also pointed out to the lapses of the premier investigating agency. CBI is yet to disclose the status reports submitted by them at SC, reading which ex CJI and another Judge had commented it is very disturbing and that he has not seen such lapses on the part of kolkata police in 30 years of practice.

Court cannot demarcate the rarest of rare case in a watertight compartment. Cases depend on the facts. Also, a judge should not get swayed by the media and hand out a death sentence. Such cases often have a scapegoat victim because the media coverage led to public outcry and the police had to put the blame on someone. This is how the police works in India. (I am not saying he is not the rapist, just that you can never be sure w the indian police)
In my opinion, remove the death sentence and shift to life sentences because the justice system can be biased in reality.
Streamline grass roots notifying and addressing abuse of any form where the process of filing complaints are digitised and followed up by a competent support team.
Have strong awareness programs in our education system and counsellors established in schools that can detect and guide individuals.
The govt. also can subsidise equipment’s related to security that can further reduce inaccuracies and process cases faster at the lower level.
Define some guidelines in terms of a warning and fine for people sitting in positions of responsibility and visibility who mobilises the masses for a negative intent.
No death sentence
There is no such thing as a perfect system - every system is fallible. The reversal argument is bogus. For example, if someone commits a crime that gives him two years imprisonment, and only after the completion of his sentence he is able prove his innocence, then also the punishment cannot be reversed. Should we try to build a system that gives better protection to people and also the innocent accused ? Yes. Can we afford it? that is not so certain. Justice and policing is expensive and the country needs to balance this need with other things that it has to do. On the other hand, no nation in the world is immune to large scale corruption by politicians, we just have to live with it. It is the job of the public to ask for the things they care about during elections - the public gets what they prioritise in a democracy. Would your vote change based on how the punishment is given in certain types of cases? If not, it will never be on the radar of any politician.
