    Mega carriers that own multiple brokerages, running $3.50 per mile loads through multiple brokers and paying the lease operator $1.32 per mile… NEVER LEASE A TRUCK WITH A MEGA CARRIER!!!

      That is why some mega carriers can get away with murder by not paying by mile but by percentage a way that we can not track the real freight rate. My best bet is that they charge customers by mile but they pass the load as persentage to the driver . Something shady there that FMCSA hasn't investigated yet since is getting under the radar.

      I'm posting here bc again, there is No Comment window for me to comment. wth.
      The problem goes much deeper than this vid; but must be recognized.
      Anyway, I got the fruad problem, BUT it's far more important for fmcsa to clean house of the Cabatoge & Massive numbers of Foreigners that can't speak English, ie., outta CA, primarily Indians, etc.. At Flying J I just saw almost all Indians driving trucks, fueling, etc.. In the store you can tell they can't even speak English. It's fmcsa rule you have to speak & read English, BUT, they made a new law to countermand the law saying they can use a device to talk to DOT OFFICER. Part of the idea of requiring ability to understand English should be obvious. 2ND & most important is for government to STOP cheap foreign labor from destroying Our Jobs, enriching them & businesses.
      I say Gov & Fmcsa are involved in supplying Cheap Labor for manufacturing, shippers, Indians that start truck businesses using them.
      War is about resources. Taking resources from the ppl who've captured a territory, by another ppl, (Indians), taking the resources.
      It just so happens that in all cases it's BROWNS taking Our Territory & government & Corporations are allowing this. The to working togethering z IS CALLED FASCISM. DO U ALL GET THIS!
      IF you don't get it just look at what Government, social media and have done to President Trump.
      THIS ALL TOGETHER IS A WAR without calling it War. But war nonetheless!!

      If not the FMCSA then who are you going to rely on? And as far as the "govt," it's sad how citizens forget that WE are the government. We The People. We have a representative form of government. In other words, we elect someone to represent us. If this someone isn't doing their job then the solution is simple, elect someone else. And become active. Make your voice heard by calling, emailing, and in person, respectfully, of course. And vote!

      Please be careful, Miranda, in applauding someone going after the little guy.
      Yes ATA and the Roehl family will love this, as will evil or clueless politicians and regulators. But if an honest worker wants to open a "Driver Inc.," as ET Transport calls them (really Driver LLC), to work as a small- business owner operator, the ONLY sensible solution is to use a mailbox address. Firstly, he may actually not have a physical address, or one anywhere near where he operates. He may reside in the sleeper berth of his truck, so that he will at least be able to save some pittance, have something to show for each year's work. But even for the folks that do rent or own a home in the state they operate in (we can categorically rule out being able to rent or own a separate office), use this address on all trucking business paperwork, are you out of your mind?
      FMCSA need not be out of their minds to make such rules. Either they are stupid, the usual case, or/and they understand that the Roehl's can easily make much larger campaign and other "contributions. "

    There is NOTHING brokers do that an app can't replace. I've heard all the arguments against an app and what the brokers think they bring to the table. It's all fear. Brokers are middle men . With today's technology the middleman just doesn't have to be a thing anymore. It's not the 1950's.

      Unfortunately the shippers often make mistakes like load over dimensional. The app is going to get you the permit money? Or a Truck Order not used? Apps will get you layover and detention pay? No way. You need a person to negotiate with the shipper for the driver. The person who pays the carrier is not the forklift driver.

    You may or may not realize you just stumbled onto one of the oldest tricks in the books, where a shady carrier also has a brokerage, that they then use to reduce the rate paid to percentage based leased units / OO's and they have all the paperwork to back up any rate inquires by those OO's if questioned about low rates.

    A original bill of services from the shipper with amount being paid and direct contract information along with the broker hired information should be provided with every ratecon to a carrier.

    This is nice I guess and good on you for consistently putting out this information but the overarching issue in our industry is the lack of a barrier of entry.
    If the FMCSA required proof of 10,000 full time worked hours as a CDL LICENSED truck driver for a company and required owner/operators to have a CDL license (which seems like it'd be a no brainer) the market would shift overnight. There are so many owner/operators that have no real training or truck driving experience or even cdl licenses. They just watch a youtuber and go rent a truck in hopes of escaping their deadend fast food or warehouse job. The problem in our industry is the lack of barrier of entry, until that's solved nothing will change.

    Hi Miranda this is great!!! I hauled a load back in October and the broker went out of business and the bond only paid 680 of 3700 . And I bet and not the only one out there. Hopefully things will change for the better!

      That's because the bond has ben hit so many times. Unfortunately, you wouldn't know that before taking the load.

      Go after the shipper. I got scammed last year for $3600. The bond only paid $1750. So I went after Amazon and collected the rest from them. The shipper is ultimately responsible. Remember that.

      Law does not work the way you state. Contract is made between carrier and broker ... not shipper, nor customer. I don't believe u got compensated. Unfortunately, the loss carriers take is designed to enrich the rich ones. A loop hole purposefully put by the system

The shipper is ultimately responsible. And YES, I DID get paid by Amazon. It was a simple process. Go read the Federal Code on commercial transportation and bills of lading. I'm not the first and I won't be the last to go after shippers. This is why some shippers are bypassing brokers now. Because some of them have had to pay TWICE, and they are fed up.

    Do we realize that when the Department of Transportation FMCSA got on a bench to protect the drivers from the carriers by saying we are required to have a 10-hour sleep break and a 30-minute rest break during our 11-hour drive time and we are required to not work more than 70 hours a week.....
    Did you know that the 14-hour rule is only for driving the truck when we get up at 5:00 a.m. and start our day and we think we're going to be done no later than 7:00 p.m. that's just for driving.
    The carrier might impose for their drivers to do on duty work after the 14 hours making a 14-hour workday 17 hours 18 hours 19.
    So just so everybody on this planet knows the United States government gives a s*** about the drivers. Their concern is taking care of the supply chain not the drivers within the supply chain.
    I rest my case

    Good news for everyone. Not enough, but it's a step in the right direction. In a lot of double brokering situations, the 2nd broker is also the "carrier" that booked the load with the broker. They then post the load out at a higher than average rate(which also skews load board data) and find themselves a victim that will never get paid. They have a bunch of preregistered MC's and burn through them quickly, so that by the time the first MC is flagged for fraud, they're already operating on 1 or 2 others. The enforcement of this law can't come fast enough.

    It’s crazy how they’ve done the same thing in the trucking industry that they do in the reselling business with clothes… But instead of buying up highly coveted clothing before the public and adding an enormous tax, fake brokers are high jacking the loads & then taking all of the profits from the carriers/ owner operators… Crazy world

    4:35 it was my understanding that using a registered agent as a principle place of business is acceptable if you’re an Owner Operator with no other offices, as long as you receive mail and other trucking related services there.

    Forgot the so called CO brokering is just a way around double brokering. Meaning a broker giving another broker under a different brokerage authority.

    With the FMCSA? I believe it when I see it. I am not for more regs. either, but the brokers need major regulation. That way the monies they rake off the top are commensurate of the service preformed only, nothing more. Thx for the update, you are a great trucking journalist in your own right, even if that isn't your goal.

    Its good to have your driver ask shipper who the broker is when they check in, and dont fall for too good to be true rates on board

    They can eliminate brokers and deal solely with the shipper to carrier. That's the only way to go. They can then make sure that the carrier that picks up the load is on the side of the truck to eliminate these carriers atleast the bad ones . The vin should also be attached to carriers so they can be followed also.

    The solution to no payment is to go after the surety bond for payment, dont let them lie to you. Just take the surety bond insurance to court. No point in trying to take anyone else to court for non payment because your user agreement you signed voids any responsibility

    The Double Broker situation must be addressed. Federal Legislation should be enacted that imposes a 100% tax on any “Double Broker Revenue.” The IRS would be the logical enforcement agency. Currently the dishonest broker is able to hide behind an insufficient bond and pocket all of the revenue that others have created. I’m sure the majority pay zero taxes on their ill gotten revenue. Fines, penalties and potential jail sentences should be included in the legislation.

    Another common point of sitting. The angry driver in conflict with the dispatcher. This is a self inflicted issue created by the dispatcher. The driver is angry because dispatcher didn't provide the Time for the tasks to be completed or the solution required when Time is the issue. By this I mean our needs are simple enough. Give me the Time to complete the mission and the phones will be silent. We are focused on the shipper and receiver. We work in other industries waiting on transportation to complete our missions. It did take me a few years too realize the issue wasn't their fault. Through Time I have also achieved knowledge to recognize and to apologize for it spilling over to them

    Interesting, so the answer is MORE regulation and MORE enforcement. Will this make carriers feel more secure? Will carriers not do their due diligence because they think the government has it under control? The key is building relationships. Know who you are doing business with. Deal with reputable brokers and shippers that you have built a relationship.

    And we can no longer count on coffee to be supplied. I was in Arizona for coffee, and all pots were closed for cleaning. Or we get to waste time on bean to cup.     It’s a complete bs, mc authorities don’t have anything to do with the road safety, the driver - does
    And he undergoes a lot of challenges before getting there including getting a cdl (which is $4k, passing a drug test, and getting approved by an insurance (sorta background check)
    All they do is making harder for a small guy to start a company in favor of big capitals
    And at the end of the day the driver is responsible for ALL moving violations
    They better regulate the brokers which are doing pretty much what they want
    WE NEED BROKER TRANSPARENCY

    Awesome explanation of "multiple brokering". You wrap your head around it well. But please "announce" the final word on driver's legal rights/access to ORIGINAL rate confirmation?
    Some Carriers argue that while an O/O per-mile "leased-on" driver sign's a contract with a Carrier, this doesn't bind him with the rate confirmation access. Original negotiated rates are NONE OF YOUR BUSINESS! Says the Carriers or sub-party rate handlers before driver.
    I feel that the driver is actually indeed in a "new" rate confirmation contractual relationship. As there is no way to hold anyone accountable for the pickup and delivery of the load, without a contract. Try telling the customers that the load is only verbal, not to worry.
    The customer wants a contract with the DRIVER. Therefore, the driver is legally authorized to know the original negotiation and fuel surcharge due him/her.
    Think about it. Why would anyone deny a driver the right to know the original rate? Will someone be exposed for stealing from the original rate?
    Why don't you want the driver to know the most important part of the rate confirmation?!?
    Bad boys, bad girls. (illegal)

    They need to do something because this "you dont have any inspections" should not be allowed as grounds to determine if a carrier is legit.. i been trucking for 25yrs. In the last 3 yrs no inspections.. no accidents, no mobing violation.. i should not be penalized for following the rules to a T

    Deport any non-citizen running an illigal authority. Simply revoking their current authority just means they will find a way to illegally obtain a new one. Any illegal activity should include revoking a visa as a penalty

    Brokers should not be allowed to hold loads their bond can’t cover at one time. Way have a Million Dollar Bond and have 20 million dollars worth of loads that aren’t settled? I got a double brokered load a few years ago. $5700 load to the middle of no where Nevada. At the time it was dispatched from the office so I wasn’t the one that found it, called on it, credit check or sign the RateCon. Just the sucker O/O that ran it. I no only had to pay it back but had to eat all that time, deadhead and fuel. To make it worse I had an expensive roadside I had to have. All together as a O/O it cost me personally all said and done I paid out of pocket around $3500 plus loss that time. Out of no where Nevada my load out sucked and was a horrible load. It was rare but it was my worst week as a O/O outside of breakdowns

    Please be careful, Miranda, in applauding someone going after the little guy.
    Yes ATA and the Roehl family will love this, as will evil or clueless politicians and regulators. But if an honest worker wants to open a "Driver Inc.," as ET Transport calls them (really Driver LLC), to work as a small- business owner operator, the ONLY sensible solution is to use a mailbox address. Firstly, he may actually not have a physical address, or one anywhere near where he operates. He may reside in the sleeper berth of his truck, so that he will at least be able to save some pittance, have something to show for each year's work. But even for the folks that do rent or own a home in the state they operate in (we can categorically rule out being able to rent or own a separate office), use this address on all trucking business paperwork, are you out of your mind?
    FMCSA need not be out of their minds to make such rules. Either they are stupid, the usual case, or/and they understand that the Roehl's can easily make much larger campaign and other "contributions. "

    trucking works only for people that lives in trucks at this time and don't have any other bills to pay, not house payments or utilities etc, this is why rates still in the puke hole, because cheap freight keeps being moved by drivers that still make profit with these rates, hopefully this rule makes rates go up!!! not real

    So how does this new FMCSA Regulation stop large foreign based (Bosnian/Serbian:other) dominated Broker Agents/sub Agents from continuing their businesses within Landstars umbrella? And Landstar is not alone in this type of operations.

    Now TQL brokers advertising loads on DAT tonight for $1085 and then I email them with an offer of $1400 and they come back with... I'd like to be closer to $800. WHAT??? Your listing says $1085 and now you're telling me $800??? I FREAKING HATE TQL!!!!!!!!!!!! I called DAT to complain about this... but they don't seem to care. So I canceled my subscription and moving to TruckStop.

      Truckstop doesn't care either my man. TQL also has a bad habit of listing the wrong town for the pickup or delivery and it can easily be 200 more miles than they claim.

    If the shippers confirm who the broker is they used, and it's different from who the carrier booked with, then their might be a problem and should be investigated.
    PS with the govt actively encouraging illegal border crossing knowing what problems this will cause the citizens it strikes me that double brokering is what the govt actually wants?
