I reside in Ohio. I had a petty theft record sealed 25 years ago. Recently, I apply for a job at a senior citizen facility. They ran a background check on me, the record showed up. The employer could see it plain as day. I researched, discovered any jobs dealing with the elderly or children, ie schools, can see sealed records. Really, what’s the point of getting my record sealed if prospective employees can see it? I was frustrated.
if it seal then no they can't see it you're good to go. Only place that will check that seal record is, if you're applying for a security clearance or military enlist they can see those record if they have a good reason why. But you're good !
That’s a really good point. There are many states that have exceptions to what can and cannot be accessed in a sealed record. Some of those exceptions apply to working in nursing homes, working with children, etc. I would definitely consider doing a follow up video to address your concern. Stay strong and keep searching!
So informative and useful. I'm a social worker that works primarily with the justice involved community. This video will be a great resource for them to understand the difference between the two processes. Also give them some hope. Thank you 💖 appreciate your knowledge and for sharing it with us.
You may want to talk to the lawyer that represented you in the case to find out the effect of your sealed record. I'm also not sure why you would need to submit to fingerprints or what that would be used for.
No. Once it's expunged for example a domestic violence case, get it expunged then after it's on record obtain the copy and send to fbi with your prints and nics number cuz it can take a year for it to go into place even though it has been expunged
Frustrating when you didn't even hurt someone and your labeled as a pos and lose your 2nd amendment. In MD it's 15 years before you can expunge or hire a lawyer. Go to clerk of court and file a motion for expung. Remember they cant give you legal dvice
Will the police academy are able to see that my record was expunged? I believe they have a question asking “have you ever been arrested before “? Thanks for the video
Hello Taste of Aroma, thanks for watching! This is actually going to depend on the laws of your state. Some states allow for expungements where the record is completely destroyed and in other states, law-enforcement officers can still keep a copy of an expunged record. You probably need to look up the effect of an expunged record in your state, and whether you have to disclose an expunged record for police academy applications.
This is something that you definitely need to talk to an attorney in your state about. Certain criminal charges can affect your ability to carry a firearm in the future.
This is a really good question and can be a little bit more complicated than most people realize. I will definitely try to do a video on this topic in the near future. Stay tuned!
The word “expungement” is a universal and broad word. It can apply to juveniles under 18 and it can also apply to adults, depending on what the laws of the state require.
Hello Attorney, I have a Good One for you… I know a Lady, when she was in her twenties, She made some bad decisions with the Father of her Children, DRUGS!!! When the LEO’S came, She was charged with Distribution, Only Because the Lease was in her name. Since then, She has had her record expunged, She can purchase Firearms, She can Vote, She can even get a Passport, However The State of Michigan will not take her off there Internal System, Her Record still shows… Here is the Riddle, If I understand the Law correctly, Anyone that has been found guilty of “Distribution” can not work in any capacity that a program receives MEDICARE DOLLARS. If you have a remedy, Please allow me to reach out to you…
If you've been arrested for a crime, then there is an arrest record whether or not the case later gets dismissed. You may want to speak with someone about whether the state that you were arrested in has automatic expungements or not.
If my charges got dismissed and I just got them expunged because i missed court so every time I try and get a truck driving job those missed court dates shows up for some reason ,how long does it take to not to show up on your background check well in my case my mvr report
Hi, and thank you for watching! Every state has their own set of laws that tell you how long it should take to fully seal a record once a judge orders the record to be sealed. In DC for example, prosecutors offices, and law-enforcement typically have 90 days to certify that the record has been sealed.
Please i was deported about 3 marijuana charges about 15years ago but the record is expunged in criminal court but is possible for me to get back visa base on my records as be expunged
The expungement laws may affect you differently if you were not a US citizen when you got charged. I have another video where I address what to be aware of when you are not a US citizen but you were previously charged with a crime. Hello there, and thanks for watching! You may need to talk to an immigration attorney first to see if expunging your record is going to help your citizenship application in the way that you desire. If so, definitely reach out to an expungement attorney in your state.

Yea it’s no point because w a lvl 2 background search it’s going to show . So expungements are useless
BUT THEY JUST SAID IT SHOWED UP! SO OBVIOUSLY THEY ARE NOT GOOD TO GO EXCEPT TO THE HOMELESS SHELTER!@@Blkknowitall

Hello ,
My record was recently sealed under first offender protection my questions is if I’m requested to submit fingerprints what will show up ?
You may want to talk to the lawyer that represented you in the case to find out the effect of your sealed record. I'm also not sure why you would need to submit to fingerprints or what that would be used for.
I hope Florida is one of those states where the expunged record is completely removed from the justice system
if it’s sealed then it’s sealed, why even look deeper into it?
People are Nosy and they love to have one over on you to call you a thief , Drunk etc
Do you have to disclose a expungment when applying for a state licensing, like a insurance agent?
Hey, thanks for watching! It depends on what the expungement laws say in the state where you received the expungement.
@@MyDcLaw I'm in Las Vegas and Mines was dropped completely which mean I don't have to report at allis what I was told! Ty
So record sealing still prevents you from legally obtaining a firearm?
No. Once it's expunged for example a domestic violence case, get it expunged then after it's on record obtain the copy and send to fbi with your prints and nics number cuz it can take a year for it to go into place even though it has been expunged

Yes . Any state job will still be able to see it . Just not the public or regular job.

apparently I lost my right to carry a firearm or reliable weapon because of something like this, I’m confused now

What if u said a no contest and did the community service and the other stuff are I able to did one of these?
I was in a car accident and the police took my guns. I had a simple battery misdemeanor in 01 and they won’t let me get my guns. What can I do?

Can a DUI that resulted in accident and conviction in texas be sealed?
Every state’s laws are different. You will probably want to talk to an expungement lawyer in Texas to get the most answer.
I have records in other states. Would i have to go to each state? Can a lawyer do them all? Thanks.

Can the bank or finance institution see the sealed record when they run a background check?
It would probably depend on the way the record is sealed and the kind of background check that was ran
I thought expungements was only for children at 18 or younger

Your best bet will be to reach out to a California lawyer or a lawyer located in the state where you got arrested.
