Excellent discussion. Ron Coleman presents the key question that must be considered "Do you own her, by virtue of having a job in one of your 'comic book movies', is this woman now your property such that she can't express an opinion on any matter that you disagree with as long as she is employed by you"?
This is literally covered by Californian Labor Law that an employer can not influence an employees political opinion, or forbid/influence their speech or terminate somebody for their political speech. The 40 LGBTQ+ people yell at you on a computer screen "struggle session" stuff alone is enough to light a fire under Disney / LucasFilm and Kathleen Kennedy's collective asses. And i bet you, they do that shit on a regular basis to tons of employees, or it would not be this organized of a system.
She made it to discovery which is the most important part. She will now get to see Disney's internal communications. We're about to turn over this woke rock.
Don't think it was lost on me, that this trial hearing began the same week that, The Acolyte's "Destiny" episode aired on Disney +. Notice how virtually no establishment media outlets have mentioned that Leslye Headland's name was mentioned in Gina Carano's lawsuit as being one of her abusers (during her time employed at Disney/Lucasfilm Ltd.), and how that (most likely) has had an impact on the SW Fan base's reaction/reception to Leslye Headland's The Acolyte? Kids, if you don't know about the legal term, "Discovery"...well, you're gonna get a GREAT DEFINITION/DEPICTION of it in this case. WOAH, BABY!
Well the case was filed awhile back but it took time to get a court trial. And there's not much to discover as all the dirt is out there but Gina was very polite in her interviews and never bad mouthed anyone and didn't mention names but we all know who. Jon Favreau fought to bring her back but higher ups blocked it. It's very political at Disney.
@@jonfreeman9682 discovery will include any official communication (e.g. email, text messages, papers, etc.) created by Disney related to the case. Essentially we will possibly see things that haven't been made public.
Disney's trying to use the First Amendment as a defense for firing Carano would be very bad if it worked. The amendment is suppose to uphold freedom of expression, not stifle it.
And that's why Disney will win, they said nothing that was factually incorrect or not opinion related. Calling a person despicable or a bad person, is an opinion. It'd be different if they called her a murderer.
@@AllyMonsters I think what's being tested is the California law that was originally intended to prevent communist sympathizers from being fired for expressing their opinions, and now Carano is attempting to use it in her defense because now it's conservative opinions that are taboo. Whether she wins will determine the strength of that law or if it only works for communists.
Because Disney is run by woke SJW's, and there is one type of racism that they are absolutely A-okay with, one group it is totally and completely acceptable to say the most vile and bigoted things against.
The problem is they were claiming that she was anti-semitic and they didn't want to be associated with that. She clearly was not. I don't understand why that isn't being argued. They are lying about why they got rid of her by pretending that she said THE OPPOSITE OF WHAT SHE REALLY SAID. This seems very relevant.
So by Disney's point of view, can conservative minded companies fire employees based on public and/or online opinions about certain topics that they don't support or align with? Because I'm sure if that happened, a double standard would apply and there would be some sort of public or online outrage expressed, that Disney would no doubt openly support.....

Winning is not money. Winning is discovery and taking all that information to court. As they often say, the punishment is the process. Its time to process Disney to within an inch of its figurative life.
Disney operates like an NGO, advocating certain viewpoints,. The company is so focused on its "messaging" and advocacy for certain causes that it has forgotten that it is a for-profit corporation. The money Disney lavishly wastes is the investors' money. Disney is not a good steward of its resources, much less making a profit for its owners. Past time to get rid of Iger, his top executives, and the Disney board.
It isn’t even that they fired her. It was all the struggle session shit and then the public character assassination after they let her go. If they were so concerned about the social media profile of their employees, then they should’ve put that in their contracts. [not to mention the double standard]
While I don't necessarily agree with everything Ms. Carano has said, the appalling coordinated attack on her person is beyond the pale; don't want to work with someone anymore, fine, but don't attack them.
But did they attack her? They only cancelled her or more precisely didn't invite her back for season 2. Rumor was there were plans for her own show as she was popular as a bad assery boss girl. Did Disney do or say something?
@WaltRight what in god's name are you babbling about? Carano wasn't "attacked." She wasn't fired, Disney didn't violate a contract or refuse to pay her what they owed here. So, genius, tell me how she was "attacked" or "treated unfairly." Please be specific
I like the idea of the CA law protecting political opinion from employers. To me it's a free speech protection. When Ron presented the question, does the corporation own you because you are it's employee is the key issue. That makes not about Gina, but a constitutional argument protecting the citizenry. Corporations already believe they own their employees. This ruling can help ingrain the separation of the personal life, and speech, and when they are on the clock at work.
@Ron - She must have been considered an employee by Lucasfilm if they were trying to FORCE her into a 40+ person struggle session. Since an entire show was being designed around her, Faverau certainly thought she was going to be working with him on a Disney Star Wars show for many years. Just because there was no current contract, their behaviour shows they were treating her like an active employee.
She was on contract for Mando season 2 and maybe more seasons and there was discussion of her own show and Jon Favreau was a big supporter of hers. What's cool about Gina is she was no 90 lb Mary Sue but a real warrior fighter who looked the part so this is girl boss done right and she has legions of fans. Yes she was an employee but like all employees anyone can get fired for whatever reason when someone is out to get you. Honestly Disney would be smart to bring her back as it'll help with ratings.
Jon Favreau informed Gina, in October 2020, that Disney had given him the go-ahead to produce, Rangers Of The New Republic. By December 2020, Favreau had already completed 2 scripts for the series; with The Pilot being given to Gina to read. Paul Sun-Hyung Lee (Captain Carson Teva) supposedly also got to see The Pilot, as well, since he was going to be playing Cara Dune's partner in Adelphi Squad. When Kennedy pulled the crap she did, she screwed a large number of people who would've been involved in that guaranteed success of a SW show...all because she hated the fact that all of the female characters from The Mandoverse were being praised and adored by general SW Fans, inc. the DREADED MALE SW FANS; which made characters like Rey, Rose Tico, Admiral Holdo, etc. look like the faulty, over-baked creations they are; which demolished her narrative that women should be a major force in running SW storytelling...STUPID and UNLAWFUL.
Regarding the "But if she said this..." hypothetical, why not turn it around? What if Disney fired someone for posting an Instragram image of their pancake breakfast because Disney wants their audience to like waffles? This is exactly why most common people are skeptical of the "corporate persons" legal argument. Too often it amounts to corporations asserting greater legal rights than the people. I can respect that a business needs some protections to conduct themselves as they see fit, but if they cannot show how the conduct at issue is RELEVANT to the business, then they have no grounds to interfere with the rights of the individual.
My hope is that all this will be revealed to the public and on display. Hopefully, this will be the final nail in the coffin. Disney has destroyed all of my favorite things between Marvel and Lucas Film. I hope that a hostile takeover is in their future.
@WaltRight lol - nope, the law doesn't work that way. Go read the CA law. What others do or don't do have no bearing. Indeed, they would have had the same case she does.
@WaltRight If you think I'm defending Disney then you have a SERIOUS reading comprehension problem. Slow down there and stop flying off the handle. You're all over the place in these comments.
We all know what Amandla Stenberg said in a TV Show about a certain pale dwmographic and that her goal was to make them cry... If she can starr 2 roles in M.r Weinsteins former secretarys TV show, Disney have a bit explaining to do regarding Gina.
There was no obligation for Disney to announce their feelings about Gina, and they could’ve simply not cast her. Instead, they went out of their way to make declarative statements about her character and actions which were demonstrably false and clearly designed to poison the waters for any future work. As an employer, they should know better than to directly interfere with future employability and the price should be high enough to discourage anyone from ever trying the same in three future. I am thinking 1B per month of unemployment, or Disney’s rights to Star Wars.
They're running a business. They were under fire. And her behavior was utterly reprehensible. Disney is allowed to say so. They're allowed to tell their shareholders and customers that they're disgusted. The truth is a defense against defamation charges. It's true that she made those selfish nasty, ignorant statements. And, presumably, it's true that Disney was as disgusted by her behavior as any reasonable adult would be I'm curious: how did you first hear about all this? Seems that the Judge would need Discovery to rule on any motion, as this looks to be. Disney's team is saying 'yeah, but, if..." "If" is not a truthful fact.
If evidence is needed, then the case survives the motion to dismiss. This motion is about if the pleading could succeed even if all the allegations are true, and it seems it maybe could succeed.
As an adjuster that handles civil rights litigation and cases citing violations of free speech (the Unruh Act as I'm in California), this litigation is going exactly as one would expect. Disney is trying to kill this litigation with a motion to dismiss. As an adjuster I would expect to motion to fail, and I would be assessing the options once it fails. Does Disney want to go through litigation and have to answer discovery? Only Disney knows what potentially could be turned over. Is it going to be worse for those things to come to light? If so, I would expect Disney to immediately try to position the case for early settlement discussions. I would not be shocked if there would be an early mediation and that they will have a settlement that will not be publicly exposed. Disney world rather do that then have their dirty laundry come out and potentially have an adverse verdict.
I would argue that investors are supposed to have legal protection from the Company's political views causing widespread financial losses. Simply because the company is choosing to inject those views into high profile shows that never had those views. As well as the fact the Company has a fiduciary duty that is legally binding to look out for investors interest over their political interests. Yet their focus here is an Actor using their 1st amendment right outside of the the "high profile show." You can also show that her firing lead to further financial damages to investors. So really when Disney is arguing this they are also admitting they violated their fiduciary duty. Just as we see official interviews with people Disney casts in other shows speaking volumes of vile hateful attacks against the fanbase and causing even more financial damage to investors... yet Disney takes no action there because it is a mirror of the same political beliefs they are pushing. At the end of the day Disney is in the wrong PERIOD because they have violated fiduciary duty and really what should be happening is an investor lawsuit. So when I hear "it's their company"... well no it's not. They are losing others peoples money. If they want to prop up whatever political view and take the losses... you do that as a Private Company with zero fiduciary duty. PERIOD.

And stop lying, by the way. Disney never said "Gina Carano is despicable." If you have to twist the truth to make a point, maybe you don't actually have a point.
@@christheghostwriter Who are you responding to now? To @rschiwal again, or someone else?
I’m here for the DISCOVERY. No wonder Disney wants to avoid that exposure.
the thing is, Disney didn't fire her because they thought it would hurt their audience, they fired her because they thought it would hurt the audience they WANTED (as evidenced by the people they made The Acolyte for, since it's not made for the OG Star Wars fans)
"is she your property?"
That is a comfortable euphemism for slavery.
"abusers" lol you people are always such whiny little victims
@@AllyMonsters But I also see your point - in any other state, Carano would probably have no case.
Disney: "We're a creative company!"
Also Disney: "Our new character is a rock named Geode"

Disney "We love strong women!"
Gina "I'm strong"
Disney "Shut up b---ch!"
If Disney is so concerned with an actor's beliefs, how come they have no problem employing a known racist like Amandla Stenberg???
Their host, Krystina Arielle is one too.
Because Disney is run by woke SJW's, and there is one type of racism that they are absolutely A-okay with, one group it is totally and completely acceptable to say the most vile and bigoted things against.
Who mind you is bi racial and daughter of president of company so she knows fk all about struggles of black folks. Just another hypocrite.
There should be total transparency, but because Disney is scared of the ramifications they DO NOT WANT IT.....
Disney has gotten used to playing fast and loose with the law for a long time. The chickens are coming home to roost.
Disney you had it coming, Gina we are with you!
She has nothing
My two favorite attorneys, Ron Coleman and Andrew Esquire. They both know how to explain the law in a way that the average person can understand.
Excellent! Than you Val for the update.
As I understand the situation, she kept posting after told several times to stop. Looking at the laws Disney can fire you for saying something that they feel like they can hurt their brand.
Now she points out Pablo Pascal had tweeted something as well but wasn't fired. As I understand it he only did it once and stopped.
It happens all the time
@@Deuteromis just to be clear: she was NOT "fired." She was an independent contractor. They fulfilled their obligation to the contract. They chose not to offer her a new contract. That's within their rights. This suit should be thrown out.

Gotta love when Lameafornia law comes back to bite them
Disney operates like an NGO, advocating certain viewpoints,.
Disney stock now under 100/ share...keep it up 😂😂😂
It isn’t even that they fired her. It was all the struggle session shit and then the public character assassination after they let her go.
If they were so concerned about the social media profile of their employees, then they should’ve put that in their contracts.
[not to mention the double standard]
Get all KK emails and headlands emails
its funny how disney is against the naz- while acting like a naz- go gina
While I don't necessarily agree with everything Ms. Carano has said, the appalling coordinated attack on her person is beyond the pale; don't want to work with someone anymore, fine, but don't attack them.
But did they attack her? They only cancelled her or more precisely didn't invite her back for season 2. Rumor was there were plans for her own show as she was popular as a bad assery boss girl. Did Disney do or say something?
They didn't "attack" her. Seriously, why are you people such disingenuous drama queens?
@WaltRight why are you lying and comparing what Carano did with what Pascal did?!
@WaltRight what in god's name are you babbling about?
Carano wasn't "attacked." She wasn't fired, Disney didn't violate a contract or refuse to pay her what they owed here. So, genius, tell me how she was "attacked" or "treated unfairly." Please be specific
@WaltRight no, he didn't "do the same thing." Why are you still lying?
I like the idea of the CA law protecting political opinion from employers. To me it's a free speech protection.
When Ron presented the question, does the corporation own you because you are it's employee is the key issue. That makes not about Gina, but a constitutional argument protecting the citizenry. Corporations already believe they own their employees. This ruling can help ingrain the separation of the personal life, and speech, and when they are on the clock at work.
Get them, Gina, go get them!
My prediction is that the discovery is going to hurt Disney, or at the very least it is going to reveal a lot of cringe statements by Disney.
Nothing we don't already know. But it will mention names. 😱
And hopefully open a lot of new lawsuits and investigations into them.
Disney double standard vs a California law meant to protect commies. Gotta love the irony. 😂
My hope is that all this will be revealed to the public and on display. Hopefully, this will be the final nail in the coffin. Disney has destroyed all of my favorite things between Marvel and Lucas Film. I hope that a hostile takeover is in their future.

And, presumably, it's true that Disney was as disgusted by her behavior as any reasonable adult would be
I'm curious: how did you first hear about all this? Was it from Disney first, or from Carano first?
"which were demonstrably false"

Disney, in the past several years, has only been successful at fucking everything up. Its impressive... Most impressive.
I hope it doesn't go the way Disney wants they were dead wrong for doing that and it really is time that they get in trouble for it
Walt Disney Co is a public company...She's got a case.
I don't think either Gina or Elon have ANY interest in settling. Sucks to be Disney.
PERIOD.
My question? If Gina posseses slanderous email on Disney. Can she release them if the trial is dismissed?
