    Let me get this straight. In Canada if you’re a repeat violent offender your caught and immediately released over and over. But if you’re a normal citizen getting attacked with your mom in your home you have to go to jail and pay lawyers. Great job Canada

      Let no good deed go unpunished:
      "On September 19 at 10:40 a.m., one man saw another man place a small child in the trunk of a vehicle at a strip mall in Yarmouth. The child was placed in the trunk and left there unattended while the man was inside a store. The man came out of the store a short time later and removed the child from the trunk and put her in the back seat of the car. The witness called police, and he confronted the man with a firearm he retrieved from his vehicle. He tried to keep the man from leaving with the child before police arrived but was unsuccessful. The entire interaction was captured on surveillance video.
      Police arrested the witness for firearms offences. He was taken to the detachment for processing. RCMP made inquiries to locate the man and child, and found them in Yarmouth County. The man was arrested and taken to Yarmouth RCMP. The man and child are known to each other and the child was in the man's care at the time of the incident.
      The man, a 33-year-old from Yarmouth, was released on conditions and is facing charges of:
      Criminal Negligence
      · Abandonment
      · Forcible Confinement
      The witness, a 19-year-old man from Yarmouth, was released on conditions and is facing charges of:
      Careless Use of a Firearm
      · Possession of a Weapon for a Dangerous Purpose
      · Using a Firearm in the Commission of an Offence"

      Ok so if the attacker is pointing a gun at him and then Mian instead shoots in to the ceiling, what will the attacker plausibly do with the firearm he is pointing at Mian? Should he, pray tell shoot in to the ceiling too?
      Only a complete fool assumes that when the attacker has a firearm out, that you should instead shoot in to the ceiling. That round may go in to an upstairs apartment and kill a kid by the way if they lived in a building.
      Could you be any more dense with that assumption given we know for sure the attackers were armed?

      In the us a lawyer is basically required have a reasonable case and can face sanctions and be disbarred for having an unreasonable case. Ideally, bad cases get dismissed with prejudice by the judge.
      But you also have to remember that the purpose of legal procedure is to find the facts and render judgment in a case. It's very dangerous to create a situation where representing someone (a right guaranteed, I believe, by the canadian charter of rights?) Becomes professionally dangerous and makes it more or less impossible for people to get legal representation. And what even happens with public defenders in this case?
      In this case it's the crown vs a citizen, so really the solution is to put political pressure on whomever selects whatever Canadian district attorneys are called to make sure they aren't criminally prosecuting people.

      We *can* write rules to protect government employees from honest errors, and also rules which utterly remove that protection when they become tyrants.
      Slippery slopes *can* be made safe by installation of robust anti-slip devices.
      I'm an engineer, and my fear of the consequences of a terrible mistake makes me a *better* engineer.

      If the system worked that way it would sure do wonders to weed out frivolous cases like this. Yet in the same breath your average thug would be unaffected because those people don't have jobs and their defense is paid for by the taxpayers anyway. Really a win-win for the average working citizen, which is why it will never happen.

    Intruders had a firearm, zip ties and rope… truly unbelievable this man was charged.
    If I were him, regardless of the outcome, I would be at peace knowing I potentially saved my families life. What a country we live in. These laws will never change.

      Be concerned, at a minimum, because the government has stolen your means of self-defense, is unlikely to return them, and the surviving attackers can plainly see that the government has their backs should they decide to get some revenge for their fallen fellow criminal.

      And what would have happened if the bad guys didn't have a gun, zip ties and rope.... presumably the murder charge would have stuck and he would go to jail.
      In the dead of night there's no time to try to devine the bad guys intent rather there's only time to act. He was very fortunate that they were armed they way they were...and now he's sits unarmed, helpless against the likely return of these losers...just like the politicians like it.
      The idiots who make up these ridiculous laws often have round the clock ARMED protection so to them this all seems perfectly reasonable.

    You know that there is heavy political pressure to always arrest whenever somebody uses a firearm against a person at all, in your home, against armed kidnappers, doesn't matter. If you even contemplate having a gun in case of a life or death circumstance in your home you will fail the test. It's not something I need to worry about with my living situation however for so many people the government is forcing them into victimization. If they keep his firearms that's just disgusting, he's already out so much and he's the victim here. There's so much political pressure against guns the government is literally treating the victim as if he's the criminal. Makes me sick.

      I agree 100% and feel this man could have his life put in serious danger from this moment onward as a result of this incident, he really needs his guns like never before. So much so, that if taken away, could be the motivation to purchase an illegal gun. It’s an unnecessary nightmare for an innocent man & his family.

      ​@@Ken-gv6sb You know that the political arm of the prosecution that pushed for this is counting on this and is going to try to engineer whatever circumstance they can to spot check the storage of the guns. If the homeowner is rightfully and logically afraid of reprisals from the gang and stores his firearms and ammo in such a way that he could access them in an emergency then they're going to charge him and send him away for 10 years. They absolutely itch to get into gunowners homes to check on how difficult it is to access firearms and ammo, it's disgusting, go after actual criminals who don't bother with any of this. It's a performative charade so they can say look we're doing something about gun violence despite it literally being a completely different subset of people who don't have PALs or gun safes who commit it all. They're so far gone off the deepend and hate gunowners that they're giddy about ruining totally normal people's lives. Conversely they also have a huge soft spot for criminals especially if they're high up on the victim ladder that they're soft on people who actually victimize others with firearms.

In fact I believe it’s another chapter in the Justice Industry where so much taxpayer money is milked by a chosen few perpetuating crime that nothing will ever be done about it. If only the public knew how much taxpayer’s dollars are wasted defending criminals while saying we can’t afford schools, hospitals and old age pensions. Getting tough with law abiding gun owners is obviously nothing more than a political stunt to appease the blind masses and goes against the advice of police chiefs across canada.

      There was no case and this didn’t really establish any rights at all, as we would if this went to trial and he won establishing case law. So this was just a waste of time and hopefully a learning experience for the authorities to do investigations before wrongful arresting someone for defending themselves.

    How does a prosecutor go 'oh this man shot and killed one of FIVE armed assailants who broke into his home? Welp, time to charge him with 2nd degree murder' like that prosecutor is deeply unfit and quite frankly an added layer of danger to the community. In my humblest opinion.

      Prosecutors who lay charges that are clearly stupid, such as in this case, ought to be penalized. There needs to be some sort of incentive for them to not proceed with charges in cases like this where the established evidence is so clear.

      He can but one of the things you'd have to prove is that the police acted in bad faith, like for example, they knew who he was and had a prior history with him as a protestor/activist or something like that and put him though this intentionally/willfully, to cause him financial damages and intentional mental anguish. You're unlikely to win if the police acted in good faith but did a poor investigation and simply screwed up or could have done better.

      Wrong, despite the lies the media and current government spews. We absolutely do have that right in Canada. Full stop. Any charges are corruption/incompetence and you end up fighting it like this guy. A similar situation happened a few years ago near my area. Husband and wife had a home invasion where they were taken hostage. Their adult son was living at home and selling drugs. (That's the reason for the invasion) he wasn't at home at the time it started. Came home mid point. Caused a distraction, and the father was able to grab the gun from one invader and shot one. He spent 2 years in court but did walk away an innocent man. They just want you to think you can't. That's the sickening thing...

If someone breaks into your house you should be able to defend yourself, your family and your home. However for example if a non-violent person with a mental impairment let's themselves into my home because they were lost or wandered off, I don't think they deserve to be harmed for an innocent mistake. Legislation and expectations ought to be nuanced enough to differentiate without always having to run to the courts.

    I've written and said this a hundred times: The police almost always take the position, "Let the courts decide". That's all well and good for them but the innocent guy has to go through hell and financial hardship until the charges are withdrawn or thrown out.

      This concept removes the separation of powers. Cops should never be allowed to lay charges. They should only be allowed to lay information and the charging should be the responsibility of the prosecutors office.
      You will hear constantly the defence of “cops not qualified to give a legal opinion” when being cross examined in court yet somehow they magically have the power to make a legal determination to lay a charge in the first place??? Ridiculous.
      Thus any time a cop lays a charge is a violation of law.

      They don't want to admit they are wrong, so they merely insist that since they have temporarily suspended their grievious actions - that somehow no legal harm or foul was committed on their part, simply because the restrictions are not in force atm;
      even though they could be reinstated at a moment's notice (but they do not want any legal precedent set to prevent them from acting in the exact same manner if the opportunity ever arises again)!!
      This isn't "Justice" - it's legalised entrapment with an automatic built-in escape clause for The Monarchy...
      The Gov't. doesn't have to play fair or be "honourable" because they have carte blanche to do as they please in their manipulated de facto entitlement system.

    Actually, an intruder with a mask is less scary than an intruder without a mask.
    Having a mask implies that you'll live and they don't want you to be able to identify them.
    No mask implies that they aren' worried about identification, so assume they'll kill you.

    Dropped the charges ! AT WHAT COST ? How much did this guy have to pay a lawyer/lawyers till the crown dropped the charges for something the police and crown should NEVER have gone ahead with in the first place. His life turned upside down and I am sure many sleepless nights.
    Charges dropped ...... but we will bankrupt you !
    They leave you feeling that YOU are the criminal instead of what you are, the victim.
    That is Canadian justice. SAD

    before anyone says this was a victory reminder he spent 2 weeks in jail, had to post a 100k+ bond and had to turn over all his firearms and was under house arrest his entire trial. score one for the good guys!

    In the US they have the Felony Murder rule which applies the charges to accomplices when another dies during the commission of a serious crime. In other words, if you & your buddies decide to commit a home invasion and one of them gets killed by the victim, then you get charged as an accomplice to murder. Seems very fair.

    I feel so sorry for this man. We were in exactly the same situation in February. 5 armed men broke into our house. I woke up looking down the barrel of a handgun. My son and I were tied up and they stole everything. Still suffering from PTSD.

Did the police act independently without consultation with the Crown Attorney prior to charging this man in the interest of getting a murder charge for their stats ?       The police do not have the power to lay charges. All they may do is recommend laying charges. The crown prosecution reviews the evidence then decides whether or not to lay charges.

    This has also happened in England! An old man managed to stab one of the intruders with his own screwdriver…brought to the terrifying break-in to threaten the elderly homeowners! The police frightened the couple MORE by arresting him. There was public outrage until he was released & apologised to by the police!!
    His wife had severe Alzheimer’s & was asleep in bed. The other home invader headed upstairs (towards her bedroom) whilst the other held he husband, threatening him with the screwdriver. The husband panicked to save his vulnerable wife & managed to stab the home robber with his own weapon…

    It is the way the law is worded. Change one word from "shall" to "may" and instead of having mandatory charges laid, it gives the police the option to actually investigate the facts first before deciding whether or not to lay charges.

      Unfortunately the word 'shall' is there because the police in this country previously would always lay charges against specific groups of people, but not lay charges against other specific groups of people ... one group gets the benefit of the doubt while the other group did not. We need clearly defined intelligent laws, not police that have the discretion to pick and choose. They haven't evolved enough yet to be given that privilege.

    Thanks for your input on this! As a legal firearms owner, I’ve always wondered what the consequences would be for self defense in your own home. I think its appalling the legal costs are on him, that he had to post bail and can’t recover that money, and now has a criminal record. The legal fees should be billed to the people that illegally entered his home!! Totally to the one guy they caught, then disbursed among the remaining criminals once they’re caught. I’m sure the one criminal would have reason to give up his buddies knowing he alone as to pay for the legal defense of the true victim. My belief is when you’re convicted of a serious crime such as this your forfeit all rights and are held fully accountable for damages caused by the illegal actions. Totally unjust for the victim in this!! 🤬
