Bryan Kohberger Silently Pleads Not Guilty as Shocking Revelations Surface in Idaho Murders Case

  • Bryan Kohberger was arraigned in court Monday and pleaded not guilty by “standing silent” when the judge asked for his plea. Kohberger, who’s accused of brutally killing four University of Idaho students, appeared to firmly understand the charges at hand, including the possibility of receiving the death penalty if found guilty of the murders. Plus, new revelations about the accused student killer’s behavior after the murders have surfaced. The Law&Crime Network’s Jesse Weber and Angenette Levy, who was inside the courtroom at Kohberger’s hearing, break down the arraignment and new revelations with famed Johnny Depp attorney Ben Chew.

    According to Cornell Law School, remaining silent means the suspect does not take a stance on being guilty or not guilty; they simply refrain from speaking. If a suspect refuses to enter a plea or decides to stand silent, the court must enter a not guilty plea on the suspect's behalf.

      And statistically the 'stand silent' suspects are eventually convicted of the crime or crimes (plural) they are accused of a remarkable 98.2% of the time. These types of individuals are usually the type of men (and some cases women) who to an absolute 100% certainty guilty

      I think people (myself included) are still wondering what, if any, would be the strategic purpose of standing silent vs. entering a not guilty plea. I could understand it if pleading not guilty would disable him from being offered plea deals and he wanted to keep that window potentially open, but that doesn't seem to be the case?
      If there's no benefit to it, then it makes you wonder why he chose that route. You'd expect innocent people to fight for their innocence.. and guilty murderers to fight even louder for their innocence lol. So this is an odd choice.

    Could you imagine who his parents felt?
    Less than a yr ago, they were so proud of their son being accepted into a PhD degree.....
    The dad decided to drive with his son back home for holiday so they could bond over this long trip....
    Then police broke into their home to arrested the son for murders....
    Now the son is sitting in jail for a yr waiting for trial that could end up him being put down or spending rest of his life in prison....
    The father couldn't do anything but to clean up the broken glasses from the police raid during the arrest....
    All these happened within just a year.

      As a parent, I can’t think of anything worse than finding out my son did something like that. To me, it’s worse than having your child murdered..

      Actually, no I can’t imagine, this has got to be slowly killing them. The look the father’s face when he was sweeping up the glass, broke my heart. They might not be physically behind bars, but they are in prison in their own home. They are also victims.

      This is devastating for any parent and family member. His sister was fired from her job. That last name Kohberger is forever ruined. He has brought SHAME and HUMILIATION to his entire family. The best thing his family could do for themselves is disown that thing, move to the middle of nowhere, legally change their last names, and never visit or talk to that monster Brian Kohberger again.

Can you imagine having a beautiful child in college and having so much hope for their future then having this happen to them???     My understanding is that the sheath did not have Bryan’s dad’s DNA. They got DNA out of the trash in PA which belonged to the father of the person who left DNA on the sheath. That was the connection. The DNA on the sheath was Bryan’s.

That is how everyday people read a silent pleas. A person that was really not guilty would be eager to plead not guilty and profess their innocence.

      Something doesn't feel right because no one wants to believe such an unprovoked and premeditated murder could happen like that by one sick individual...it's particularly scary and unsettling because it reminds everyone how vulnerable we or our children are despite it being extremely statistically unlikely to happen to you...
      I'd be shocked if he's not the one just based on what we know so far but I'm willing to keep an open mind depending what comes out at trial...dude's got a lot of explaining to do and "somebody borrowed my car that night" isn't likely to fly...

      In Idaho, the Governor is putting into law that if the drug for lethal injection is not available, then it would be legal to put someone given the death penalty, before a firing squad.

      I would never!
      Imagine if a piece(s) or pieces of the evidence used by the grand jury is incorrect, or something you want suppressed, or challenged; or imagine being able to know, before the arraignment, that the evidence provided to GJ has you with no doubt-and you might have pleaded guilty if you knew-but you don’t even know what they have…..
      Waste of time and just ridiculous. Show me what I was indicted on by the grand jury BEFORE I enter a plea.

    Dennis Rader (BTK) also stood silent. Hard to say not guilty when you know you're guilty. That was my take. BCK (Kohberger) didn't want to say the words. He may end up describing how he got into the house and then how he killed each student....just like BTK.

      This is IDAHO. I highly doubt anyone is going to overturn the death penalty for a thing like Brian Kohberger. Anyone guilty of 1st degree is subject to the death penalty there and Kohberger is guilty of 4 1st degree murders so the judge will order 20 to 30 years followed by death penalty likely.

    It was Bryan’s dna, through genealogy websites they made a familial match on the dna with his father, that initiated the warrant to obtain dna from Bryan which proved to be a match.

      False… they found a single source male DNA on the knife sheath next to a victim.. then got trash with items from his parents house and expedited the items to the lab in Idaho and when that came back a match as the father of the DNA found then the arrest warrant was signed and initiated

      As weird as it sounds, the sheath being there does not necessarily allow for them to convict him for murder. Someone could have placed it there, set him up, it could have already been in the house, etc.
      All unlikely, but just saying, they'll have to come forth with more hard evidence, which I'm sure they will.

    The witness living in that house never identified Kohberger, and never claimed to have witnessed the actual murders. She merely described the man that she saw leaving the house. Her account is impossible to attack since it is purely her perspective. What can be attacked is the prosecution using the witness’ description, but even that is not going to be easy.

      -You are scheduled to be arraigned based on a true bill indictment from a grand jury
      -You do not have the GJ materials outlining what you were indicted on-you have nothing from the grand jury
      -Do you just plead not knowing exactly what the GJ was given and what evidence they indicated you on?
      I wouldn’t. Common sense to me.
      Can there be other reasons…yes. But this makes sense to me as a smart strategy. Especially since the defense is still asserting they have not received all materials from the prosecution. Standing in silence can also be viewed as a protest against the way the case is progressing.
      Smart move imo.

    Some are really upset with the Judge’s mispronunciation of Kaylee’s name, while I totally understand, is it smart to pi-s the Judge off this soon?
    Pronunciation is not on the top of the Judge’s list, JUSTICE is. There are also 3 other victims, 3 other families going through this, all 4 families could face the repercussions of what one family says & does.
    I’m not saying the matter should not have been addressed, but it could have been handled privately. Things like this is exactly why the Gag order is in place, the public doesn’t & shouldn’t know everything.,

      I retired from the court system in another state and Burglary in that state was breaking and entering with the intent to commit a larceny OR ANY FELONY therein." Larceny is a common reason people break in, but the intent to commit any felony (murder) would make it burglary, if Idaho state law is the same.

      I'm from the UK. Burglary is the entering of any dwelling and that includes a car without permission with the intent to commit theft or whatever else. Aggravated burglary is entering a residence whilst in possession of any type weapon which could cause bodily harm.

      If a defendant doesn't answer, the judge must enter a plea of not guilty and let the trial proceed. For a judge to enter guilty then it would not go to trial and an appeal court would overturn it and he would go free or set a new trial with "not guilty".

      It wouldn't lead to a mistrial because a judge mispronounce their names. This isn't even the judge who will preside. That will be determined later.

    Bryan didn’t please not guilty nor did he plead guilty. He chose to stay silent. When the accused chooses to stay silent, the judge judge marks it down as not guilty. This does not mean that Bryan pleaded “not guilty”.

    I think he’s done this horrid thing many times, gotaway with it, LE did not look too deeply into past cases, so he wasn’t too worried about covering all bases as history told him he’d get away with it… so glad he got caught this time. LE did a great deep investigation this time. This is the gift of public attention.

      It's possible, it's hard to imagine someone first time is able to pull off a quadruple homicide by knife and have never attempted it before. Could be either way, maybe he finally snapped? Or he's been up to this evil in the past. I happen to not be far away from where this nut went to school in PA. I wonder if by looking into that area of any unsolved cases come up

      These families emotions are raw. It's only been 6 months so don't expect them to be perfectly perfect. The judge made a mistake and it wasn't a small one for Kaylees family but I'm sure he felt bad. It's mostly about being watched under a microscope during a highly emotional time rather then intentional disrespect.
