- Bryan Kohberger was arraigned in court Monday and pleaded not guilty by “standing silent” when the judge asked for his plea. Kohberger, who’s accused of brutally killing four University of Idaho students, appeared to firmly understand the charges at hand, including the possibility of receiving the death penalty if found guilty of the murders. Plus, new revelations about the accused student killer’s behavior after the murders have surfaced. The Law&Crime Network’s Jesse Weber and Angenette Levy, who was inside the courtroom at Kohberger’s hearing, break down the arraignment and new revelations with famed Johnny Depp attorney Ben Chew.

According to Cornell Law School, remaining silent means the suspect does not take a stance on being guilty or not guilty; they simply refrain from speaking. If a suspect refuses to enter a plea or decides to stand silent, the court must enter a not guilty plea on the suspect's behalf.
Do we really need your lecturing in this matter?
Yes
And statistically the 'stand silent' suspects are eventually convicted of the crime or crimes (plural) they are accused of a remarkable 98.2% of the time. These types of individuals are usually the type of men (and some cases women) who to an absolute 100% certainty guilty
@@luxuryspacegaycommunism 😂😂😂😂
I think people (myself included) are still wondering what, if any, would be the strategic purpose of standing silent vs. entering a not guilty plea. I could understand it if pleading not guilty would disable him from being offered plea deals and he wanted to keep that window potentially open, but that doesn't seem to be the case?
If there's no benefit to it, then it makes you wonder why he chose that route. You'd expect innocent people to fight for their innocence.. and guilty murderers to fight even louder for their innocence lol. So this is an odd choice.

Could you imagine who his parents felt?
Less than a yr ago, they were so proud of their son being accepted into a PhD degree.....

Then police broke into their home to arrested the son for murders....
Now the son is sitting in jail for a yr waiting for trial that could end up him being put down or spending rest of his life in prison....
The father couldn't do anything but to clean up the broken glasses from the police raid during the arrest....
All these happened within just a year.
It’s unimaginable for his parents, probably as devastating as it was for the victims parents.
As a parent, I can’t think of anything worse than finding out my son did something like that. To me, it’s worse than having your child murdered..
Actually, no I can’t imagine, this has got to be slowly killing them. The look the father’s face when he was sweeping up the glass, broke my heart. They might not be physically behind bars, but they are in prison in their own home. They are also victims.

It was Bryan’s dna, through genealogy websites they made a familial match on the dna with his father, that initiated the warrant to obtain dna from Bryan which proved to be a match.
False… they found a single source male DNA on the knife sheath next to a victim.. then got trash with items from his parents house and expedited the items to the lab in Idaho and when that came back a match as the father of the DNA found then the arrest warrant was signed and initiated
As weird as it sounds, the sheath being there does not necessarily allow for them to convict him for murder. Someone could have placed it there, set him up, it could have already been in the house, etc.

I really hope that the trial isn't audio only like the Vallo trial!!
Y would he do it though. Seems intense for a first crime.
It’s possible he was involved in others but not confirmed
Why does anyone do anything? Because it feels good.
Thrill killer.
As a person who is obsessed with serial killers Kohberger want to one up all his predecessors.
he was like ''go big or go home''
For anyone that has gone to court, you go about 4 times before your final one. You plead not guilty in hopes that the DA gives you a deal.
Iwill say though he doesnt look to sure of himself here. Spare the family from having to go to trial and just plead guilty. Ridiculous to move forward with so much evidence stacked against you. He wants all the attention on him and now he definitely has it. Won't last long, so enjoy it while you can freak.
👍thanks Law and Crime

The number of victims for me is also a reason why death penalty should be considered.
If the defendant refuses to enter a plea-or to even speak-then the judge will typically enter a not guilty plea on his or her behalf. (The judge may first try to determine why the defendant won't plead and convince him or her to do so.)
NOTICE IT SAYS TYPICALLY, it does Not say the Judge MUST Enter a Not Guilty Plea.
If a defendant doesn't answer, the judge must enter a plea of not guilty and let the trial proceed. For a judge to enter guilty then it would not go to trial and an appeal court would overturn it and he would go free or set a new trial with "not guilty".
Perhaps, the judge got her name wrong because he, being a judge who was chosen for this case, had not been following the case, as not to have a biased opinion coming into it. It may be a blessing in disguise.
lol the judge knows about the case
And they need to get over it.
No. That was wrong and disrespectful of that judge. If he doesn't even know how to pronounce their names what is he doing there?
@@judyrajnowski6004 It was a mispronunciation, simply human error, NOT a crime. Everyone knows their names and in the scheme of things, it is NOT a major situation.
@@shazzasees Gotcha but I still think it was sad he pronounced the names of those kids wrong. Surprised me. This is a big case and I sure hope if he's the murderer they get that right and he's put away for good.
Kohberger has such an errie stare
Imagine seeing him at your door at night. No wonder he creeps everyone out and was fired from his TA job at Washington State.
Yes he does to bad he didnt decide to make horror films instead of this horrible act
that's the orgasmic stare he had when pleasuring himself to illegal online images
i think his inspiration was ted bundy....and that's truly sickening
Dark Triad
It’s not disrespectful to forget someone’s name
I agree and the judge did apologize for it. To be disrespectful would be if he did it on purpose or didn't apologize which he did.
He's the judge in that case and it's his job to get the victims names right at the least. My goodness.
the judge was terrible , how hard is it to practice victims names and ensure you pronounce them correctly , he stumbled over Xanas name multiple times too and laughed and said its hard , well not as hard as losing a child , get a grip and get their names right. If he didnt prepare enough to know their names it makes you wonder how capable he is of overseeing such a massive case , even laughing over stumbling a name , come on , 4 young people dead and this goon cant even get a name right , thats why its important , it shows lack of professionalism and respect
Respect the judge
@@edub9930 dont have to
@@edub9930 He needed to show respect!
If a dude was actually smart he wouldn't have driven to the area except for the one time and his phone would have stayed on being charged on his nightstand playing a thunderstorm sleep video on RUclips instead of putting it in aeroplane mode after starting towards the victim's area.
Love how Ben avoids saying his name throughout the whole video. Not gonna give that monster any more publicity
It is confusing case and no answers yet why the roomates didn't call 911 when they heard their friends screams rumors .
When the Judge is reading off the charges when he reads Kaylees BK nods.
He is just acknowledging what is being read.
Dude is kinds odd. Guys who come off odd, weird, or creepy even though they might be saints should be very careful about taking the stand cause the jury won't have enough time to become familiar with the defendant.
His eyes look empty no life in them at all.
SAY THEIR NAMES JUDGE, it is not hard to get these right. Also it would anger me because it leads to possible mistrial he’s setting it all up for an appeal later
It wouldn't lead to a mistrial because a judge mispronounce their names. This isn't even the judge who will preside. That will be determined later.
I hope there's another judge because he didn't seem fit. He couldn't even pronounce their names correctly.
Typical narcissist move he is grandstanding and thinks the whole world is his own TV show now. Innocent people do not behave like BK, he has been creepy since day 1 in every interaction
10000000% they will go for the death penalty! I don’t think there is even a .0000001% chance they would go for anything other than the death penalty
3:23 no he didnt.. he looks more run down and defeated.. whereas before he was defiant looking and healthy
I think this guy has always been that way. I see a very sad human being.
Why was this judge not briefed on these names? It is incomprehensible. I'm sure it was very difficult in that room today. But these names are not difficult.
It was up to him to learn how to pronounce the names. Like I have always said, the smartest students are in the physics and mathematics departments, not the law school😮
Actually, I didn't know how to pronounce Xana until my wife told me. I just don't use the X as the start of a word.
Bryan didn’t please not guilty nor did he plead guilty. He chose to stay silent. When the accused chooses to stay silent, the judge judge marks it down as not guilty. This does not mean that Bryan pleaded “not guilty”.
I think he’s done this horrid thing many times, gotaway with it, LE did not look too deeply into past cases, so he wasn’t too worried about covering all bases as history told him he’d get away with it… so glad he got caught this time. LE did a great deep investigation this time. This is the gift of public attention.
My God, if this WASN'T his first time then the police need more specialized training then a lot of us already think they do! These murders were the equivalent of trying to recreate a Vangogh painting with a broom. Sloppy and frenzied af.
It's possible, it's hard to imagine someone first time is able to pull off a quadruple homicide by knife and have never attempted it before. Could be either way, maybe he finally snapped? Or he's been up to this evil in the past. I happen to not be far away from where this nut went to school in PA. I wonder if by looking into that area of any unsolved cases come up
I very much agree 💯 he has tried something in the past.
@@tigerlily8117 it's Idaho I wouldn't hold your breath
I don't, he wouldn't have been so sloppy. What is it with young people who need to have their cell phones with them? Anybody who watches Dateline knows you don't do that.
Aww love that Ben was on!!
Didn't BTK install security systems in some of his victims' homes too? There's definitely something odd about this fella, whatever the outcome. I'd be screaming from the rooftops if I was innocent of these accusations. He's so calm, like he's in for an unpaid parking ticket.
A burglary is when nobody is home he obviously got charged with wrong charge it's home invasion idots
No disrespect
Sorry but it's petty to call mispronouning a name disrespectful. It was obviously and accident and the judge would corrected himself. they didn't need to make a scene about it.
They wonder why a Gag order? Things just like this, should have been privately handled.
More people worried about a name pronunciation, than they are justice.
I agree. More important things to worry about.
Unless it’s your family member.
These families emotions are raw. It's only been 6 months so don't expect them to be perfectly perfect. The judge made a mistake and it wasn't a small one for Kaylees family but I'm sure he felt bad. It's mostly about being watched under a microscope during a highly emotional time rather then intentional disrespect.
@@shelleyplemons1362Exactly. Everyone so quick to say how these families should feel. They don’t know what its like to walk in their shoes nor would they ever want to.
I don’t know if we will ever really know WHY he did this.
True, I just want justice is all I care about.
