      They still can be, they're legally in the courtroom for all meaningful purposes while on Zoom. It also allows the extremely useful ability to mute them, which is quite difficult in real life.

      He now has a vested interest in not understanding the nature of the court he’s being tried in because he paid money for the documents telling him he must be tried only in a common law or maritime court.
      The judge could probably have short circuited the conversation by saying that the 10A lets states form additional courts as required.

The moment this guy asks "What jurisdiction am I being tried under?" the response should be "If you don't know, you're not fit to represent yourself and I'm gonna have to appoint you counsel" -- Period.

    One day a judge will tell a SovCit If you cannot understand the jurisdiction or the charges against them then they are not fit to represent themselves. That seems like a no-brainer to me. The vast majority of us understand what statutory law is.

      It should be but I think some judges don't know what's happening initially or they assume the defended might be mentally impaired.
      It is annoying when judges entertain their nonsense. They should start shutting them down once they start talking about "maritime" or "admiralty". It's a waste of the court's time.

    Another misconception - The 1st Amendment allows you to redress any governmental grievances . Actually, it allows you to PETITION the government for a redress of grievances. Call flooding a librarian, city clerk, or police station dispatch a thousand miles away from you isn't what the Founding Fathers envisioned, I suspect.

      He knows it's not admiralty. He just thinks admiralty and common law are the only two options, so when the judge says "neither," it somehow invalidates the charges against him. Doesn't matter how many judges and lawyers tell him he's wrong, he thinks he has a chance to get off scot free if he continues to do it his own way rather than cooperate.

      Texas is on the coastline (Gulf of Mexico), it's the southern coast of the USA. You seem to be under the impression that the US only has two coastlines on the east and west sides. Texas is literally known as the third coast state. I think he said he was in San Antonio, that's close enough to the coast to spend the day at the beach and be home for dinner. (about a 2 hour drive)
      There's still zero chance of him being tried under admiralty law, but your estimate of his distance to the coast is about as wrong as his request to be tried under admiralty law. Maritime/Admiralty law pertains to incidents that occur at sea or in “navigable waters” (e.g., lakes, rivers, and wetlands) of the United States, so it doesn't even require a coastline, it just requires to be on water usable by a watercraft. However, it also doesn't replace local jurisdiction if there is overlapping state law (such that a lake is covered by both state and maritime), in the same way state law doesn't replace federal where both can apply jurisdictionally.

      It might be possible to explain it to them in the form of an "implied contract", like sitting down to order dinner at a restaurant; you implicitly agree to pay for it. When you drive your car on the public ways you implicitly agree to follow the laws and become subject to ALL OF THE LAWS of that jurisdiction (federal, state, county, municipal, if not also tribal).

    I love the fact that the prosecutor very clearly answered the common sovcit nonsense about consent. It always riles me up that they think laws only apply if they give some sort of formal consent. I'd like them to try that in other more restrictive countries. Would love them to go somewhere like Singapore, then argue "no you can't beat me for having drugs since I didn't consent to any contract with your country and you don't have jurisdiction." It's asinine, and a kindergartner can figure this out. Are you actively within the country? Then you've consented to the laws there. Are you actively within a particular state? Then you've consented to the laws there. Are you actively within a county or city? Then you've consented to the laws there.

      Criminal jurisdiction is primarily geographical. You enter a territory, you're subject to their laws.

    They're going to keep asking the same questions over and over because they don't ever agree with the answers. It happens every time. They won't accept anything outside their mistaken sovcit interpretation. And if and when any charges get dismissed, they consider it a "win" in court. It's infuriating and a huge waste of the court's time.

    It's really admirable how these judges still have the patience to explain things. I would probably be so fed up that I would simply had told them that they should have consulted with a lawyer beforehand, and continued with the process, only addressing relevant questions and telling them if they bring up any bs that it's irrelevant and move on

      Insufficient education might play a role. Not one of them has ever actually read the constitution or any of the laws and cases they love to cite. They feel overwhelmed by life and this bs gives them the illusion they can decide some things in their life and blame the rest on someone else.
      They can decide. It is just that simple: If you want to benefit from society you have play by the rules this society has set for themselves to protect their own. You can't just cherry pick whatever fits you best and ignore the rest. That is not how society works. It is not how life works.
      If you want to change the society you live in - engage in it. Or go somewhere else.

    I had a boss like this guy. He would ask a question, if he didn't like the answer he would ask it again and again over and over. I would would always say, my answer hasn't changed since the last time you asked me this a minute ago. There should be a reset button on people like this.
