    Lots of people are married, lots of people breakup, question crops up.
    “What happens to the house? The house is only in my husband's name or the house is only in my wife's name. What can I do a about it? Does she get the whole house if we split up?”
    Well the subject is extremely complicated and it really depends on a whole variety of different factors as to who gets the house. What it's worth, how much mortgage on it, how many children have you got, how old are the children and so on and so forth.
    What I can tell you is that the house is not in joint names but it's the matrimonial home. The person whose name is not on the house deed has just as much financial entitlement to it as if it's in joint names.
    The beauty of course of not having your names on the title deeds is but that, not only that you have the same financial interest in the property as if it was in your names, it also means you've got no liability for the mortgage so if the house is just in your spouse's name don't worry too much about having to put your name on it, there is not much benefit if any, and I don't think you would benefit but just a awful lot of burden.
    What you might want to do is actually stake your claim on the matrimonial home and that's easily done; you just put a matrimonial home right notice on the property which is a little notice that warns anyone who is going to mortgage or buy the house or re-mortgage, it warns them the spouse is hanging around somewhere in the background and the beauty of the matrimonial home is that it's free; it protects the interest of the non-owing spouse without giving the running liability for the mortgage.
