      Law firms like to use templates when creating filings. In this case someone chose to use an inappropriate template, and failed to proofread. There have been cases when firms have blamed victims for being attacked ("Victim knew or should have known she could be raped on premises") and have it blow up in their faces. Someone was stupidly sloppy. And I hope American pays dearly for it.

      ​@@lumer2bThere's a concept called, "mitigation of damages." If you know you are being harmed or could be harmed, the law expects you to take reasonable steps to minimize that harm. Since there is an insuance company involved and there was something noticable (which is how the employee got caught), that argument is pretty much expected unless insurance decided to concede that argument. The plaintiff's lawyer could have made that argument backfire spectacularly in court as well. Most likely, the lawyer included that argument to protect against malpractice claims.

      It's almost certainly their insurance company making them fight it because it's their insurance company that will be paying. Plus, insurance almost always want to raise a, "mitigation of damages," defense if there was anything that could have been noticed (as the light from the camera is what eventually resulted in the employee getting caught).
      I know of a few schools (both public and private) where the school discovered a teacher was abusing (or worse) a student or students, and reported it to law enforcement. Then, their insurance companys forced them to fight the inevitable lawsuits rather than settle despite the school officials wanting justice to be done for the victims.

      The light was visible, which is how the perpetrator got caught.
      I don't blame the defense lawyer for raising that argument due to the concept of, "mitigation of damages." Given that insurance companies have a huge stake in this case, not raising that argument (unless explicitly told by the insurance company not to raise that argument) would open the lawyer up to a malpractice suit. At the same time, I expect that argument would have backfired spectacularly in court. The plaintiff's lawyer gave AA a gift by going to the press, as they redacted that part of their legal response.

      It's impossible to investigate thousands of employees and thousands of flights every day...a few bad incidents doesn't mean anything. There's no way to prevent everything from happening without doubling the price of a ticket.

    This is the new 'normal'. Nothing is ever the 'authorities' fault. Blame the victim, or give them the standard: 'what's the harm?' Anyone going into an American Airlines bathroom should just assume they are going to be recorded or don't go in? Do we have to search the bathroom when we get in there?       @@kenbob1071when you get sued like this as a large business with insurance, your insurance company retains counsel and runs the show. How do I know? I've sued a professional, aka his insurance company, and fought with them for a decade. He even wanted to settle, but they wouldn't do it and dragged it on. Insurance companies are the absolute worst. I actually believe AA here because I've seen how ridiculous insurance companies can be.

    This is disturbing on so many levels. American Airlines f'ed up, and so did the insurance company who hired an attorney that blamed a child. My kids wouldn't have known, but I'm sure the cops would've been arresting me the day my kid found the phone, so different situation.

    To be fair, the attorneys work for the insurance company that provides the airline's liability insurance, not the airline. So there's no incentive to take the airline's best interest into consideration as their job is to minimize insurance payouts.
