POLICE OFFICERS FRAUDULENT TICKETS : The ticket/citation does not conform and is inconsistent with the constitution and supreme court rulings and also does not follow courts civil or criminal procedures. The Judge says the ticket/citation is a summons & complaint ? Is It Really… Nope, anybody can beat these unlawful, unconstitutional tickets!!! 1) Probable Cause ; The police officer must have articulable probable cause before detaining of anyone !!! Understanding of probable cause: The police officer must have and be able to articulate probable cause that, A) You have harmed/damaged a person or property. B) The police officer has a witness, of you committing a crime. C) The police officer witnessed you committing or about to commit a crime. D) Has a warrant for your arrest. Without probable cause before the stop, the ticket/citation is unconstitutional. 2) Proper Complaint ; For a proper complaint. The injured party (plaintiff ) (he/she) (living soul) must have created and signed an affidavit, aka (sworn complaint) that has a judicial (branch) officer signature with a embroidered seal (stamp) (notarized). Where is the plaintiff and judicial officers signature and stamp? Not on the ticket! 3) Charging instrument ; The sworn complaint becomes the charging instrument when submitted into the court by the plaintiff (living soul) or by a representative (prosecutor) with a court received stamp “Filed“ with case #. If there is no charging instrument submitted by the plaintiff (living soul) then there can be no summons issued and there is no case for the court to be tried. No stamp “Filed” on the ticket! 4) Proper Summons ; A proper summons comes after the complaint is filed into the court, then the Court can create the date/time and the instrument (summons) to bring you into court. The summons is a separate document from the complaint and requires hand written signature of a dually appointed judicial officer, aka (judge) or (head court clerk) of that court. Where is the summons judicial officers signature on the ticket? 5) Separation of Powers Act ; When the issuing (ticketing) police officer gives you a ticket/citation and shows (tells) you the date too appear in court by his/her own accord, the police officer is in violation of the separation of powers act. The police officer power is from the executive branch, the officer has no judicial powers to create the instrument for a court date & summons for anyone to come into court, only the government judicial branch officer aka Judge or head court clerk of that court can set the time/date and create the instrument (summons), thus ticket/citation is unconstitutional and null & void. 6) Damaged Party ; Who is the damaged party (a living soul)? The plaintiff being the (state of) or (city of) or (county of) is not a living soul. Must be a living flesh/blood soul. 7) Legal Right ; A ticket/citation does not indicate, a violation of a legal right. 8) The police officer is committing perjury ; When the police officer sworn on the ticket and or (incident report), and or in court that you committed a crime/felony and or violation against a fictional plaintiff that is NOT a living flesh/blood soul. a) Violation = Injury, Infringement, Breach of right, Duty, and or Law (Blacks law). b) Crime = A crime is damage to person or property or police witnessed a felony. “Sherar v. Cullen 481 F 945 (1973) ” c) A “Code’ or Statute’ is not a Law,” “(Flournoy v. First Nat. Bank of Shreveport, 197 La. 1067, 3 So.2d 244, 248)” When a police officer sworn that you committed a crime/violation on paper or in court and there is no real damaged party (living soul) the officer just committed perjury, which is a class 4 felony. Also is a violation of the police officers Oath of Office (Breach of officers contract to the people) and also is WARRING AGAINST THE CONSTITUTION (TREASON). Summary: The ticket/citation is really, a Sworn Witness Report by the Police Officer.
This video is the second greatest reason after all the extra judicial killings to abolish the police. This is an embarrassment to society and we should burn all evidence of this ever existing.
