  • Members of retirement funds give some of their retirement savings away when they get divorced. This is allowed for under the Divorce Act and the Pension Funds Act. The Divorce Act says that if you are married in community of property, your "pension interest" in a retirement fund will be considered to be part of your assets to determine what the parties to a divorce action may be entitled to.     My ex-husband took everything and the pension funds department knew we were divorced, I got nothing, my ex does not even care about the high Court order and no one is dg anything , this law ony works for South Africans Nationals .

      Im going through the same situation my sister .the court insisted that I must get 50%thats really unfair but I'm gonna fight
