As someone who works in disability law this is an embarrassment. This is not advocacy. Weaponizing the ADA only undermines the legitimate claims that people have.

We had this same problem out here in California, they target Mom and Pop stores and business's knowing they will settle out of court because they don''t have the money for lawyers, well some got together and sued the group and won afterwards the group leader was arrested for making false law suites and spend a few years in prison for extortion. It's time to update the ADA law and include a reasonable amount of time for the affected business to make repairs _before_ it can be sued. This should reduce the number of ADA "nuisance" lawsuits and still get the changes made.
its not the ADA its the state laws which allow for monetary damage awards. ADA only awards attorney fees by default, making it not lucrative for any plaintiff unless it's a plaintiff-lawyer who brought the action.

Agreed, had they sent a warning first that they're going to sue unless they fix it up first it would have been a completely different story. Then they'd actually try to better the community without the witch hunt, and not go after businesses money for at least trying to keep it up to par. Going after them for the money alone without a warning first seems to me as abuse.

I really don't like that bull with the van signs. Grocery store in town had a bunch of van only signs put up on all of the handicap spots because of a law change limiting space marked like that to only vans. Now there are a lot of people who can no longer use handicap spaces and some of them really need it despite not having a van. Like my grandfather has his motorized wheelchair on the back of his truck and now he can't use the handicapped spaces.
Incorrect. Most individuals like myself who are disabled do put complaints in and never see any change. Most complaints about accessibility are because of fat able bodied people taking our parking spots or there are legit spots throughout the city that aren’t accessible.
Side note: there are individuals in my community that have jobs specifically to help people with disabilities to get around in lifer with less complications so we can have a somewhat normal life.
Before speaking your opinion make sure your opinion has been thoroughly thought out.
Then what’s the problem with warning first like the other guy said before you sue. Didn’t you see the whole story? The group that was suing other companies wasn’t even in compliance themselves. If that’s not the definition of “calling the kettle black” then I don’t know what is. If your going to advocate for people with disabilities, you better make sure you are the SHINING LIGHT of disability compliance. Do you agree?

As a disabled person the only problem I have with a handicapped parking space is when an able bodied person takes it. This is ridiculous

Can't tell you how many times I've needed to use the bathroom only to find someone in the handicapped one and all the other stalls empty. The thing that really makes me laugh though is they almost ALL say the same thing - they were all full when I came in. Uh huh lol
Also disabled and agree that this stinks. These people getting sued are putting those spaces in and should not be sued for small errors that may have been made. This makes anti-ada people happy as eventually many states will refuse to comply as they have a reasonable fear they will be sued either way.
What. Peeves me as a disabled person is the lack of HC spaces. There should be more spaces than the standard average required
100% agree. I am handicapped, but I am more able than most. So it really burns me when I don’t use available handicapped spot so someone else more disabled can use it, only to have someone who clearly doesn’t need it park there anyway.
Actually had a women tell me that it was my fault. I was using up the good spots allocated for people like her, so she’s just making things right.

@el bandido jefe exactly. I sometimes even park at the far end of the parking lot just for the walk. I have a cane and it may take awhile but even handicapped people need exercise sometimes. I have my good and bad days so I don’t use the closer spaces often. But it still pisses me off when I see someone use those spot but don’t need it. I just don’t understand why they feel it’s was ok.

A number of years ago, in San Luis Obispo County (Ca), there was a guy that would go around to various restaurants, go into the restrooms and claim to "injure himself" on the ADA bars. He would then contact his "Attorney" (more likely a co-conspirator) and file an ADA suit. After about three of these suits, the Judge declared him to be a "vexatious litigant" and barred him from filing lawsuits. His "Attorney" was dis-barred and he slinked away, back to his sewer

These groups prowl cities all over the country. They look for the smallest discrepancies in ADA compliance and sue small businesses, driving many of them out of business. I am all for ADA compliance, but that is not what these people are about.

It would be one thing if what they did caused changes and took ZERO monetary benefit. To threaten a lawsuit unless you “settle” is called extortion.
Um no. Extortion is to threaten financially, with nude photos, locked computer malware, etc. A lawsuit implies you have already broken the law and the plaintiff must resort to the court for redress.
A lawsuit is a very expensive procedure, for me to be compensated for my loss and since "you" were at fault and refused to compensate until I had the court PROVE your fault, those costs are your burden. It is reasonable and prudent for the plaintiff to offer to settle.
Finally, look at circumstances. In nearly every case, litigants pay the much lower costs to come into compliance, than the cost to settle. AID itself can't bring itself into compliance, cannot bear to be scrutinized publicly without hurling MAGA like insults at the local media outlet, cannot pay their field agents enough for adequate clothing and surveillance. AID is barely staying afloat.
Like when the DA offers a plea bargain to lesser charges? Even when you're innocent of the charges? What do you call that?
@@krane15 we will proceed carefully, because this can get confusing. Right now, you are confusing "civil law," with "criminal law." Many of the rules above still apply, right down to being reasonable and prudent. I will elaborate.
Ok "lesser charges," is not an attempt to win a lawsuit, without going to court. Criminal law, is advocacy driven, meaning the state automatically _assumes_ guilt. This is a big mistake people make about police, it is why they say, never talk to police without representation, because police are charged with gathering evidence to support a prosecution.
When the state offers lesser charges, it is a signal that the defendant has won. It says, "the state believes, in its heart, that you are guilty, but prosecution of that charge does not serve the taxpayers interest." Therefore, the state offers a "compromise," that only fools - and railroaded people, take.

I've been disabled my whole life and I was just about to leave a comment like yours, so I appreciate that. I use a chair and getting around a lot of public places is not fun! The thing that bothers me more than that is that people like this are taking something that is meant to give the average disabled person a voice to speak up about the lack of accessibility and they are profiting off of it. You know what's going to happen? They're going to take the voice away from disabled people are there going to make it harder for us to Use it. These people, the ones that are actually doing something wrong we'll get away scot-free.

Being disabled and to get back at the fraudulent suits I would get a lawyer and sue the property they are on and see how fast they lose their office. tired of these phony lawsuits saying they are trying to help us.

If you're disabled get an attorney with slightly more scruples than theirs and then have them file an ADA compliance lawsuit against this group for not being handicapped compliant.

This is about putting money in certain people's pockets at the expense of ruining lives. The lawyer admitted that he can sue without ever going into the establishment. If they were truly concerned then a business should have a reasonable amount of time to fix issues that were NOT pointed out at the inspection prior to opening. Everyone of these should go to court and film the outcome of the judges decision with the ability to counter sue. Otherwise, 100,000 businesses will be like how LA is now, boarded up.

I worked as an adjuster for an insurance company who insured properties subject to ADA suits. In practice, the ADA statutes are written so that individuals can file suit, after suit, after suit .... making quite a good living doing so.

They (not this organization, but attorneys like him) did this in California several years ago. They would go into restauraunts and businesses posing as customers and upon finding a discrepancy, hire someone disabled to go in and complain about the discrepancy and the attorneys would sue with a caveat. PAY US $$$$ and the suit goes away. The owners pay the few thousand dollars to avoid litigation and the attorney goes to the next business. "LEGAL" EXTORTION.
