      If you haven't paid your "debt to society"; why are you out of prison. If you have, why are you still being "charged" for it? PS: Things like losing your fundamental rights over a domestic violence restraining order are a problem, because such an order can be a boilerplate part of a divorce proceeding; for the leverage it can provide. There are other examples. (and don't get me started on the "no fly" list)

    The Second Amendment says the right to bear arms "shall NOT be infringed." That means those rights cannot be taken away PERIOD.

      I find a probationary period after prison to be reasonable. Once complete, full restoration.

      Judges control the courts, and they always make sure to tell the jury to follow his instructions to the letter. Jurors don't know, and those that do would be too chicken to use nullification. Also, jurors are selected and prosecutors will do their best to weed out anyone who might use it.

    I love the two judges that voted in the positive for him. My dad who is 64 committed one felony when he was 20 and it was a non-violent offense but yet he is not allowed to carry a firearm. He has never had another charge on him since.

      if it was a state charge the laws have changed lately, and conviction of a felony is not the reason, it means if you were imprisoned for any length of time for a crime that the penalty was more than one year, so if the max penalty was 5 yrs and you spent less than a year you still come under the convicted felony statute. if you were got probation or deferred then it is not considered a final conviction.

The Privileges and Immunities Clause of Article IV, Section 2 literally protects the RIGHTS of ALL citizens from the actions of any state working to limit them. The term "privileges" does NOT refer to fundamental RIGHTS. It refers to commerce, etc

    I'm a violent felon from almost 20 years ago... Did my time and changed my life and now have 3 kids and been married for almost 20 years and own my own business... I'm not allowed to vote or protect my family for something i did as a kid! I'm being taxed without representation i paid ten k this year... Should i be allowed to get my rights back? Of course i should

    Congrats to the 2 Justices, in the 9th Circuit, who stepped up and did the Constitutional Thing! Anyone who is a "danger to society" should be in PRISON, all others, allowed around the People should be considered One of the People and have All Rights, there in. I am 100% for this. My only concern, due to the idiots in Government, is that recidivist Violent Criminals are being let out of Prison.

    NO infringements. The idea that any felon loses Inalienable rights is absurd. They came up with this to allow early release of criminals. If an individual is not ready to rejoin society, keep them locked up!

    I think this brings back the issue of people getting jacked into the system and never getting out. Today screwing up will literally put you on the hook for life, there is no do the crime do the time. It’s more like a life sentence.

      Technically speaking, whatever a prosecutor and judge agree on. There doesn't seem to be much of an established legal definition, moreso just follow-ups on previous interpretations that might often be misconstrued. It's certainly one thing about the Justice System that's been backward for a long time - No consistency.

    Why should it matter if it’s a violent felony or not? If you’ve served your time and completed all fines, probation, etc., then you should be able to get those rights back.

    I'm fighting with a police department, a county, and soon to be fighting with the New York State Police over having unregulated gun parts returned to me. They don't wanna give them back, some parts were taken in a warrantless search of my home that the ATF participated in, and I was charged with a crime that I ended up beating after I sat in jail for a while on it. I'm right at the point where I'm about to file federally on this.

      @@cdebo822 I still have my rights, but I think it would be pretty easy for an opposing attorney to make a convincing argument that I am not of "good moral character", so I'm not really sure I'd even want to put GOA in the position of trying to fight for me. I got a small claims case pending right now over what was taken in the warrantless search, and I found out what I gotta do to get my stuff back, I just gotta file a form for the DA to approve, which they should, I mean, they were the ones who dropped my case to begin with, so I see no logical argument that they could make as to why I shouldn't get my stuff back. After I make a little more progress, I might contact GOA, but first I gotta see what the government's response is to my lawsuit after I file.

    EVERYONE should read MY story.....1989 I was the maintenance supervisor at a motel, I was in uniform on the private property of said motel and I had my then 3yr old Daughter with me because her mom was very ill.....a local Leo drove onto the property Without a call for service, he stopped and walked to me, threw me down and cuffed me....I was Given a Small dbl edged knife by a salesman and had it in a sheath on my toolbelt....I was arrested for CCW...carrying a concealed weapon and held 37 days
    Without bond, missing Halloween and Thanksgiving with my family...in court and by advice of a Lousy public defender, I was told that IF I wanted to go home before late February...I had to plead guilty and take the Felony which unfortunately I did.....
    Should I be a Felon for Life ??...shouldn't I have my 2A RIGHTS BACK ????.....please comment and let me know what YOU think.

      Sounds like you were charged with something thats unconstitutional. So of course you should get your rights back because the law itself saying you can't carry a concealed weapon is unconstitutional. Now for those who commit violent crimes, break into homes, sell drugs then they forfeited their 2nd amendment right when they committed those crimes. Should their felony be lifted eventually if they haven't committed any crimes for a set period of time? yes.

      While I was never arrested ever in my life. I have known a fair amount of xfelons try very hard to come clean n live a just life. Many companies won't give them a chance to better themselves while out of prison. Not everyone in prison are quilty imho. I am saying that as a former prosecutor, n have been known by my wife cry at night aftermath of a serious charges.
      Most of society look down upon xfelons n won't give them a fair chance. Most WANT to change their ways n never wants to go back ever again. It's too bad that we allow illegal invaders enter our country illegally n enabled to receive funds n benefits for likely a lifetime. Yet we can't help our own citizens down on their luck in the United States. Probably why I never thought about running for office as I'd likely help the wrong people per se. We unfortunately have a clown n freak show at our highest offices. While being made to pay taxes to support such administration n treasonous criminal politicians.
      If you're a business owner, n a xfelon applies for a job. Why not give that individual a 2nd chance? They just might be the best employee you've ever had. I stuck my neck out numerous times trying to give folks a 2nd chance in life. While many of them succeed at their job position while moving onward towards a career path.

    I am a non violent felon. My "CRIME" was exercising my God given right to own and carry weapons in a communist state. So now, because I didn't ask government for permission to exercise a right I an no longer allowed to exercise my God given right. Am I the only one that sees the ridiculousness of this? Rights do not require permission.

      @phillipsmith21 ---almost 25 yrs ago I caught a felony possession charge for drugs. Was on probation, cops show up at my house with a warrant for my brother, his girlfriend let them in they came to my room asked for ID realized I was on probation. Searched my room found my .22 rifle which was taken apart and part stored wrapped in towel in my closet, part was wrapped in a drawer of my dresser and part was on the floor because I was sanding the butt.
      They found one very old bullet, probably 15 yrs old in a junk drawer and arrested me for the gun and ammo. I spent a county year in jail, did my probation, all other things necessary and I lost my rights to own, be near, or possess a firearm and they took my voting rights and no jury duty. After about 10 yrs I was given my voting rights and jury duty eligibility but no firearm rights.
      Oh and I'm in California where getting your gun rights restored is hard and costs minimum about $5K and still might not give your right back. You have to have the Governor sign a letter after you petition for your 2nd amendment rights to be restored.
      So I'm wondering if I have to apply to purchase a gun at a store and wait to be denied and then see if I can get a court date to fight it? Or do I have to get caught in possession of a firearm and arrested for it to be able to fight for the right to possess a firearm? It makes no sense to restore my other rights and not the firearm right when I wasn't a violent felon.

    I got in trouble as a teen for drugs, as I was struggling with some addiction issues etc. I did my time and have had an absolutely pristine record ever since. I'm now 33 years old, I contribute to my community and I have made a really good name for myself and my young family.
    I really would like to have my rights back and not be viewed as a "Criminal" for something that happened 15 years ago. It's frustrating, dehumanizing, and hopefully gets resolved.

    Can some point to "case law" as being "law" per the Constitution? Where does it say that or elude to that anywhere in the Constitution or Bill of Rights?
    Where does it say that after your "debt" to society is paid for a crime that you are still forever restricted from your Rights?
    Is any of that what the Forefathers sanctioned, intended or wrote down? 🤔

    Historically (up until the 20th century) once the offender had served their sentence, they were considered 'peaceable' once again. If an individual is too dangerous to be in society, the state has an answer for this, the penitentiary (for life without possibility of parole) or the death penalty.

    I’ve always said that if we expect people to enter back into society and telling them they’ve paid their debt to society they should have all the same rights as everyone else. If we don’t then we are ostracizing them essentially treating them as lesser citizens. The only time I’m ok with this is for violent felons and still it’s questionable you could get in a fight defending yourself or family and get screwed and end up a felon or something so there’s times where each case should be reviewed.

    In my mid 20's I got four dui's, no one was ever hurt. However I remember clear as day when I was sentenced and the judge explaining to me, while he himself wore a ankle monitor for his excessive drinking habits, that I am going to lose my right's to bear arm's as a convicted felon. Ever since that day, and though I've served my time in full with no fines pending. Till this day, I'm refused and essentially laughed at. At 42, I've been nothing but a productive citizen in society, a father, husband that provides daily for my family. Yet just because I have a "F" on my record I have zero chances of owning a gun. My past happened in California. I now live in Florida and it amazes me that even a "red state" doesn't believe in second chances. So I hope to lord ol mighty that the supreme court look's at this and makes it law. 🤞🏽

    That is correct. The 2nd amendment has no provision for the removing of the right to bear arms. If they are too dangerous to exercise their rights, they are too dangerous to be let out of jail

      Ehh I know plenty of people who have been incarcerated, the overwhelming majority hold no ill will towards the government, courts, or police that arrested them. They understand they did dumb stuff&paid for it. I’ve noticed that a lot more than I thought would be the case. Many people are convicted for victimless crimes&aren’t the stereotypical “criminal”. Everyday people, veterans, highly respectable people of the community; the ones who are upset at everyone but themselves for being convicted or arrested are usually pretty easy to pick out.

    I'm currently going through the charge of possession of a firearm by certain persons 10 years after my previous conviction of paraphernalia and if convicted I will be appealing to the 6th district out of Ft. Smith AR under the Bruen decision

    It has often been the case that "we've been doing it this way" and "if you rule against this law, other - similarly unconstitutional - law will be in jeopardy" are used as excuses why the court shouldn't find unconstitutional practices to be unconstitutional.

    All the guy had to do was not identify to the police because cops can ask a passenger's for ID all day but they can't legally demand ID unless they suspect the passenger of a crime

    Oath-breakers deserve to be held accountable just like those who brake the law. As soon as your sentence is completed all your rights should be restored. Or else what's the point of even taking the oath in the first place? Hypocrisy! My offense was considered violent because someone was injured during citizens arrest. I wasn't sent to prison. If I was such a dangerous person why didn't I go to prison? But I lost my rights when I was 22. I just turned 40 yesterday.

    So why not say how we get our rights back. What do we do just go out and buy a gun and see if they come and arrest me? I'm a law abiding citizen, have been since 1996 and have been abiding by all laws. Do I have to ask the state to get them back?

    18 years ago, I plead guilty to a conspiracy charge. I was terrified at the time because I was assured by the federal prosecutors that I would never win against them because they could outlast any money I had for legal defense. I've never been in trouble before, or after I served the sentence/probation, but federal convictions can't be expunged. I grew up with guns and love the hobby. It kills me that I can't plink with my two boys in the back yard because I'm deemed a terrible person by the government, who would be the ultimate threat to the world if armed with a 10/22 at my home. This gives me hope. Thank you for covering this case, Jared. 🤜🏼🤛🏼

    I cannot find a historical situation where any one that once was a felon was denied their rights until around 1900. This is a recent development and therefore should be null and void. If they are too dangerous to have a firearm, then why are they out of prison?

      Because they served their time appointed to them by the judge. What is given up must be earned back they need to show they can be a law abiding citizen in society before their felony is lifted. Rights can't be taken away they can only be forfeited.

    I am glad to see these Unconstitutional laws being chipped away Jarred. Driver’s licenses are called a privilege, but if you get a DUI and loose the privilege of driving it’s not a life time ban in most cases if any.

    💭🤔 I had been charged with a misdemeanor in a self-defense case where the perpetrator came to my home I was sentenced to 18 months. The judge also threaten me and promised me during release of my personality that I would definitely do time for this situation the perpetrator also was caught in a lie by the judge on two different occasionsand was let go because the judge hated me more. It has been over 15 years. I have had no previous arrest. I have broke absolutely no laws do I lose my second amendment rights.

    I had a friend who is now deseased, that got a Felony DUI. It was his 2nd DUI in 9 years, so Illinois made it a Felony. The State stripped him of his FOID card and his hunting license upon conviction, even though he was allowed to serve his 6 month sentence on weekends so he could continue to work through the week to pay his $10,000 fine. AND, as soon as his fine was paid and his time was served they gave him back his Commercial Driver's License but, NOT his Right to own a Firearm.

    There s a long standing and wide spread legal tradition of not only allowing felons to be restored to their 2A Rights, many States had laws requirung that the released felon be given a $20 gold piece, a horse and more importantly a firearm. Even former Confederate soldiers were allowed to bear arms following the South's surrender; and they had been in open rebellion

    People are released from prison and often required to live in neighborhoods where they may very well need to protect themselves and their families. If they cannot be trusted with a firearm they should not be released from prison.

    I was an active duty Marine who prosecuted by the state of PA instead of facing UCMJ and then 7 years later I had a gf who accused me of rape then admitted to the DA that she lied because she wanted to teach me a lesson. I'd love to share my testimony

    I agree wholeheartedly…I’m a non violent felon and I caught that charge more than 10 years ago….with all the craziness happening in the world today I’d love to get me a gun for self defense but because of the felony I cannot….but this gives me hope that I will be able to own one eventually without the worry of police or ATF knocking on my door after I procure one….they need to fix the law sooner rather than later!

    I have a 21 year old second degree assault and I can never protect myself or my family or hunt with my son 21! Years and it haunts me and my family suffers from my choice to drink and fight but I haven’t been in trouble what so ever I work and pay taxes but here I am still considered a threat to society

    I'm a felon and I work with a white non felon in a secluded area.... He often brandishes his weapon and says that he can kill me and I can't do anything about it and that nobody would care if he did because I'm a black felon.....this isn't fair... i would never do anyone like that and I'm a felon but this non felonious person threatens people daily and is very reckless with his firearm ....these laws need to be changed because if I defend myself with a firearm i could possibly go to jail for life
    Meanwhile he's always showing his uscca card and brags about the fact that he can kill anyone he wants......we are in Florida if context is needed
