I appreciated the pretty sterile review of the law and opinions. Exactly what I was looking for when searching for a lawyer perspective on this (not news).
Thanks for the explanation. But one thing was left out .. the definition of 'insurrection'. From what I've heard, a 2 year old throwing a fit in the grocery store qualifies as an insurrection.
This is the exact text which the court defined insurrection as: “an insurrection as used in Section Three is (1) a public use of force or threat of force (2) by a group of people (3) to hinder or prevent execution of the Constitution of the United States." So, no, your child being a brat does not qualify.
@garythecyclingnerd6219 Great. Ok, there's no such court called THE court. U.S. Supreme Court ? Even then, justices' 'opinions' differ. And the U.S. Supreme Court can overturn itself. A group of people who try to prevent the execution of the Constitution. That's good. How about when everyones' gold coin was confiscated by the federal government, or be subject to one year in jail and a fine of 500 oz. of gold. In the Constitution, it says that only precious metal is U.S. money. I can list 100's more examples .. A group trying to prevent execution of the U.S. Constitution .. Well, anyone denied free speech is being prevented from executing the U.S. Constitution. The right to keep silent falls under free speech, too, according to the U.S. Supreme Court. That means that when the IRS wants a tax form mailed to them, we have the Constitutional right not to. There are two blatant examples of how people working within the U.S. government have ACTUALLY prevented the execution of the U.S. Constitution.
What of it? Did not the court challenge go through the proper legal means? The amendment does not state you must be convicted of insurrection to be disqualified.
@@garythecyclingnerd6219 So the media can just make something up about a person and courts can use that to take away their rights without due process? Sounds awesome. Including political questions? Now turn off your tds and think about the ramifications of that.
@@royburnacoven3559 Evidently you did not read the opinion. This is not about the media, this is about what Trump said and his actions up to and on Jan 6. In the sections of the opinion titled "Insurrection" and "Engaged In", the Colorado Court defined insurrection and details the undisputed things Trump did which, in their opinion, constitute and insurrection. They also state both that the amendment is applicable and self-executing. Again, the amendment does not say you must be convicted of it. This "due process" claim is literal nonsense.
@@garythecyclingnerd6219 Both the FBI and the Congress of the United States of America said there was no crime. These judges have disenfranchised millions of voters without any due process as their ruling clearly ignored many facts of January 6th and used biased information in their partisan ruling. He sounds gay.

It is so political, and they did it to help Trump in the polls.🙃

Let the people decide ..
The people are stupid.
The US supreme court isn’t political. Let’s respect their decision.
Innocent until proven guilty. Trial by jury of one’s peers.
Section 14 does not state one must be convicted of insurrection for the amendment to apply.
