Creating a 2.5D game as opposed to a full 3D game helps manage resources while still maintaining a detailed visual style. Sticking to classic 2D gameplay that's familiar to most gamers lends well to handhelds even if it has the graphic prowess to do more. This reminds me of SHADOW COMPLEX which I'm all for. Will pick this up.
It could. I think it's kinda hard for some developers to make 3D perspective games for the 3DS, because only a few games used that concept so far. If you take "3/4 of the graphical power" from Resident Evil Revelations (because games with large maps couldn't be rendered so well/fast in 3D with those graphics) and mix with Monster Hunter TriG and Metal Gear Solid 3D's free perspective gameplay styles, you could actually run a port of Batman Arkham Asylum w/ simpler graphics on a 3DS, for example.
This feels like Arkham Asylum, but instead in a prison instead of an insane asylum. And also Batman has to acquire gadgets as he progresses like in AA.
For those who don't get it, this game IS an open world game, it's just done in a metroidvania style. You can effectively explore and wander as much as you like but in a pacing more akin to that of Nintendo's Metroid series. It's not "boring" it's just more exploration and less fighting.

They make the same game for 3DS and Vita, same scenario in PS3, X360 and PC, that's why there are no significative differences between versions. If there would be an exclusive Batman for Vita, it would be a very different history.

Joker reference first and foremost, Nolan wrote a character that already existed into the movie and then Heath played him, they did not create that version of the Joker

Maybe, but everybody prefers 3D camera. And Castle-crashers or deadlight can't be used as a comparator for Batman.

Dude, some really good recent games have been sidescrollers. Castle-crashers, Deadlight. It's still a really practical and potentially fun style.
