The landlords on the place of course they can set the heating limits if the landlords are the ones paying for it. If it's part of the rent you're right they cannot. In this case the landlord was paying for it so he has the absolute right to set the heating limit
Oh yes they can. Most leases have a waste of utilities clause and most states have a minimum temp requirement and a landlord doesn't have to go above it. If you live in a cheap building then the landlord will limit the heat. Want more? Go buy a space heater pay for it yourself. But 64 seems unreasonable. That land lord needs to fix the drafts.

As a landlord, I usually hold a portion of the deposit around half of the time. It takes a long time & it's expensive to get a unit ready for a new tenant. Normal wear & tear is expected but I've had people who let water leak, causing damage, pets move in without allowance, holes in the walls, etc. People can be very disrespectful when they don't own it.

I always paint top to bottom, shampoo carpet, and clean so most things get taken care of anyway. So unless there's something disrespectful, they'll always get their deposit back. I'll do the walkout with the people too, so they know what is happening. We do a walkthrough when they get the keys & then one when they move out.
Since I no longer allow Section 8, I have much better tenants and I now ask my tenants how much of their deposit they want back after doing a walk through with them.. It's amazing how different things are when you have a good relationship with them.. I often give them more back than they ask for...

By law, the landlord has to re paint after each tenant. We all know they don't. But it's legally not up to the tenant. So yes, he was being a nice guy.

As a landlord good tenants are very hard to find. The landlord has a responsibility to create a lease that reads clearly the terms and conditions. Regardless, as a landlord I've experienced having good and bad tenants. All I can say is, do not call them good tenants until they move out. People don't show their true colors until move out. Even though the case had confusing documents which ultimately favored the plaintiffs, how can a reasonable landlord really expect the tenants to keep the thermostat set at 65 degrees in winter in New York, then move the thermostat out into the hall so the tenant has no access? In many cities there are laws which say the minimum and maximum temperatures of rentals must be. It is a health risk especially for elderly, disabled and children occupants. I believe the landlord said the plaintiff had a young child visiting there. Cheapskate landlord!!!!! (Bet his apartment wasn't at 65 degrees)>

Since I no longer allow Section 8, I have much better tenants and I now ask my tenants how much of their deposit they want back after doing a walk through with them.. It's amazing how different things are when you have a good relationship with them.. I often give them more back than they ask for...

I don't get why people find it so hard to understand that they need to be out by the end of their lease..... out and clean and fix whatever. And I don't blame the judge for saying she's going to blow her brains out..... the plaintiff seems to think that someone else has to clean the apartment after he leaves.

in Canada, the heat must be a minimum of 68 F all year round. 64F and the landlord would be in trouble.
I believe 68 is also the law in the US.
I think Judge Milian is losing it lately. The tenant admitted he was cleaning on the 4th. She said the 3rd was absolutely the last date she could stretch it to. He was clearly there after the end of the lease. As for the exit when he said his kids could have written a better contract with a crayon - that makes him sound like an idiot for signing it.

By law, the landlord has to re paint after each tenant. We all know they don't. But it's legally not up to the tenant. So yes, he was being a nice guy.

Had a “Palestinian” landlord.. loved the guy. Don’t prejudge .. he did complain about water usage.. but we talked about family and he was a really great guy. Family was amazing.. If he ever thought I did anything wrong I always listened and compromised..

As a landlord good tenants are very hard to find. The landlord has a responsibility to create a lease that reads clearly the terms and conditions. Regardless, as a landlord I've experienced having good and bad tenants. All I can say is, do not call them good tenants until they move out. People don't show their true colors until move out. Tenants dont like owning their damages.

Even though the case had confusing documents which ultimately favored the plaintiffs, how can a reasonable landlord really expect the tenants to keep the thermostat set at 65 degrees in winter in New York, then move the thermostat out into the hall so the tenant has no access? In many cities there are laws which say the minimum and maximum temperatures of rentals must be. It is a health risk especially for elderly, disabled and children occupants. I believe the landlord said the plaintiff had a young child visiting there. Cheapskate landlord!!!!! (Bet his apartment wasn't at 65 degrees)>
