      @@sheap3871 it is not. When you are not in your home then it is not an invasion of your privacy. People assume that no one can take pictures of you out and about but that is not true. Your privacy is within the 4 walls of your home.

      I understand what you're saying as I was in that boat with a couple jobs myself but she was only working part time of such and such hours or so since they've never stated she went full time at the job and if the pay was around $540/wk. I'm pretty sure she must've had something else going on that helped her afford living so she wouldn't have had to work the 2 years there. Because if that pay was what she was getting weekly at the end and it was increasing over time that means it was less near the start and all. As soon as it started happening she should've been looking for another job and then when she found one hand in her two week's notice. That's how I was raised. You don't like the job start searching for another while you're working there and when you find and get another then you're free of that terrible job you're at.

      Usually I feel like I wouldn't believe someone when it comes to getting more money from employers and maybe the harassment wasn't as bad. But I do think there was some harassment and this guy was so wrong. Also about them not sure if she got paid that s bull

    At the very end when his daughter said 'this has been very embarrassing..' I thought she was referring to her father, but how shocking to hear she was talking about the plaintiff. That daughter should be ashamed of herself for defending her pervert father...

    99 percent of the time I agree with Judge Milian, but this case makes me so upset. This is definitely a hostile work environment. If he didn’t even think to not comment on her rear end in his answer to a JUDGE, what makes you think there was any restraint in person with no witnesses.

      It is a shame. I have seen women being sexually harassed at work and nothing is done about it. The only time HR got involved was when an employee was fired because she said no. I think if this happened to this lady then the judge would have sided with her. UNLESS, this is not a civil case but a criminal case.

    The judge picking apart her sexual harassment claim... Even though her employer has remarked about her weight gain and sent inappropriate pictures. Im sure the judge will not rule in her favor for the entire amount.

    Victim shaming! The judge seriously asked why the plaintiff didn’t tell him to pick it up the piece of paper? Perhaps because it was her boss and she did not want to get fired? 🤷🏾‍♀️ Then the judge question the plaintiff as to why she waited so long to file a claim of sexual harassment? Perhaps because she needed her income and had a fractured hand that may have prevented her from working anywhere else?🤷🏾‍♀️ This case was an EXCELLENT example of how not to treat a victim of sexual harassment. Makes me even sicker that the judge is a female.

      I think she should have been awarded a small fee for having to work in a hostile work environment. The judge could have said, this isn't 'sexual harassment', but it's just not right to treat an employee like this.

      no he wasnt up to anything . the guy simply grew up in a totally different era where stuff like that in the workplace was common and she did too as a matter of fact because she is not young either . she appears to have been a young woman in the 1970s where sexual harassment was a typical day at the office and nobody made a big deal about it like all the woke social justice warriors do today and our whole society is breaking down with a young generation that does not even know what gender they are for f**k sake .

Yes she should have quit but I've been in that situation and worked till I couldn't stand it anymore at that job. Don't give excuses for bad actions. He wasn't born a caveman. He knew better.

      He wasn’t there for the harassment. The case was about her commission. She did cuss him out about commenting on the lady’s body but she couldn’t penalize him because that’s not what the suit is about. Logic over emotions.

    If he feels comfortable to comment on someone’s rear-end and admit to that in court, imagine what he said and how he acted in the office?? I 100% believe the plaintiff.     The senior guy did sexually harass the employee..he would have been fired on the emails alone..only issue is most federal and state statutes apply to companies with more than 50 or so employees..but she was sexually harassed..toxic work environment..she needed an attorney

    I think she proved sexual harassment. Even the judge felt it was inappropriate and it was persistent. Lots of people say why didn't you do this but the fact is that he knew she was in desperate straights and couldn't easily find another source of income and used it too...I don't want to say coerce her into something but how else can you look at.

    This plaintiff was very clearly sexually harassed and the defendant even admitted to actions that would be a legally hostile environment. This was an incredibly bad judgement. Judge Milian seems to almost always call these incorrectly but I know she probably has little to no experience in employment law. It was pervasive harassment.

      The problem is that this is civil court for sexual harassment you have to go to criminal court. So the best thing she can do is keep it for record.

      Sexual harassment cases have a tricky process. First, you have to tell the offending person their behavior is creating a toxic workplace. She kind of did that with the emails from his friend, but they weren't sent directly to her from her boss. The other incidents she never said anything about. Also, you have to submit a sexual harassment claim to a government agency like the EEOC. They will conduct an investigation and if they find a legitimate claim, they issue a notice to the victim that allows them to sue for sexual harassment. That didn't happen here, and doesn't happen in most cases. This is one of those cases that feels clean-cut but the law lags behind common sense.

    Oh, I feel so bad for the plaintiff. I'm sure it was tough for her to quit her job, but I wish she had walked away from that horrible Jerk and job much, much earlier.
    What she needed was belief in herself, and someone to tell her to believe in herself. She was afraid that no one would hire her because of her hand injury so she just sucked it up week after week for a paycheck. I'm sure she would've been able to get another job if she had left.

    “Grievous or persistent,”. It was both! It absolutely was sexual harrasment. She was in a position where she could not afford to make money, and he consistently verbally and physically violated her boundaries.
    This is much bigger than small claims court and I hope she can take this somewhere else.

    Milian chastised the defendant for victim blaming, but she did the same thing by saying the plaintiff stayed so she couldn't have been that miserable. It's obvious that the defendant is a creep who took advantage of a person who needed the money, and had no other good options. The plaintiff got harrassed and ripped off by her boss, for the same reason she was railroaded by Milian; she's not very good at sticking up for herself.

      She wasn’t “railroaded”. JM is a judge and she’s pointing out something completely obvious. How do you take sexual harassment for 2 years? I mean, she couldn’t find another job? I would haul a$$ and find another job immediately to avoid that abuse. It’s not victim blaming, it’s pointing out the lack of care and responsibility that we owe ourselves, that she did not give herself. That a lot of us don’t seem to give ourselves, especially as women. I agree she doesn’t seem like she can defend herself. That guy and his daughter are scum. And people like them are a dime a dozen. But how do we protect ourselves if we can’t even fight for ourselves first?

      @@ChasRiaStJohn The huge mistake that you and Milian are making is assuming that everybody behaves as you would. Just like how staying in an abusive relationship doesn't mean a woman is happy with her marriage, people accept workplace harassment and abuse for a number of reasons related to desperation, financial hardships, and a poor sense of self-worth. But the abuser or harasser - who has purposely preyed on a vulnerable person - shouldn't get to benefit off of those circumstances.
      This woman entered that job believing she didn't have a lot of options because she had been out of the work force for too long, she invested a lot of time and money into the position making it harder to walk away from, she had a severe injury while she was there that required several surgeries and physio (all of which is expensive), and an illness that needed to be managed with medication (another expense), and being berated and denigrated by her boss on a regular basis likely chipped away at her already not so great self esteem. So it's kind of irrelevant what the average person would do, if the plaintiff had a mindset and circumstances that were worse than that of the average person.

      She needs some assertiveness training. Her voice is very soft and tentative. She needs to stand up straight, look you in the eye, and make firm declarative statements. T hat doesn't in any way excuse the creep. He deserved to have his butt kicked. But she will remain a target for bullying behavior unless she learns to assert herself firmly and directly. I was grabbed by the breast in the company parking lot by a pervert from another country who was working with us. I decked him - knocked him down, broke his nose - in one hard punch. He never bothered any of us women again.

    I work in a restaurant and must say that I have so many older men that believe this is ok. They constantly harass waitresses everywhere they go and think it's cute or funny. Just disgusting that they believe because they are past a certain age that they can act inappropriate.

    This is probably the first time judge Milian IMHO was totally wrong. This lady had some guts coming in front of a room full of strangers opening up about a very sensitive and personal issue. I think the defendant was nothing but a dirty old man and I'm shocked the judge didn't see that! This one dropped my opinion of the judge down a notch to be sure. Sorry judge but you ef'd this one up.

      Everything but the pictures was he said / she said. Statements made in testimony do not equal proof. The guy is a creep, but like others have said, you need to get outside agencies or documented evidence for a judge to rule in your favor

      This case is more reason to open your mouth and say something. Not show up for work for two years then try to prove it. Self advocacy is key. Dont tolerate bs. I’ll never understand allowing someone to make you uncomfortable. Even when my job was on the line I made it clear I will not tolerate disrespect

    This case was so sad, I feel so much sorry for her. At my place of employment this is grounds for dismissal, unacceptable behavior. Judge Milian was so wrong. This wasn't only sexual harassment but also hostile work environment.

    I work in HR and this case is definitely sexual harassment. Just the emails alone qualify as a sexual harassment/hostile work environment case. Everything else was additional layers. The plaintiff didn't get into the details of each incident and was timid about saying on national TV, but she definitely has a case and I'm surprised at the judge.

      Wow, you are the third fellow HR professional I have seen in these comments. I've disagreed with the judge on many occasions, but this case resonates with me more strongly than others because as an HR professional I probably have more knowledge of employment law than she does as that is not her area of expertise. All of us who work in HR probably have more understanding than she does.

      Yes! It's not always that simple. I was stuck at a job I couldn't afford to quit for a year and a half. I was miserable and killing myself over it, but I didn't have a choice.

      I agree. She seemed genuinely traumatized by the experience, and the defendant didn't deny a thing, and actually seemed to be getting off on hearing about it again. He was like if a character from Mad Men was alive today.

      Sad that the judge, being a woman herself, had no real empathy for this lady having to work under that creep. How easy for the judge to sit and shout "why did you keep working there" - something to that effect. As if jobs grow on trees!!
      She mostly blames and shames victims, not the shameful lecherous perpetrators.

      Judge should have punished the creepy perp for his despicable behaviour, & compensated at least 1000 dollars to the lady. THEN the creeps would think twice about commenting on rear ends etc. and stop sending foul jokes and pics on a lady's computer. He was misusing his power and taking advantage of her having to work even after 4 surgeries. She did not use her power for another hurting woman.

    Unfortunately, my father acts the same way as the defendant. My father makes raunchy jokes, and has pictures on his computer of naked women. It's uncomfortable, and I hate having to tell him to stop, because he usually gets upset.

      I think it was tough to prove sexual harassment, but she should have been awarded at minimum the 2 weeks as there was a lot of proof for hostile working environment. Probably should have given her something for punitive damages as well.

    Really amazed that this judge is essentially rolling her eyes at this woman's claims. This is so sad. I have been treated similarly at work when I was a teenager/young adult and it's heartbreaking to see her treated like she is crazy or delusional.

    The judge clearly forgot what it’s like being a normal employee. This happens far too often. And there are employers that go on power trips to make themselves feel better. If I told my boss to pick something up they would look at me crazy.

    I think the plaintiff was in an abusive relationship with her ex which set her up for the harassment by the defendant. He knew exactly what he was doing and had no remorse for what he did or said until JM rammed him for his answer to the complaint.

    He definitely sexually harassed her. And it sounds like he was a jerk in other ways too, as a boss. I can’t believe that he got away with laughing and smiling when accused of harassment and evidence being shown. Anyone who would react that way when facing a judge does not care about offending his employee or creeping her out. The fact that he brought his daughter to court with him when he knew he was being accused of sexual harassment shows just how little he cares about anyone else’s feelings. He has no shame and doesn’t even understand that he should be embarrassed.
    I hope the plaintiff reports the sexual harassment to whichever department in her state handles that. I think she could win in a lawsuit that just focuses on that. She needs to get some help with representing herself though. She is timid and doesn’t describe things very well. She needs to look for an organization that helps people with sexual harassment complaints. Even if she doesn’t win her case or if the statute of limitations has passed at least his actions would be on the record. It could possibly help a future victim of his.

    You can tell the plantiff is uncomfortable. Any unwanted touch, being photographed without knowledge, any salty remarks, inappropriate joking, can be construed as harassment. This is absolutely a harassment case!

    So, in one sentence, he said he issued her a check every Friday. However, two minutes later, he said it was direct deposited. Also, the things he did, and said to her totally qualify as sexual harassment.
