To provide some context: The President does indeed have the power of pardon. The Polish Constitution puts it as follows: "The President of the Republic shall have the power of pardon. The power of pardon may not be extended to individuals convicted by the Tribunal of State." (Article 139) However, the same Constitution also states that: "The organs of public authority shall function on the basis of, and within the limits of, the law." (Article 7) "The system of government of the Republic of Poland shall be based on the separation of and balance between the legislative, executive and judicial powers." (Article 10) "Everyone shall be presumed innocent of a charge until their guilt is determined by the final judgment of a court." (Article 42) In 2015 Duda "pardoned" Kamiński and Wąsik before there was a *final judgment* (that is, the appeal court's ruling). Effectively, he stopped the appeal from happening. This clearly went against the presumption of innocence principle and the separation of powers principle, which is why many legal experts have questioned his decision. Duda argues that the constitutional power of pardon extends to acts of "individual abolition". But... Does it? In the light of Article 7? I hardly think so.
I would add: pardon is supposed to be a form of humanitarian relief for the convicted. What Duda has done is to "remove" the punishment from the criminal, not to help him, but to allow him to take office and continue committing crimes. Of course, Kaminski has not yet been convicted of opposition surveillance, but it is already known that he is responsible for such a crime (changes in the prosecutor's office that would enable the prosecution of criminals from the previous government are just being made), and that precisely enabling him to carry out his crime was the president's goal and the reason why he was pardoned prematurely and inconsistently.
That`s what is happening right now, we are just getting rid of post-communists from "law and justice" party. Those two politicians who were legitimately sentenced to prison, pardoned in an unconstitutional manner 8 years ago just because they belong to the president's party, are FINALLY being incarcerated, and their party, which repeatedly violated the constitution and wreaked havoc on Poland during its 8 years in power, is now shouting about "political prisoners." Don't be fooled by their deceitful narrative; these two criminals ruined the lives of hundreds of people in Poland.

Please be precise. They were not charged and sentenced to jail term on corruption charges but on the abuse of power. A two-tier court procedure found them guilty of abusing their position in order to compromise the then coalition partner, which unfortunately led to the main figure apparently committing suicide. Andrzej Duda is a party-colleague of the two and calls them crystal clean, but he has pardoned them in 2015 in a legally invalid manner - before the full legal procedure elapsed, ergo before they were finally sentenced, which is required for the pardoning act, according to the Poland's Supreme Court ruling. Calling them 'political prisoners' is a sad joke. He may pardon them again - although that will prove that prevously he botched it.

Sad to say there is a manipulation in the first sentence. They have NOT been found guilty of corruption, but of the abuse of power while fighting corruption! That's a slight difference. (this is corrected later in the material but the first impression counts). Also the validity of their trial is dubious for many (depends on which experts you listen to).

The previous government was a result of people not facing charges of breaking the law in high political positions. Those who now are so full of 'democracy' and 'constitution' were the same people who stripped us of some basic human rights, violated the constitution and opened us up to foreign (especially russian) influences. Poland needs everyone's support to bring back the rule of law and independent judiciary system and dealing with and de-radicalising our own MAGA-like movements/people. And lastly, who benefits from division and turmoil in Poland? Exactly, that's where the source of this radicalisation lies.

Poland should be European and it belongs to EU, but what the current pro-EU political party is doing is just basically arresting everybody and for no reason. Firing basically whoever it wants in the court, and in the TV state media, and putting their own people there. The new pro-EU government in Poland wants to dictate what people see on all TV channels (TVN + TVP), and people don't have any alternative (Conservative people basically can't watch anything). We already had pro-European government from 2007-2015, and we were okay with that, but it was not abusing power to such an extreme extent as this one in 2024.
A Polish lawyer here - first these two have been sentenced for abuse of power not on corruption charges. Second - the president pardoned them before the final ruling was issued, what most of the Polish legal doctrine finds as premature and therefore not legally binding. If the president so wishes he may pardon them now and they would be free even today. Apparently he does not want to do so as he would prove he was wrong in the first place. From political standpoint having them in prison is seen as beneficial for PiS and the president as it helps to mobilise their electorate and building a narrative of political prisoners. These are main reasons why they are not free by now.
@@vulik Wrong - he did not pardon them yesterday. He has taken a different legal route to pardon them, that involves other authorities and could take up to several months. Again - as of now it’s his prerogative and sovereign decision to pardon them and get them out of prison on an instant basis. He has not taken this decision that’s why they stay in jail.

@@vulik No, it’s not correct. For the sake of simplicity - there are two legal routes to pardon a convicted individual in Poland. The short one requires a simple decision by the president. This decision lies within president’s sovereign prerogatives. The “long route” requires a round of consultations with the general prosecutor and the respective courts that had issued the respective rulings. This normally takes several months. This is the route that AD has taken, at the same time addressing the authorities involved in the process to act as quickly as possible and the general prosecutor to release the convicts from jail until the pardon proceedings is over. Again - if the president had taken the short route these two would be free by now. It may be assumed that he decided otherwise for the reasons I explained in my first comment.

When politics screws with law, there is never any justice. NO ONE SHOULD BE ABOVE THE LAW! The guilty must pay the price, or it makes a mockery of the victims. If you cannot do the time, do not do the crime!!
Kamiński and Wąsik were sentenced not for corruption, but for fighting it. It was over 15 years ago, they were responsible for creating a situation that was about to make people suspected for corruption accept a bribe, so they could have evidence for the allegations. The biggest problem now is that there is conflict of competence between some of institutions, including the High Court, President and Constitutional Tribunal, and it is a result of flaws in Polish law, and a few overinterpretations by various politicians. For many it is just a form of games, aiming to please the supporters of Tusk, who were expecting clearances. Personally, I think that although what Law and Justice did with education system and public media was totally unacceptable, because it fuelled social polarization, what the current coalition does is no better - in fact, Law and Justice did play with the law, but never clearly broke it; meanwhile at the very first weeks of their rule, Civic Coalition broke the law, taking the control of public television literally by force. In our internal politics, PM Tusk is perhaps the biggest hypocrite - declaring national reconciliation, and doing exactly the opposite, further polarizing the voters. I hope one day the trend of polarization ends and we'll have responsible rulers that respect not only the will of their own voters, but also of the opposition, and try to find compromises. Unfortunately now nothing suggests such changes.
This may end in a civil war in Poland, which may be the point of Tusk, perhaps acting on orders from foreign governments, including Russia (see the attack? in Smolensk)

I wanted to clarify that, because the material presents it unclearly and it can be understood that they participated in corruption themselves, which is not true. These two, Wąsik and Kamiński, largely overstepped their authority as the special forces coordinators, contributing to the destruction of the ruling cabinet in 2007 (cabinet of their past and current political leader) and to the suicidal death of the harassed (by them during their mentioned involvement) vice-PM Andrzej Lepper.

They just preapared false documents to catch scammers, which is a normal procedure in all police services like this in other countries, when they want to catch someone. Beside President Duda validly pardoned them, which was confirmed by the Supreme Court and the Constitutional Tribunal. We currently have political prisoners just like during communism.
Dear friends Germans, in 2006 Kamiński and Wąsik incited crime, forged documents and wanted to discredit the Minister of Agriculture Andrzej Lepper (He was a tribune of the people, a leader of farmers and people from small towns), whose party was in the coalition with PiS. They did not have permission from the prosecutor and the court to carry out the provocation. The minister did not accept a bribe for farming from a "businessman from Switzerland" - an anti-corruption officer "Land Affair - Afera Gruntowa". Years later, it turned out that the Minister of Agriculture was innocent, but the Law and Justice party took over the electorate party this man. Because of his tarnished name, Lepper committed suicide. They were not convicted of fighting corruption, but wanted to discredit Lepper and take over his electorate. They were sentenced to 10 years in prison in the first instance. Is it right to apply the power of pardon to such a person? If your colleague is the President of a country, then you can do anything? They are not political prisoners, they are politicians in prison.
It so happens that both politicians were convicted of exceeding their powers ALREADY in 2017 (edit: actually in 2015!) by a district court. They were to serve a 3-year prison sentence. They still had an appeal to make, but Andrzej Duda pardoned them before the appeal took place. This act of grace was considered invalid because it is assumed that the act of grace can only be performed after a final appeal. Both pardoned people were deemed eligible to remain MPs, precisely because their appeals did not happen. In 2023, after the change of power, an appeal was held, both politicians were sentenced to prison again and the sentence was carried out, even though the convicts tried to take refuge with the president. It was known from the beginning that any new act of clemency would be considered valid and that the politicians would be released if the president issued it. However, Andrzej Duda abstained this time this time and instead went on questioning the accusations and escalating the situation until the day of the protest staged by PiS. Precisely on that day, the new act of grace was issued by the president, in such a way for the procedure to be as long as possible and the tension to not decrease. It's a shame that DW now apparently stand on the side of the abusers and hold that they should remain unpunishable. What do you think of Trump, btw, I wonder?
According to law professors, written in books preceding 2017, the act of grace is not limited time after the final appeal - it can be made at any time. The judge sentencing the 3-year term had 2 weeks to write justification of the sentence, it took him 3 months (sic!) and caused and interference with parliament member election process. Such unjust interference to democracy required the President's intervention.
That's just one of the legal interpretations, and rather a minority one. Yet even Duda has denied his grace on that ground inthe past. In any case, this allowed the two to remain MPs after being judged guilty of power abuse - to me, this is absurd. And Kamiński later got involved in the Polish Pegasus affair and the spying of opposition leaders right before an election during the 8 years of PiS rule, being the Minister of the Interior and Administration at the time. This is yet to be investigated.

You missed vital context, President Duda pardoned them before sentence was in "power" thus rendering this pardon illegal as per highest court decision.
The Supreme Court of Poland ruled the pardon from 2015 was invalid because the pardon was made before the court decision was final in 2023. The president now admits that the previous pardon was invalid, because he can not pardon twice for the same crime.

I'm Polish. I voted for the Civic Coalition but I did not really expected what will happen. It's worse than under PiS. Political revenge, political prisoners (acquitted twice by the president), ignoring the decisions of the head of state and all high-ranking state officials nominated by PiS, paralysis of the state, attacks on free private media supporting PiS, in other words: The alleged defenders of democracy and the rule of law didn't really care about it at all, but they fought only for lost power and privileges. Now they are trying to get everything back by force. Even all the elderly people protesting in front of Tusk's house had their IDs checked by the police, what wasn't done in front of Kaczyński's house. The situation may be good for Germany and the EU, but not at all for Poland.
On that calls for explanation. I am Polish, in Warsaw now, I am following these events close. Above all, do not be misled by any disinformation. These two guys were at the head of a Police force called 'CBA', Counter Bribery Agency'. One of their early 'action' was to set-up a case against Mr Andrzej Lepper, who, believe it or not, was a coalition partner in Law and Justice government in 2007. Kaczyński stance towards their partners was always to kill their leaders politically (or physically?), and take over their voters. That's why they can't find any coalition partners now. So, these two guys forget a set documents and set-up eavesdropping devices without court permission in hotel rooms. They put up agents who played Swiss businessmen wanting to buy some land, but bribes were needed on the way. They actually instigated a crime of corruption and did not uncover one. Mt Lepper was found dead later on, looking like he had committed suicide. They two guys were convicted of their crimes as state official, including setting up an illegal provocation, forging documents and illegal eavesdropping. The court cases went during the 8 years of Law and Justice governments. The verdicts were passed after they lost power, because they managed to control the justice system in Poland. These are second verdicts. The Polish President pardoned them first in 2015, but he did that erroneously, before the original verdicts took legal force. DW does not understand what they are reporting. They just show you some images. There are absolutely no political prisoners in Poland. What the new government is doing is cleaning up the legal mess made by the previous government, and in particularly the complete take-over of the justice system by government and parliament, which actually means by one political party.
Not correct. Both men were wrongly convicted by the so-called court by phone - a classic during Tusk's government. The president validly pardoned them, which was confirmed by the Supreme Court and the Constitutional Tribunal. So we have political prisoners of the Tusk regime.

Unfortunately the previous government of Law And Justice Party (PiS) was not so popular among European Parliament members, due to thier conservative catholic approach mainly, but also for other reasons. Even that a Donald Tusk, or Euro Tusk, and his gang are currently trying to take full control of the country not respecting all leagal apsect required in constructional acts, they have full support of their EU colleagues who give him an open account for all actions. Stituation become so developed that according so law acts Euro Tusk and several members of his government are facing state tribulal acquisition if they not succeed with they revolte plans. Very strange situation I have to say. To clarify, Tusk government coalition are in favour of joing Euro land and deeper federalisation of EU. On the other hand, PiS (Law And Justice Party) are against Euro in Poland as well not in support for deeper dependency on EU, especially in aspects of suvereginity.
Let me explain what it is about? Both politicians and heads of the CBA served Poland during the presidency of Lech Kaczyński, who died in Smolensk. In the case of the so-called "land scandal" (this the case it concerns) and the re-arrest of Mr. Kamiński (Polish historian and politician. Anti-communist opposition activist during the Polish People's Republic, Chief of the CBA ) and Wąsik (Member of the Sejm of the Republic of Poland since 2015), Vice-Chief of CBA/Central Anticorruption Bureau/, it was obviously not the CBA employees who were accused of bribery in this scandal (who handled this case), but the suspect was Minister A. Lepper from the PiS coalition, head of the Samoobrona party. As a result of the materials provided to land scandal (for a bribe of PLN 2.7 million to transform 40 ha of agricultural land into construction land) the case was discontinued due to the lack of decisive evidence and allegedly illegal operational and reconnaissance activities (controlled bribe) and lack of proof of transfer of money to A. Lepper, which was not replaced. As a result of this scandal, the PiS coalition was actually hit, which broke up. This weakened the positions of PiS and the Government, and new elections were ordered. Vice-President of the Council of Ministers, A. Lepper, who was also the Minister of Agriculture, was dismissed. As I mentioned, the scandal led to the collapse of the then ruling coalition of PiS, LPR and Samoobrona RP. The sentence was then handed down, but to Mr. Kamiński and his deputy, Mr. Wasik, to 2.5 years for the so-called "excess of powers and controlled operation (lack of sufficient evidence)" in the year of PO/PSL government? It looked as if they wanted to kill "two birds with one stone", break up the PiS coalition, get rid of the Minister of Agriculture Lepper and the above-mentioned heads of the CBA and two co-workers of the CBA? Of course, in such a situation they exercised the President's right of pardon, but only in 2015. The investigation into this case was resumed, but I would like to remind you that in 2007, a certain PO MP was involved in a bribery and paid protection scandal and was sentenced to 3 years in prison. A similar reconnaissance and operational action was used. Then there was full evidence of acceptance of valuable items and a larger amount of the promised bribe. Sometimes it works and other times it doesn't. The case was reopened.The CBA was established to "look at the hands of politicians" and on behalf of the voters because this is what they voted for in the 2005 elections when PiS, a conservative and republican party in Poland, won.

Corruption means abuse of power. While that is viewed by many in Eastern Europe as normal especially in case of taking a bribe or being eternal president like Putin it is seen as failure as a state, as a nation and as a community.
The situation is complicated and even law professors struggle to comprehend it. Basically the law about the presidential pardon is not clear. There is no statement in it if president can pardon someone who wasnt sentenced by the court - and president did that before for these men - for the first time in history(over 7000 presidential pardons were given after the sencence by the court). Then high court stated that president cannot do that. So they were sentenced to jail last month. This is why president needed to pardon them the second time after the sentence now. PiS party could change the law so that it would be clear if president can pardon someone before the sencence, but they neglected it during their rule. There is also conflict between the high court and constitutional court. Constitutional court neglected its job for 4 years, they were given an assignment to decide what is constitutional. They finally did it at the end of last year stating that president in fact have the right to pardon someone before sentencing by the court - and high court stated that it doesnt care about constitutional court verdict.

There is only one exception saying that the president cannot pardon those convicted by the State Tribunal. PiS did not have the majority to change the Constitution. Besides, he didn't need to change it since the regulation allows for a pardon. Different chambers of the Supreme Court issue contradictory rulings in this regard. But the Chamber of Labor is incompetent, and moreover, the request for consideration was submitted to it illegally, not through the daily newspaper, but to a specific judge who was known in advance to issue a ruling against the president.

According to the Tribunal State the president had the right to pardon Wasik and Kaminski on the grounds of individual abolition. Article 139 from the Polish constitution. Therefore Duda is right that he had the constitutional right to pardon Wasik and Kaminski despite many Poles not being aware of this fact and repeating the lie that is has been done against the law as Wasik and Kaminski were not officially convicted at that time. Many Polish people repeat it not in bad faith, but because they do not know the constitution and simply repeat what they hear on-line from the Anti-PIS media. In December 2023 a District Court decided that Wasik and Kaminski are guilty and they were arrested despite the previous decision of the Tribunal State. The most important fact is that Wasik and Kaminski were arrested for abusing law, but they did, in fact, uncover a real crime. The were arrested for formalities and not as many people say, for falsifying evidence. One of the men that was involved in the "land scandal" named Kryszynski admitted that he is guilty in court and the other one claimed that Kryszynski involved him in it and testified against him. Duda pardoned just 95 people during 5 years. Tusk's colleague, Bronislaw Komorowski pardoned 360 people during 5 years. I think that's very telling. Is PIS an amazing political party? Honestly I do not like politics in general and I found many flaws also in PIS, but Tusk and his people are terrifying me.
Can you point to s single act of Polish law where the individual abolition is mentioned? It's not in bad faith,m where did get that? There are legal analyses, underlining that the Polish clemency prerogative included in Art 139 of the Const. does include the individual abolition, also confirmed by the Polish Supreme Court. Article 139 says: " The President of the Republic shall have the power of pardon. The power of pardon may not be extended to individuals convicted by the Tribunal of State." By the way, I love how people in my country are wasting time arguing over two guys that literally fought corruption being pardoned, but nobody discussed all the literal murderers being pardoned by presidents of our country during the years. As a Polish person following the crisis in Poland I can tell you that this interview was severely biased and the merits of this narrative is false. The reality is that since Tusk came to power last month he decided that the laws and constitution don’t apply to his actions, as a matter of fact our President from the start was very open to cooperation with Tusk, but after witnessing blatant disregard for the law as it was the case with Polish media and currently many more events, he became outspoken(as any President should). Listen to the narrative of the presenter of this program, he immediately assumes which side of this conflict is inflammatory which isn’t a sign of good journalism at all. So what DW missed or didn't fully explain. The 2 people did get a pardon, but they did get it before conviction by the court. This belive it or not opens a can of worms as the president can write conviction for all the crimes the PiS party did during their rule before they even go to court. The constitution isn't quite clear if you can give such pardons. The og courts made that pardon not binding but when pis came to power they created their own courts and institutions that were straight in the violation of the constitution and the president signed on that. This time around, the news reader says that the Polish president will "pardon two populist ex-lawmakers who were arrested on corruption charges". Let me get the facts straight, they were arrested on "abuse of power" charges whilst FIGHTING corruption. A slight difference, isn't it? They were fighting corruption on the highest political level. Doesn't that suggest something? Thanks to these two (amongst others), corruption in Poland fell significantly, which I'm very proud of. This also wasn't the sole reason that sparked the protests, the new government took the public TV and press agency by force just before Christmas, literally stealing it by sending in some strong men. I'm not saying I was happy with the state of the public TV in Poland but this is plain and simple called theft. Correction: the first pardon in 2016 was not on „similar charges” - these were the exact same charges. It’s the same case. President was forced to pardon them again. Why you ask? Basically this allows the government to strip them of their parliamentary seats.
According to the law, they shouldn't have had those parliamentary seats for the last 8 years as well. By the law being disputed, the president can only pardon a person that is convicted and a convicted person can't be an MP. President can not pardon someone who is innocent, right? But in 2016 they were pardoned without being convicted, which has never happened for anyone except those 2 men and 2 other people from the same court case. The argument is that this is unlawful, because this violates constitutional separation of powers. So what happened in 2016 is essentially president telling the court "they're with me, don't judge them, drop the case" and the ruling party tightly controlling the courts made it drop the case.

To provide some context:
The President does indeed have the power of pardon. The Polish Constitution puts it as follows:
"The President of the Republic shall have the power of pardon. The power of pardon may not be extended to individuals convicted by the Tribunal of State." (Article 139)
However, the same Constitution also states that:
"The organs of public authority shall function on the basis of, and within the limits of, the law." (Article 7)
"The system of government of the Republic of Poland shall be based on the separation of and balance between the legislative, executive and judicial powers." (Article 10)
"Everyone shall be presumed innocent of a charge until their guilt is determined by the final judgment of a court." (Article 42)
In 2015 Duda "pardoned" Kamiński and Wąsik before there was a *final judgment* (that is, the appeal court's ruling). Effectively, he stopped the appeal from happening. This clearly went against the presumption of innocence principle and the separation of powers principle, which is why many legal experts have questioned his decision. Duda argues that the constitutional power of pardon extends to acts of "individual abolition". But... Does it? In the light of Article 7? I hardly think so.
I would add: pardon is supposed to be a form of humanitarian relief for the convicted. What Duda has done is to "remove" the punishment from the criminal, not to help him, but to allow him to take office and continue committing crimes. Of course, Kaminski has not yet been convicted of opposition surveillance, but it is already known that he is responsible for such a crime (changes in the prosecutor's office that would enable the prosecution of criminals from the previous government are just being made), and that precisely enabling him to carry out his crime was the president's goal and the reason why he was pardoned prematurely and inconsistently.

Please be precise. They were not charged and sentenced to jail term on corruption charges but on the abuse of power. A two-tier court procedure found them guilty of abusing their position in order to compromise the then coalition partner, which unfortunately led to the main figure apparently committing suicide. Andrzej Duda is a party-colleague of the two and calls them crystal clean, but he has pardoned them in 2015 in a legally invalid manner - before the full legal procedure elapsed, ergo before they were finally sentenced, which is required for the pardoning act, according to the Poland's Supreme Court ruling. Calling them 'political prisoners' is a sad joke. He may pardon them again - although that will prove that prevously he botched it.

Sad to say there is a manipulation in the first sentence. They have NOT been found guilty of corruption, but of the abuse of power while fighting corruption! That's a slight difference. (this is corrected later in the material but the first impression counts). Also the validity of their trial is dubious for many (depends on which experts you listen to).

The previous government was a result of people not facing charges of breaking the law in high political positions. Those who now are so full of 'democracy' and 'constitution' were the same people who stripped us of some basic human rights, violated the constitution and opened us up to foreign (especially russian) influences.

As A Pole, I do not support the new government as it ignoring the law and creating tyranny.
Poland should be European and it belongs to EU, but what the current pro-EU political party is doing is just basically arresting everybody and for no reason. Firing basically whoever it wants in the court, and in the TV state media, and putting their own people there. The new pro-EU government in Poland wants to dictate what people see on all TV channels (TVN + TVP), and people don't have any alternative (Conservative people basically can't watch anything).
We already had pro-European government from 2007-2015, and we were okay with that, but it was not abusing power to such an extreme extent as this one in 2024.

A Polish lawyer here - first these two have been sentenced for abuse of power not on corruption charges. Second - the president pardoned them before the final ruling was issued, what most of the Polish legal doctrine finds as premature and therefore not legally binding. If the president so wishes he may pardon them now and they would be free even today. Apparently he does not want to do so as he would prove he was wrong in the first place. From political standpoint having them in prison is seen as beneficial for PiS and the president as it helps to mobilise their electorate and building a narrative of political prisoners. These are main reasons why they are not free by now.

Again - as of now it’s his prerogative and sovereign decision to pardon them and get them out of prison on an instant basis. He has not taken this decision that’s why they stay in jail.

@@vulik No, it’s not correct. For the sake of simplicity - there are two legal routes to pardon a convicted individual in Poland. The short one requires a simple decision by the president. This decision lies within president’s sovereign prerogatives. The “long route” requires a round of consultations with the general prosecutor and the respective courts that had issued the respective rulings. This normally takes several months. This is the route that AD has taken, at the same time addressing the authorities involved in the process to act as quickly as possible and the general prosecutor to release the convicts from jail until the pardon proceedings is over. Again - if the president had taken the short route these two would be free by now. It may be assumed that he decided otherwise for the reasons I explained in my first comment.

Does Polish law forbid President to pardon someone before conviction? Does Polish law say anything about using this "short way" twice? Is it sure that this decision of the President to use "short way" for the second time won't be questioned by lawyers who are in opposition to President?

Kamiński and Wąsik were sentenced not for corruption, but for fighting it. It was over 15 years ago, they were responsible for creating a situation that was about to make people suspected for corruption accept a bribe, so they could have evidence for the allegations. The biggest problem now is that there is conflict of competence between some of institutions, including the High Court, President and Constitutional Tribunal, and it is a result of flaws in Polish law, and a few overinterpretations by various politicians. For many it is just a form of games, aiming to please the supporters of Tusk, who were expecting clearances.
Personally, I think that although what Law and Justice did with education system and public media was totally unacceptable, because it fuelled social polarization, what the current coalition does is no better - in fact, Law and Justice did play with the law, but never clearly broke it; meanwhile at the very first weeks of their rule, Civic Coalition broke the law, taking the control of public television literally by force. In our internal politics, PM Tusk is perhaps the biggest hypocrite - declaring national reconciliation, and doing exactly the opposite, further polarizing the voters. I hope one day the trend of polarization ends and we'll have responsible rulers that respect not only the will of their own voters, but also of the opposition, and try to find compromises. Unfortunately now nothing suggests such changes.
This may end in a civil war in Poland, which may be the point of Tusk, perhaps acting on orders from foreign governments, including Russia (see the attack? in Smolensk)

These two, Wąsik and Kamiński, largely overstepped their authority as the special forces coordinators, contributing to the destruction of the ruling cabinet in 2007 (cabinet of their past and current political leader) and to the suicidal death of the harassed (by them during their mentioned involvement) vice-PM Andrzej Lepper.

Not arrested on corruption charges, but sentenced to 2 years in jail for misfeasance as heads of the anti-corruption agency (CBA).
They just preapared false documents to catch scammers, which is a normal procedure in all police services like this in other countries, when they want to catch someone. Beside President Duda validly pardoned them, which was confirmed by the Supreme Court and the Constitutional Tribunal. We currently have political prisoners just like during communism.
Dear friends Germans, in 2006 Kamiński and Wąsik incited crime, forged documents and wanted to discredit the Minister of Agriculture Andrzej Lepper (He was a tribune of the people, a leader of farmers and people from small towns), whose party was in the coalition with PiS. They did not have permission from the prosecutor and the court to carry out the provocation. The minister did not accept a bribe for farming from a "businessman from Switzerland" - an anti-corruption officer "Land Affair - Afera Gruntowa". Years later, it turned out that the Minister of Agriculture was innocent, but the Law and Justice party took over the electorate party this man. Because of his tarnished name, Lepper committed suicide. They were not convicted of fighting corruption, but wanted to discredit Lepper and take over his electorate. They were sentenced to 10 years in prison in the first instance. Is it right to apply the power of pardon to such a person? If your colleague is the President of a country, then you can do anything? They are not political prisoners, they are politicians in prison.

It so happens that both politicians were convicted of exceeding their powers ALREADY in 2017 (edit: actually in 2015!) by a district court. They were to serve a 3-year prison sentence. They still had an appeal to make, but Andrzej Duda pardoned them before the appeal took place. This act of grace was considered invalid because it is assumed that the act of grace can only be performed after a final appeal. Both pardoned people were deemed eligible to remain MPs, precisely because their appeals did not happen.
In 2023, after the change of power, an appeal was held, both politicians were sentenced to prison again and the sentence was carried out, even though the convicts tried to take refuge with the president. It was known from the beginning that any new act of clemency would be considered valid and that the politicians would be released if the president issued it. According to law professors, written in books preceding 2017, the act of grace is not limited time after the final appeal - it can be made at any time.
The judge sentencing the 3-year term had 2 weeks to write justification of the sentence, it took him 3 months (sic!) and caused and interference with parliament member election process. Such unjust interference to democracy required the President's intervention.
That's just one of the legal interpretations, and rather a minority one. Yet even Duda has denied his grace on that ground inthe past. In any case, this allowed the two to remain MPs after being judged guilty of power abuse - to me, this is absurd. And Kamiński later got involved in the Polish Pegasus affair and the spying of opposition leaders right before an election during the 8 years of PiS rule, being the Minister of the Interior and Administration at the time. This is yet to be investigated.

I'm Polish. I voted for the Civic Coalition but I did not really expected what will happen. It's worse than under PiS. Political revenge, political prisoners (acquitted twice by the president), ignoring the decisions of the head of state and all high-ranking state officials nominated by PiS, paralysis of the state, attacks on free private media supporting PiS, in other words: The alleged defenders of democracy and the rule of law didn't really care about it at all, but they fought only for lost power and privileges. Now they are trying to get everything back by force. Even all the elderly people protesting in front of Tusk's house had their IDs checked by the police, what wasn't done in front of Kaczyński's house. The situation may be good for Germany and the EU, but not at all for Poland.

On that calls for explanation. I am Polish, in Warsaw now, I am following these events close. Above all, do not be misled by any disinformation. These two guys were at the head of a Police force called 'CBA', Counter Bribery Agency'. One of their early 'action' was to set-up a case against Mr Andrzej Lepper, who, believe it or not, was a coalition partner in Law and Justice government in 2007. Kaczyński stance towards their partners was always to kill their leaders politically (or physically?), and take over their voters. That's why they can't find any coalition partners now. So, these two guys forget a set documents and set-up eavesdropping devices without court permission in hotel rooms. They put up agents who played Swiss businessmen wanting to buy some land, but bribes were needed on the way. They actually instigated a crime of corruption and did not uncover one. Mt Lepper was found dead later on, looking like he had committed suicide. They two guys were convicted of their crimes as state official, including setting up an illegal provocation, forging documents and illegal eavesdropping. The court cases went during the 8 years of Law and Justice governments. The verdicts were passed after they lost power, because they managed to control the justice system in Poland. These are second verdicts. The Polish President pardoned them first in 2015, but he did that erroneously, before the original verdicts took legal force. DW does not understand what they are reporting. They just show you some images. There are absolutely no political prisoners in Poland. What the new government is doing is cleaning up the legal mess made by the previous government, and in particularly the complete take-over of the justice system by government and parliament, which actually means by one political party.
Not correct. Both men were wrongly convicted by the so-called court by phone - a classic during Tusk's government. The president validly pardoned them, which was confirmed by the Supreme Court and the Constitutional Tribunal. So we have political prisoners of the Tusk regime.

Unfortunately the previous government of Law And Justice Party (PiS) was not so popular among European Parliament members, due to thier conservative catholic approach mainly, but also for other reasons. Even that a Donald Tusk, or Euro Tusk, and his gang are currently trying to take full control of the country not respecting all leagal apsect required in constructional acts, they have full support of their EU colleagues who give him an open account for all actions. Stituation become so developed that according so law acts Euro Tusk and several members of his government are facing state tribulal acquisition if they not succeed with they revolte plans. Very strange situation I have to say. To clarify, Tusk government coalition are in favour of joing Euro land and deeper federalisation of EU. On the other hand, PiS (Law And Justice Party) are against Euro in Poland as well not in support for deeper dependency on EU, especially in aspects of suvereginity.
Let me explain what it is about? Both politicians and heads of the CBA served Poland during the presidency of Lech Kaczyński, who died in Smolensk. In the case of the so-called "land scandal" (this the case it concerns) and the re-arrest of Mr. Kamiński (Polish historian and politician. Anti-communist opposition activist during the Polish People's Republic, Chief of the CBA ) and Wąsik (Member of the Sejm of the Republic of Poland since 2015), Vice-Chief of CBA/Central Anticorruption Bureau/, it was obviously not the CBA employees who were accused of bribery in this scandal (who handled this case), but the suspect was Minister A. Lepper from the PiS coalition, head of the Samoobrona party. As a result of the materials provided to land scandal (for a bribe of PLN 2.7 million to transform 40 ha of agricultural land into construction land) the case was discontinued due to the lack of decisive evidence and allegedly illegal operational and reconnaissance activities (controlled bribe) and lack of proof of transfer of money to A. Lepper, which was not replaced. As a result of this scandal, the PiS coalition was actually hit, which broke up. This weakened the positions of PiS and the Government, and new elections were ordered. Vice-President of the Council of Ministers, A. Lepper, who was also the Minister of Agriculture, was dismissed. As I mentioned, the scandal led to the collapse of the then ruling coalition of PiS, LPR and Samoobrona RP. The sentence was then handed down, but to Mr. Kamiński and his deputy, Mr. Wasik, to 2.5 years for the so-called "excess of powers and controlled operation (lack of sufficient evidence)" in the year of PO/PSL government? It looked as if they wanted to kill "two birds with one stone", break up the PiS coalition, get rid of the Minister of Agriculture Lepper and the above-mentioned heads of the CBA and two co-workers of the CBA? Of course, in such a situation they exercised the President's right of pardon, but only in 2015. The investigation into this case was resumed, but I would like to remind you that in 2007, a certain PO MP was involved in a bribery and paid protection scandal and was sentenced to 3 years in prison. A similar reconnaissance and operational action was used. Then there was full evidence of acceptance of valuable items and a larger amount of the promised bribe. Sometimes it works and other times it doesn't. The case was reopened.The CBA was established to "look at the hands of politicians" and on behalf of the voters because this is what they voted for in the 2005 elections when PiS, a conservative and republican party in Poland, won.

Corruption means abuse of power. While that is viewed by many in Eastern Europe as normal especially in case of taking a bribe or being eternal president like Putin it is seen as failure as a state, as a nation and as a community.
The situation is complicated and even law professors struggle to comprehend it. Basically the law about the presidential pardon is not clear. There is no statement in it if president can pardon someone who wasnt sentenced by the court - and president did that before for these men - for the first time in history(over 7000 presidential pardons were given after the sencence by the court). Then high court stated that president cannot do that. So they were sentenced to jail last month. This is why president needed to pardon them the second time after the sentence now. PiS party could change the law so that it would be clear if president can pardon someone before the sencence, but they neglected it during their rule.
There is also conflict between the high court and constitutional court. Constitutional court neglected its job for 4 years, they were given an assignment to decide what is constitutional. They finally did it at the end of last year stating that president in fact have the right to pardon someone before sentencing by the court - and high court stated that it doesnt care about constitutional court verdict.

There is only one exception saying that the president cannot pardon those convicted by the State Tribunal. PiS did not have the majority to change the Constitution. Besides, he didn't need to change it since the regulation allows for a pardon. Different chambers of the Supreme Court issue contradictory rulings in this regard. But the Chamber of Labor is incompetent, and moreover, the request for consideration was submitted to it illegally, not through the daily newspaper, but to a specific judge who was known in advance to issue a ruling against the president.

According to the Tribunal State the president had the right to pardon Wasik and Kaminski on the grounds of individual abolition. Article 139 from the Polish constitution. Therefore Duda is right that he had the constitutional right to pardon Wasik and Kaminski despite many Poles not being aware of this fact and repeating the lie that is has been done against the law as Wasik and Kaminski were not officially convicted at that time. Many Polish people repeat it not in bad faith, but because they do not know the constitution and simply repeat what they hear on-line from the Anti-PIS media. In December 2023 a District Court decided that Wasik and Kaminski are guilty and they were arrested despite the previous decision of the Tribunal State. The most important fact is that Wasik and Kaminski were arrested for abusing law, but they did, in fact, uncover a real crime. The were arrested for formalities and not as many people say, for falsifying evidence. One of the men that was involved in the "land scandal" named Kryszynski admitted that he is guilty in court and the other one claimed that Kryszynski involved him in it and testified against him. Duda pardoned just 95 people during 5 years. Tusk's colleague, Bronislaw Komorowski pardoned 360 people during 5 years. I think that's very telling. Is PIS an amazing political party? Honestly I do not like politics in general and I found many flaws also in PIS, but Tusk and his people are terrifying me.
Can you point to s single act of Polish law where the individual abolition is mentioned? It's not in bad faith,m where did get that? There are legal analyses, underlining that the Polish clemency prerogative included in Art 139 of the Const. does include the individual abolition, also confirmed by the Polish Supreme Court. I didn't make anything up. Yes, Kaminski and Wasik broke the law, but they didn't falsify evidence. As I wrote above the people that have been accused of corruption confessed their guilt in court. Article 139 says: " The President of the Republic shall have the power of pardon. The power of pardon may not be extended to individuals convicted by the Tribunal of State." By the way, I love how people in my country are wasting time arguing over two guys that literally fought corruption being pardoned, but nobody discussed all the literal murderers being pardoned by presidents of our country during the years. That's an interesting phenomenon.

As a Polish person following the crisis in Poland I can tell you that this interview was severely biased and the merits of this narrative is false. The reality is that since Tusk came to power last month he decided that the laws and constitution don’t apply to his actions, as a matter of fact our President from the start was very open to cooperation with Tusk, but after witnessing blatant disregard for the law as it was the case with Polish media and currently many more events, he became outspoken(as any President should). Listen to the narrative of the presenter of this program, he immediately assumes which side of this conflict is inflammatory which isn’t a sign of good journalism at all. I am not telling anyone here whom to believe, but I’d encourage people to remain sceptical.

So what DW missed or didn't fully explain. The 2 people did get a pardon, but they did get it before conviction by the court. This belive it or not opens a can of worms as the president can write conviction for all the crimes the PiS party did during their rule before they even go to court. The constitution isn't quite clear if you can give such pardons. The og courts made that pardon not binding but when pis came to power they created their own courts and institutions that were straight in the violation of the constitution and the president signed on that. So currently we are in a situation were there are the og courts and institutions and new ones. Evrybody is right and nobody at the same time. This time around, the news reader says that the Polish president will "pardon two populist ex-lawmakers who were arrested on corruption charges". Let me get the facts straight, they were arrested on "abuse of power" charges whilst FIGHTING corruption. A slight difference, isn't it? They were fighting corruption on the highest political level. Doesn't that suggest something? Thanks to these two (amongst others), corruption in Poland fell significantly, which I'm very proud of. This also wasn't the sole reason that sparked the protests, the new government took the public TV and press agency by force just before Christmas, literally stealing it by sending in some strong men. I'm not saying I was happy with the state of the public TV in Poland but this is plain and simple called theft. They are abusing law on so many levels right now, taking a disproportionate revenge on the current opposition. Yet they call themselves democratic - not in my name. They also have a strong support coming from the EU, well how about the Rule of Law now Ursula von der Leyen? Lastly, your polish correspondent, is not only inarticulate but also biased in her interpretation of the facts.
Mariusz Kamiński and Maciej Wąsik are one of the people responsible for pegasus gate - literally spying on opposition politicians through their smartphones using a software made for TRACKING CRIMINALS. Let's say it again to understand how absurd that is: they used a software made for tracking criminals to spy on opposition politicians. Yes, they abused their power while fighting corruption, it still means they ABUSED THEIR POWER and are guilty.
So, I'm not the only one. and everbody keeps calling 'Stay strong, Poland'. People don't know the facts.

Many of them were heavily brainwashed for the last 8 years by government controlled TV/radio/press and with a collaboration from the church. So I think many of them truly believe that Poland is at some existential risk because of this and that those two guys are innocent, decent people, rather than convicted criminals. This is sad. It will take years to undo just partially.

Correction: the first pardon in 2016 was not on „similar charges” - these were the exact same charges. It’s the same case. President was forced to pardon them again. Why you ask? Basically this allows the government to strip them of their parliamentary seats.
You can't pardon an innocent person.

According to the law, they shouldn't have had those parliamentary seats for the last 8 years as well. By the law being disputed, the president can only pardon a person that is convicted and a convicted person can't be an MP. President can not pardon someone who is innocent, right? But in 2016 they were pardoned without being convicted, which has never happened for anyone except those 2 men and 2 other people from the same court case. The argument is that this is unlawful, because this violates constitutional separation of powers. So what happened in 2016 is essentially president telling the court "they're with me, don't judge them, drop the case" and the ruling party tightly controlling the courts made it drop the case.
@@przemysawhorban5553 It actually is. The last pardon came BEFORE they were convicted the first time. That is why it wasn't valid. You can't pardon someone for something they haven't even been convicted for yet.
