  • The plaintiff claims the defendant shot across two lanes to make a left turn and slammed into his car, so the plaintiff is suing for damages. The defendant insists the plaintiff sideswiped him, and he’s the one who was hit. If anyone’s owed money, the defendant believes it’s him. The defendant is countersuing for an insurance deductible.

    Installed a dash cam in my car for this exact reason. Better to be safe than sorry in court.

      The mentioning of you living in Europe seems completely unnecessary.
      If anything: you are way more likely to be sued in the US than in Europe and most insurances in Europe are quite decent, well priced and don’t require a high deductible fee in order to keep it affordable… which can’t be said about the average American insurance policies…

    When The older plantiff with strong accent was explaining his side up at the board with the Judge says i made the turn...lol but it sounded like turd..then Judge M says turd???? With a stunned face, but the plantiff was clueless....🤣🤣🤣

    A photo for the defendant of where he stopped that day would have tipped the scale in his favour. In most countries you should be able to safely turn to your ‘immediate’ left or right lane of a multi lane stretch of road. 👍🏼

    This is the definition of "an accident". I think BOTH parties made wide turns. Neither one wanted to give a second of time to slow down or stay in their lanes. I think they're both at fault, either one could have given the other the space to procede. Good verdict.

      It's rather simple really, not sure why the judge didn't catch it. The defendant had at least 5 times the amount of time to assess the situation because he was making a long turn as opposed to the plaintiff who made the turn in seconds. Assuming the defendant isn't going about traffic hoping someone would hit him, the old guy must have been at fault here.
      In any case, these sorts of intersections (without protective traffic lights) shouldn't exist in a country that calls itself the greatest nation in the world.

    This is my second pet peeve driving situation (the first is four way stops and "being polite") Turn into the lane closet to you. Pretty sure that is still in the handbook. Oh and I would like five minutes in a closed room with the guy who originally thought, "Hey, I can pass on the right and not wait for this person to turn."

    According to the defendant's story, the plaintiff's car should be damaged along the whole side, but according to the photos the only damage was at the rear quarter panel. If they initially stopped on the median as the defendant claims then it shows that the plaintiff is most likely at fault.

      if the damage is on the REAR quarter panel then that means the defendant is at fault because he hit the rear of the plaintiff's car meaning the plaintiff was first and the defendant was not paying good enough attention to stop or slow down to avoid the collision .

    Any time I'm turning left at an un-protected intersection (a solid green light), I wait for any vehicles turning right to finish their maneuver. You never know what lane a motorist wants to end up in. Ultimately the driver turning right has the right of way.
    Driving 101 is that you should turn into the closest lane.

    I almost fell out of my chair when I saw the names of the streets.... the exact road I take to work every single day 😂 I sometimes forget People's Court was an east coast thing. (And yes I've seen too many accidents to count. Luckily there's a fire department right over there, so the ambulance is always just a stones throw away)

      Okay, so I have a question. In that intersection, the older man said he had a green light to turn. If he had the green light to make that turn, wouldn't the younger guy not have a green light to make his turn? This intersection is a little wonky so I'm not understanding how the traffic light work.

      @@jessicabrigman8295 No turning arrow there- both east and west-bound traffic have the green at the same time, and someone making a left has to yield to oncoming traffic. In this case, they both could have made the turn to head south, but the plaintiff instead of turning into the right lane, turned into the left lane.

    The judge is incorrect. The plaintiff should have won, BECAUSE, and as she stated, "traditionally, persons making a right turn have the right of way" and this remains the case. The defendant should have waited.

    This is why you should always take photos as soon as it happens and before you pull to the side of the road to discuss anything, which would have shown exactly where the cars were...

      Where they initially stopped wouldn't have proven anything, but may have eluded toward fault. If they first stopped on the median as the defendant claims, it would strongly imply that the plaintiff was probably the one that made the wide turn.

    When the plaintiff showed his version of the accident he showed himself making a right into the middle lane which is illegal. This was 100% the plaintiff fault.

      @@lukerinderknecht2982 You do not have to turn in to the immediate lane. You have choice of lanes. Left turning driver yields to right turn. Each driver can go into any available lane but only after properly yielding. So the left turner can indeed turn into the far right lane but only after yielding to the right turning vehicle. Both cannot turn at the same time. Right turn first, then left turn follows.

      @@foxvalleystingraysI think this may depend on the state. I was pulled over for not turning into the lane closest to me at an intersection and had a green light. I also was in an accident similar to this scenario in which the other driver was at fault for not turning into his immediate lane. The states were AZ and TX.

    I think the plaintiff is confused in how police reports work. They took his statement, and he’s reading it as if it’s their findings. Wish she would have explained it a bit so he understands the police are not agreeing with him, it’s just a report

    Actually the guy making the right was supposed to stop becuz he only has the right of way if there is no traffic light. Since there was, he was supposed to wait for the guy to make a left then go. I find it hard to believe both had green lights 🤔

    Where I’m from, the person turning left (defendant) would be at fault. He didn’t have an arrow, so he should’ve waited until the plaintiff was done with his turn before proceeding.

      @@DonziGT230 the defendants front end hit the plaintiffs back end. They both acknowledge that. That means that the plaintiff was turning first. When making a left turn, oncoming traffic has the right of way.

    Yeah, this is why you should always stop and take pictures exactly where the accident happened. Since he's older you would think he is an extremely cautious driver, but a lot of older people do 60 on the highway which may seem cautious but it makes other drivers have to switch lanes to get around pokey drivers which in return is more dangerous. Or him thinking he is making a right turn and can take either lane he wants cause of "right of way". I have people making left with me making a right all the time and i hate it. If im making a left i wait for everyone making their right to go first because i dont trust other drivers! Then the defendant being a younger driver you would think impatient, but im around his age and i am extremely impatient but very aware of others being bad drivers. Judge made the right call. Get dash cams! That would have been a tremendous help.

    Just had my SUV totalled 2 days ago. I had a green light, a 76 yr old made a turn at the last second (on his red). You'd be surprised how much damage & pain is caused by 45mph hitting a near-stationary car. Dash cam is still sitting in its box in my living room. So dumb of me... Install dash cams, friends.

    When the plaintiff showed the accident on the diagram, they immediately moved themself into the middle lane, which would be an illegal turn. My guess is that he was shooting across the lanes and was honest when showing himself on the diagram. This makes me think he was the one who caused the crash. But that's a pretty minor detail and may have just been a mistake.

      We don’t know if the right lane is a parking lane. If that’s the case, his lane to legally turn into would’ve been the middle lane. But considering he also showed the defendant flying over the median, I’m not sure we can trust his testimony that accurately.

    Where I’m from the defendant should have turned left and stayed the left lane, and the plaintiff should have turned right and stayed in the right lane. That’s not what happened obviously because there was an accident. Who was at fault? 🤷🏼‍♂️

The plaintiff, when he was demonstrating on the board what happened, admitted that he turned into the left lane- thus it is his fault- but dingbat psycho Milan says she doesn't know who turned into the inappropriate lane??!! People, this is why you NEVER want to come under the jurisdiction of a court, because judges are idiots, psychos, or just don't give enough of a damn about you or justice to even pay attention or care. (Once sold a vehicle online to a husband and wife judge couple [no, not Marilyn & John]...between the two of them, they couldn't figure out how to use PayPal and had to send a check for the deposit. Real judges, who have jurisdiction over the lives, liberty and property of others every single day. How would you like you life being in their hands?)
