      55 restating orders are legit useless and usually do nothing but anger stalkers when they’re served with them.

    • @hayleeofthevalley
      @hayleeofthevalley 6 лет назад +23

      Diane M Kuchins people have a right to use force to defend themselves without restraining orders, though. So that’s just another reason for why it’s useless.

    • @someone-ji2zb
      @someone-ji2zb 6 лет назад +75

      The main reason for the order is that it gives the cops a real reason to show up as quickly as possible to deal with the person if he actually shows up in person. Try getting the cops to do anything based on your word alone... takes hours, if not days.

      It could lead to a political firestorm if someone claims that it is a cringey cultural thing about chinese people. Plus, the overarching view that it can have in mainland China can cause a geopolitical crisis as they wouldve arrested a Chinese national. It has happened during the cold war, hence why there are alot of precautions regarding hiring F1 visa students in technology sensitive firms while the us government turns a blind eye for refugees that are likely foreign spies. In short, it will cause a much harder backlash than it is worth to arrest the creep.

      CaniCat I agree they should Never be allowed outside because it will happen again! Some people can’t “come back” in society nor should they allow them to try! It’s a brutal (ugly) reality of our world & unfortunately uncontrollably monstrous behavior! Their behavior is a reality & combined it with Mental Illness (& often drug or alcohol abuse). Sadly they won’t/can’t be compliant with medications without structure & long term or life term care.
      It can -and does lock them up permanently & also receive treatment for their mental illness. Sadly they will never be rehabilitated & if someone wants to give them a chance-I hope they look at the survivors & their families (I saw more of them than I did the perpetrators). Some individuals can Not come back in society for great reasons! I spent 20 years in the ER’s being the “eyes & ears” for 6 very specialized psychiatrists (including forensics & child). Working with survivors & it was much more difficult to be objective when you saw not only the survivors (of their families) in the same ER at the same day or night. I did send some perpetrators to the psych unit in our State Prison (again the psychiatrist call along with our ER Dr). It keeps them safer & any one that has contact with them a little safer. Some proved they were too dangerous including Non compliance of Meds -to be released! Yep! You are right! It won’t rehabilitate them enough to be in society again. It will assist them with the medication & will be much more routine for them. Perhaps assisting in controlling their hallucinations & or aggression. I agree with you!

      No there aren’t. That’s an urban legend. Less than 6% of inmates are receiving mental health in prison, where upwards to 50% of inmates have mental illness. It’s not a coincidence that we started shutting down all of our nut houses slowly in 1955 and then all at once in 1970 and the prison population exploded. Most of our prisoners should be in but houses but nobody wants to build but houses, calling them a drain on the health department budgets. (But then keep the prisons full of legitimately insane people, which is why our jails suck, btw) And yes, it is lost on people that we just traded sanitariums for prisons.

    • @Sarah.Riedel
      @Sarah.Riedel 5 лет назад +1

      The thing is, the criminal justice system is already heavily, heavily skewed towards individuals with mental illness, so the law must be extremely cautious in its application of criminal penalties when a suspect is determined to be suffering from a serious, chronic and difficult to treat illness like schizophrenia, because it so radically alters the individual's perception of reality and impairs their ability to make rational decisions. Of course everyone must be held responsible for their actions, but our legal system is designed to take things like psychiatric diagnoses into consideration and to provide all reasonable opportunities for de-escalation and rehabilitation before imposing a jail or prison sentence. It may seem ridiculous but it's the way it is.

    This is why I eventually almost gave up fighting my stalker. I was lucky enough to get away, but it took YEARS. Everyone assumes stalkers look or act a certain way, but, like in this case, most stalkers are great at playing the victim and/or charming their way out of trouble. EVERYONE in my life thought my stalker was romantic and sweet...except me. He was EVERYWHERE. He even managed to get hired at my job after my boss told me I was overreacting the 3 times my stalker's harassment scared and angered me enough for me to want to file a police report. I begged everyone in my life to keep him away from me. No one listened. So frustrating. So terrifying. But I'm ultimately stronger because of it. It taught me I had to be my own hero. I sincerely hope this jackass eventually gets some real consequences for harassing that poor girl.

    He absolutely knows what he's doing, he is capable enough to come up with a strategy for evading law enforcement, get high marks in school, and hold down a job. The claims of mental illness are just his way of gaming the system. There is no reason he shouldn't be held legally accountable. The criminal justice system lacks understanding of how a stalker's mind works, they are not sad, lovesick men who act uncontrollably out of mental illness. Rather, stalking is a deliberate effort to control the victim's life through fear and take away all their happiness. They don't view their victims as human beings, more like objects to possess. He knows what he can get away with and even if he does not physically harm her, he will keep toying with her and making her life miserable until he's dead or locked up. Her peace of mind is so much more important than making excuses for this guy so he can keep living out his disgusting power fantasies. Honestly somebody should put a hit on him so this poor woman can get her life back. :(

      It is very simple to get people's phone numbers without their permission. You just need to know the provider. Once you figure that out, the only info you need are last names and date of birth. Then after a few failures of figuring out who's name the account is under, you hit the jack pot and can dig through the account info. As long as you wait a couple days in between attempts, no one will be the wiser.
      It sucks, but it is that easy. Think of it this way... how easy is it to access your bank information over the phone? All you really need is your social security and date of birth confirmation (unless you put a password on the account, which EVERYONE should do) to check the balance of an account.

    I went to a psychiatrist and said, I am crazy. He looked at me and replied, no, you are not crazy, I made this statement again, yes, I am insane once again; he stated no, you are not crazy. Then I said, how do you know that I am not crazy? The doctor replied to me, crazy people do not know that they're crazy. I believe what the doctor said, I come from a very long line of mental illness in my family. From schizophrenia to bipolar disorder, borderline personality disorder, social anxiety, clinical depression, the gamut goes all the way to schizoaffective. No one in my family has ever stalked anyone. No one in my family has ever murdered anyone. Even when they were not in their right state of mind, they never harmed another person.
    Crazy or not, we all need to be held accountable for actions. This man should have been found guilty of a felony and then sentenced to a mental institution. So at least they could have it on record that he is a known felon, crazy or not. Emma, you should sue your highschool. Hold those accountable to a higher standard. Take actions against the police departments; most of all, Emma do not let this man take your life, your freedom to live a happy life. It is so sad 8 years of your life have been stolen because of a narcissistic, manipulative human being. He may have a mental illness, however, he has shown that he does know right from wrong. The school knew what he was doing was harmful to you. They did nothing, WHY?, because he was more important than you, WHY?, because of his music and math abilities. SAD!!!!!!

    It sounds like a lot of his exchanges with her were through social media and Facebook. Why didn't she disable her account until the guy was taken care of or moved on?
    If you're being stalked, Facebook is THE LAST place you want to have any activity. People flood to Facebook to show off their life, which typically means your best pictures, your best moments, where you hang out, who you're with, what you're wearing, where you're going...
    People spend incredibly too much time on Facebook and volunteer tons of personal information. It's a stalkers lifeline.

      Why should she disable her accounts because of one person.? Social media is literally about socializing..so she shouldn't be allowed to do that because she's being aggressively stalked.? No.. she shouldn't have to change a thing. She didn't ask for this. Now, what needs to happen is he needs to be held accountable for his actions before he physically harms her.

    The CFP (Center for Forensic Psychiatry) is like a jail and psychiatric hospital combination. When I worked on the State Hospital side of this facility, the patients that were NGRI (not guilty by reason of insanity) were sent to court on a regular schedule. When they were found to be competent, they then stood trial and were either sent to CFP if they were still psychotic or jail if they were considered free of psychosis to serve their sentence. I know things in this world have changed, so I am not sure if that is how it still works or not.
