. Thanks for your nice explanation. I would like to add the following information also. The first Act passed in 1955 was only for the Durgaha of Kawaja Moinuddin Misti in Ajmeer . In 1995 new Act was passed covering Waqf properties of all states except J&K . In this Act it is clearly specified that a Waqf deed should be maintained by the Waqf Board related to the property donated by the owner as Waqf for charitable purpose. It is the duty of the management committee to verify the ownership of the property and should be convinced that the person donating the land is the genuine owner based on the land revenue records . According to Islamic Scholars only immovable property should be offered as Waqf and not movable properties . Therefore the Waqf Board should produce the Waqf deed signed between the person who donated the property as Waqf and the Waqf Board . There is a prescribed Application Form to be filled & signed by a person donating his property as Waqf with copy of the documents proving his ownership of the land . Since Waqf Board should maintain Waqf deed & the application filled by the person donating the property before two witnesses, exempting Waqf Board from producing the documents while making a claim on a property as Waqf property has no legal standing . In India donating land as Waqf is very rare . Usually properties are purchased for constructing worship buildings & establishing educational institutions. Mere procession of a property by a person following Muslim will not become Waqf if he sell his property to a third person . As per Indian Constitution , Supreme Court is the apex body for issuing verdict of a property under dispute. If Waqf Board is placed above Supreme Court, it is anti constitutional

വഖഫ് സ്വത്ത് എന്ന് പറയുന്നത്, ദൈവമാർഗത്തിൽ സ്വന്തം ഇഷ്ടപ്രകാരം റജിസ്റ്റർ മൂലവും, പഴയകാലത്ത് വാക്കാലും സമർപ്പിക്കുന്നതാണ്.
ചില സ്ഥലങ്ങളിൽ ഇതിൻറെ ഭരണം നടത്തുന്നവർ ഏതെങ്കിലും തരത്തിൽ അന്യാധീന പെടുത്തുകയോ, സ്വന്തമായി അതിലൊരു ഭാഗം കൈക്കലാക്കുകയോ ചെയ്യുമ്പോൾ ആ മഹല്ലിൽ തർക്കം ഉടലെടുക്കുകയും അതുമായി ബന്ധപ്പെട്ട് കേസ് പോവുക സ്വാഭാവികവുമാണ്.
ഈ വിഷയത്തിലാണ് വഖഫ് ബോർഡും കോടതികളും സിവിൽ നിയമപ്രകാരം ഇടപെടുന്നതും രേഖ പരിശോധിക്കുന്നതും.
ഇത്തരം സന്ദർഭത്തിൽ ഏതു വ്യക്തിയാണോ വഖഫ് സ്വത്ത് കൈവശപ്പെടുത്തിയത് അവരാണ് അവരുടെ സ്വത്താണെന്ന് രേഖ മുഖേന തെളിയിക്കേണ്ടത്.
എൻറെയും നിങ്ങളുടെയും പേരിലുള്ള സ്വത്തുക്കൾക്ക് എല്ലാം രേഖയില്ലേ...
ഒരു രേഖയും ഇല്ലാതെ വക്കഫ് സ്വത്തും, സർക്കാർ ഭൂമിയും, ദേവസ്വം സ്വത്തുക്കളും ഇതിൽ വിളിച്ചു കൂവുന്ന ഈ മഹാൻ അടക്കം ആരെങ്കിലും കൈവശപ്പെടുത്തിയാൽ ആരാണ് അവരുടെ ഭൂമിയാണെന്ന് തെളിയിക്കേണ്ടത്. ഒരു രേഖയും ഇല്ലാതെ ഭൂമി കൈവശപ്പെടുത്തിയവർക്ക് കൊടുക്കണമെന്നാണോ ഇദ്ദേഹം പറയുന്നത്.
കാര്യങ്ങൾ കൃത്യമായും മനസ്സിലാക്കിയിട്ടും കേവലം വർഗീയത മാത്രം വിളമ്പുന്ന ഇവരെ പോലുള്ളവരെ മതേതര സമൂഹം ശ്രദ്ധിച്ചാൽ ഐക്യം നിലനിൽക്കും.

Good question. The waqf act came into force only in 1954. But the cases relating to babri was on record of the civil courts even before 1954. Such cases were outside the jurisdiction of waqf board.
