U didnt mention that in english mortgage, the mortgagor tranfers the mortgaged property absolutely to the mortgagee nd the mortgagee hv to re-transfer it to the mortgagor upon payment of the mortgage money.

As per section 58(f) of the Transfer of Properties Act, equitable mortgage can be created by deposit of documents of title to immovable property with intent to create security thereon with the Bank. It means the document which creates title and confers right, interest and ownership exclusively on the title holder in rem like Sale deed with all their different names, Gift Deed, Will along with probate etc.. Family settlement ar:id family partition does not creates any such exclusive right, it is merely distribution of inheritance right among the successors mutually. kindly guide us in this matter, so that EM can not be created on Partitioned deed, is it valid,

Kisi Land(Property) k 2 owner hai, wo Bank se Mortgage loan me us land per House banaya hai... ye dono Owner me se ek hi owner EMI pay kar raha hi continue.... ab dono owner apsi sahmati se chahte hai ki property owner sirf 1 hi rahega is case me Property trasnsfer kaise hoga (Mortgage loan active hai, Bank se) kis act, section k under hoga

I have a doubt - Why 'loan' and 'debt' are separately mentioned as consideration of the mortgagee in s 58(a) TPA? Is 'loan' an entirely different thing from 'debt' in this context? Can you give any examples for explanation? Best regards
Yes there is a difference. Loan is basically from Banks or Financial institutions and Debt is from individuals.
Debt is a wider term which includes Loan. Also Debts can be raised through Debentures, bonds etc. Thin line of difference.
