While Cardinal Becciu has been sentenced to five and a half years imprisonment, he has lodged an Appeal against that conviction. I assume that, under the Laws of the Vatican City State, he will remain at liberty pending the outcome of that Appeal. It is unfortunate that the Laws of the State of Victoria were not so accommodating in the case of Cardinal Pell. After being sentenced at the original Trial, he was sent immediately to prison. Then, every delay possible was introduced by the authorities in Victoria to try to delay his Appeal there. At the Hearing of his Appeal in Victoria, two of the three Judges sitting on the Appeal gave perverse verdicts. Fortunately, the third Judge was honest and refused to participate in the intended travesty of justice, so the case was able to go on to the Federal Court. There, all seven Judges took one look at the evidence and declared the verdict unsafe and ordered Cardinal Pell’s release. However, he was obliged to spend almost four hundred days in prison for a crime which he clearly did not commit and which the authorities in the State of Victoria knew he did not commit. So, while the way in which the Vatican City State is governed might be corrupt, it pales into insignificance when compared with the corruption in the legal system in the State of Victoria.

Having followed the case against Cardinal Becciu, there does not appear to be any definite evidence that he profited personally from the poor investment decisions which he made. If he has, in fact, been imprisoned for five and a half years for nothing more than incompetence, then that would, of course, be a matter of grave concern. I did read, at the time, that the case appeared close to collapse at several times during his Trial, and the Pope was obliged to intervene, in his capacity as autocratic Sovereign of the Vatican City State, to change the Law (or Rules of Procedure) as, otherwise, the case would have collapsed. If the reality of the situation is that Cardinal Becciu was no more than incompetent, then, of course, the responsibility for the financial loss would rest not with him, but with the person who appointed him and entrusted him with a task beyond his professional competence, that is to say, the Pope. Clearly, it would be impossible for the Pope to have accepted responsibility, so it was necessary for Cardinal Becciu to become the “fall guy” to deflect any criticism from the Pope. The Pope, of course, is beyond the reach of the authorities in the Vatican City State itself - as autocratic Sovereign ruler he can simply refuse to answer any criticism. If it were to be established that an offence had been committed by the Pope where the place where the offence was committed was outside the borders of his own sovereign territories, then, of course, he might be extradited. However, it would be too politically damaging for the Republic of Italy to attempt to extradite the Pope.
If Cardinal Becciu says "Cardinal Pell authorised the transfer of money to Australia", then he needs to show proof of that aithorisation with his signature approving it. This is not just a nod and a wink game. It's big money and nobody is going toauthorise that without official signed documentaion.
From what Cardinal Becciu says, he admits that the funds which were invested in the London property were not funds forming part of the Patrimony of the Apostolic See, but were the proceeds of the Peter’s Pence collections. The nature of these funds is very different. The Peter’s Pence collections are intended to be used by charities which assist the poor and needy. The funds representing the Patrimony of the Apostolic See are entirely different in nature. They arise from the desire of Mussolini’s Government to regularise the status of the former territories of the States of the Church. Pope Pius IX refused to abdicate and so did his successors. As a result, the claim by King Victor Emanuel III to the former territories of the Papacy were subject to question. Mussolini wished the Pope to formally abdicate in respect of his former territories and he offered an enormous sum to the Pope as compensation for the loss of his former territories. So, by the Lateran Treaty of 1929, Pope Pius XI abdicated and received the agreed sum by way of compensation. As it happens, this settlement was not so generous to the Papacy as that offered by King Victor Emanuel II to Pope Pius IX, who was offered a much larger area of Rome as his own sovereign territory and a much larger sum by way of financial compensation. So, by holding out, the Papacy did not, in fact, improve its position, although Mussolini was, of course, one to drive a hard bargain!. It is this compensation which represents the origin of much of the Patrimony of the Apostolic See. So, the gifts of the Faithful by way of Peter’s Pence are not part of this fund. I think that it was the 25,000 Euros sent to the charity in Sardinia of which his brother was the President which was part of the Peter’s Pence fund, however, as Cardinal Becciu explains, this was, in fact, a charitable purpose, a local co -operative, so would have been a suitable recipient for funds from the Peter’s Pence collection.
