I have not seen anything from you that looked like defamation--almost everything out of your mouth is either a question or an] invitation to dance, join you at the piano, etc. You were letting the video speak for itself--which the Pinks could not do since they were trying to invent a false story that you 1-inappropriately touched her, 2-you damaged their flags in a way that is illegal in China, 3- you monopolized the piano and refused to let them use it (since it was just a matter on minutes, this boils down to saying you were at the piano, they wanted it, and you refused to leave and let them film "confidential" messages to clients LOL), and 4- they accuse you of racism based on you asking them if they were Japanese (you have film of the blues man telling you they were so the confusion is understandable and nothing like racism--which is not technically illegal anyway to my knowledge--you are not hiring them or anything, and you said nothing derogatory about their race, just their behavior towards you!). On the other hand, the "influencer" who misrepresented the law and lawsuits, actually IS lying about you and your behavior, and clearly her intent is to destroy your business opportunity live-streaming these events. THAT is illegal. She says on her video (I hope people recorded it) that your use is "commercial" therefore illegal. She admits her own activities were under contract so presumably commercial as well, but somehow legal for her, just not for you. You simply sit and play, with the camera running--lots of people do that around the world. She showed up with a dozen people, a contract and props--far more of a commercial activity and one that would require a permit or license here in the US. You, on the other hand, are exempted from permits, etc by the law granting you permission to use the the piano and film in parks and train stations. That law says they want to encourage interaction. YOUR kind of interaction--joyous sharing of music and dance by disparate peoples in chance encounters in public places--exactly as stated in the law. I hope you find an attorney--one of the bloggers who covered your encounter there gave a beautiful rundown of British law, has a GF in law school--they should be able to refer you to a British ACLU? In any western court if the CCP persons were to attempt to take legal action against Dr.K, I believe that their case would be laughed out of the courtroom and the publicity surrounding the incident would be enough to make the CCP look and feel so embarrassed that they would want to totally seal there boarders against their own people wishing to leave their own country and to cease trading internationally in all fields of commerce. The permission of Chinese students to go abroad to study and gain qualifications and experience would be withdrawn and they would have to face being the most derisively peoples of this planet.
I'm not convinced a permit is required for all commercial use. The filming in this case is in public and this specific unexpected event incidental and there is no contract in place for the purchase of the RUclips footage and no guarantee of any income for the footage. It could be argued that the videos are primarily for entertainment purposes of sharing Brendan's passion for the piano and that any commercial gain is incidental. I wouldn't necessarily be relying on police advice to get the correct interpretation of law on this topic either. We know what reputation some of them have in regard to correct interpretation of law. Not all of them are properly up to speed on all laws and they can't be expeted to be, however don't assume they are correct either. If everyone is to be held equal before the law, then everyone else filming inside the station and putting their VLog online would also be required to seek permission and administering that with impartiality would be quite impractical. In terms of filming in shopping centres, it could be argued that permission is implicit, becuase lots of people film there and people are not being aprehended for doing so. Thus a public norm has been established for this shopping centre, being part of the station's surrounding infrastructure. Brendan also has a case of him being verbally threatened by verbal intimidation ( i.e. angrily shouting at someone to cause fear ), which can be deemed a criminal act in the UK.
Forrest Gump did the same thing when his Jennie was touched by strangers, and actually punched those guys. You don't need the law to grant that request to exclude their images when they requested so, it shows the basic respect to another human being and their equal human rights. Escalating to labelling someone as CCP forcing some rules upon you is completely unnecessary and insensitive.
He did not need a permit--the law allows use of train station s and parks for these artistic expressions and interchanges--it wants to encourage them because no one has a reasonable expectation of privacy there. Brilliant! It shows that Dr. K is super friendly, kind and helpful to everyone who enjoys music. He doesn't "hog" the piano as accused by little pinks and is happy to share and collaborate with anyone interested, regardless of their gender, age, race or nationality. It's pure joy to experience art without any dirty politics involved. Whoever tries to sue him should be laughed out of any court-room and be responsible for all costs of BOTH sides.
While I don't wish the stress of a court room on anybody and certainly not on a really nice guy like Dr K, I almost WISH they would take him to court, just to see them lose spectacularly. There are many law firms I am certain would take up such a high profile case pro bono on Dr K's behalf, but again I'm sure Dr K has better things to do than go to court rooms. At the end of the day the little pinks are posturing and blustering and will back down. Especially when one of m'learned friends gives them a detailed breakdown of his fee structure and his hourly billing rates. There are former Russian billionaire oligarchs now foraging in dustbins after an encounter with England's silks and courts. If the Beijing bosses drop Ms little pink a line saying by all means take Dr K to an English court of law, but don't expect us to foot the bill. You're on your own. If she has any sense, she'll pipe down.
Courts are huge money pits. Donald J Trump started with $ 120,000,000 presidential campaign war chest, the biggest in United States political history. After his various civil cases he's now down to his last $ 5,000,000 and there are STILL cases pending. Courts should be avoided where possible.

In any western court if the CCP persons were to attempt to take legal action against Dr.K, I believe that their case would be laughed out of the courtroom and the publicity surrounding the incident would be enough to make the CCP look and feel so embarrassed that they would want to totally seal there boarders against their own people wishing to leave their own country and to cease trading internationally in all fields of commerce. The permission of Chinese students to go abroad to study and gain qualifications and experience would be withdrawn and they would have to face being the most derisively peoples of this planet.
I'm not convinced a permit is required for all commercial use. The filming in this case is in public and this specific unexpected event incidental and there is no contract in place for the purchase of the RUclips footage and no guarantee of any income for the footage. It could be argued that the videos are primarily for entertainment purposes of sharing Brendan's passion for the piano and that any commercial gain is incidental. I wouldn't necessarily be relying on police advice to get the correct interpretation of law on this topic either. We know what reputation some of them have in regard to correct interpretation of law. Not all of them are properly up to speed on all laws and they can't be expeted to be, however don't assume they are correct either. If everyone is to be held equal before the law, then everyone else filming inside the station and putting their VLog online would also be required to seek permission and administering that with impartiality would be quite impractical. In terms of filming in shopping centres, it could be argued that permission is implicit, becuase lots of people film there and people are not being aprehended for doing so. Thus a public norm has been established for this shopping centre, being part of the station's surrounding infrastructure. Brendan also has a case of him being verbally threatened by verbal intimidation ( i.e. angrily shouting at someone to cause fear ), which can be deemed a criminal act in the UK.
Forrest Gump did the same thing when his Jennie was touched by strangers, and actually punched those guys. You don't need the law to grant that request to exclude their images when they requested so, it shows the basic respect to another human being and their equal human rights. Escalating to labelling someone as CCP forcing some rules upon you is completely unnecessary and insensitive.

He did not need a permit--the law allows use of train station s and parks for these artistic expressions and interchanges--it wants to encourage them because no one has a reasonable expectation of privacy there. The want people to enjoy music, art, and meet each other. THAT is British law on the subject~!
