Restaurant Calls Police For Filming On A Public Sidewalk! First Amendment Audit

  • I decided to re visit Old Town Tustin to capture some video & images from the pubic sidewalk just outside a local Italian restaurant (link to my first visit a few months ago is provided at the end of this video) . Shortly after , the manager approached and wanted to know why I was taking pictures . I had a couple encounters with a couple of patrons who decided to approach my camera, one of them wanting to know apparently if I was a "boy or girl" & the other one demanding I turn off my camera. 2 officers from the Tustin P.D. arrived on scene & eventually educated the Management that i was within my rights to be filming, Kudos to these officers for respecting my first amendment right although one officer tried asking for my I.D. & got denied.

      It’s perfect advertising ! But most places have a sign that let their guest know they are filming and have special seating away from the cameras so they don’t feel uncomfortable. That’s the difference.

    I thought the police did a terrible job. They should have told her you have every right to be there and left. There was no reason to talk to ,you, ask for ID or ask if you had a reservation at the restaurant

      Imagine a business that wasn't interested in what you were weirdly doing outside their premises and to their customers.... I agree the guy has every right and I have given him a thumbs up, but I also was in business most of my life and the the first thing I would do would be exactly as the owners of that business have done on this occasion.
      Secondly the guy didn't want to go in as then he could have been arrested and/or trespassed on private property... he was only there outside at a private business to upset people, get the cops called and then prove his point..

      ​@@steviewonder8624 Incorrect - he would have gone inside,. Other places have invited him in before and he gladly goes inside, takes a look around, and has a cordial conversation. This auditor has posted videos showing just that which is why he is one of the good ones.
      No issue with the business owner coming out to see what's going on. That's called being a good neighbor! If people call the cops though just because of photos then they have misunderstood the purpose of law enforcement. They're the reason that when seconds matter the police are only minutes away.

      @@pipingkid What"s the point of going inside? Even if he is invited in, He cannot film the restaurant clients in there.....that is where they do have rights.!!!
      The whole point is to do an audit... you can't do one inside a private business. The best you can do is stand on the sidewalk, upset the clients and management, so that the cops come and then you get your audit. In general, I don't agree with private business audits....go attack the public employees at their work, at least they are paid by the public.

    A real cop, good for him. His partner should probably take notes. Terrific audit, the restaurant owners were educated by an upstanding officer.     A lot of cops in California have been educated over the past five years (although apparently not in San Diego). You should try auditing in Texas sometime. There are lots of cops there who think they ARE the law.

    Getting people comfortable with being filmed at any time is a challenge, even with people you know. The real challenge is getting cops to understand the Constitution and hopefully, the people will learn not to call, especially 911.

    If that restaurant doesn’t want to be filmed, or photos taken of it, then build a giant brick wall around it, so nobody can see it from anywhere and then call up Google maps because you can see it from there too

    How great is it to hear a cop confirm that public photography is not a crime instead of a cop arriving on scene and feeling obligated to satisfy the snowflakes and bully,, badger, and berate a public photographer? Before First Amendment auditors enlightened cops, many would assume that they were required to treat a public photographer as a criminal. No more, thank to First Amendment auditors. I'm grateful. ❤

    We got a call so we are going to see what they want done. Did he really say that? How easily distracted the customers are, and why, because they have such a shallow existence with no meaning so they get easily irritated. A restaurant of the wobbly walking dead. The real offender is all the lard being tossed about when they move. Cops are total pros though, no directives at all.

    to be open 60 yrs in the restaurant business is a huge achievement. most restaurants fail soon after opening. my son started a restaurant in Frankfurt, W. Germany. i attended Jr HS there. his mom sent some jazz tapes he could use. One day a customer came for lunch. after she left a customer told him she was the foremost food critic for the Frankfurter magazine, his place made top 10. she mentioned she liked the music. He became overbooked after the review. His R advertised california cuisine. that could be anything. mexican was popular. chinese was 2nd. then italian.

    I love that restaurant. I'm happy the management is aware of the law with your professional approach to the subject.
    The officers involved were amazing! Even though their awesome behavior is expected of all peace officers, they are not the majority. I applaud those officers in maintaining excellence with their code of conduct to the public, regardless of feelings.

      I've eaten there before myself. Great food , nothing against them . That's all it is about , bringing awareness to the community. So far all my interactions with the Tustin P.D have been handled in a professional manner 👮⭐👍

    I really love your work. One of my favorite auditors out there. The only thing I don't get is, telling cops that you have no ill-will when they didn't ask you anything about that. And also thanking cops for being professional when they were just professional by telling you that they will talk to you after they figure out what the other party wants to have done with you. While you are on the side of the road by the way. You don't call that cop professional. Thanking him for being professional! This is the only flaw that I see with some of my favorite auditors like yourself.
    Absolutely adore and love what you do though ❤️

      Simply reassuring them I'm not there to so any harm ...some cops like to use the narrative that photographers who typically record buildings are planning an attack ...thats all that was meant by it ...thanks for the viewership Glen

    The cops should know filming from a public sidewalk is legal. They should have educated the restaurant, and they should never even have engaged the auditor.

      That pretty much ends the moment you leave your home . there are exceptions of course, in certain places

      @@FirstAmendmentRights the only exceptions are private property that you can't see from a public location therfore you'd have to enter private property to film those hidden locations and restricted access areas of public places. The rest is fair game

      Exceptions are also locker rooms , dressing rooms , public restrooms ..there's a level of privacy in those situations as well
