We need "Dylan's Law" - a law that protects children who voice their opinion that they don't wish to spend time with a parent, who may be abusive. Dylan didn't want to spend time with his Dad.
If Dylan would have been allowed freedom of choice not to visit his Dad, he would possibly still be alive!!!

I agree. When my kids didn't want to go with their dad (I had found out so much during our divorce the kids never told me) I kept them in the house even though my lawyer told me I would be violating the court order and could be taken to jail... Take me to jail. My kids are not going. They are older now and still have nothing to do with him. This really does need to be a law.

Even if there isn't a threat of abuse or murder, I would think it would be very psychologically damaging to force a child to be around someone they are scared of or uncomfortable with. The well-being of the child should always be paramount in these decisions, not just the feelings of the parents.

Kids need to be listened to and it should be investigated when they don’t want to visit the other parent. However, it’s not that simple because it could be the rotten parent that’s successful in alienating them from the good parent. Then you have a case of the kid being removed from the good parent who now has no chance of maintaining that relationship. It gets messy. It should definitely be investigated though.

There should be no contact at all, if the child does not agree to it. If they later on, actually & for real, want to have contact to that parent again, for whatever reason, guess what - they can STILL change their mind but didn't have to go through all that additional trauma ffs.. Social worker in CO here, unfortunately this would be difficult to accomplish. Parents have visitation rights according most states statutes and even though there are definitely concerning parents out there, a state can’t withhold that right unless the parent has displayed ongoing instability or violence. It’s not a perfect system at all but if the courts allowed children to decide under any circumstance, there would be many parents who don’t get to see their kid’s for unjust reasons like: “Sally said her dad doesn’t let her stay up late so she refuses to go”. They definitely need to look into cases one by one, but the system is too underfunded :(

Except that's not how it happened. There was no indication - to the court - that the father was unstable or violent.
It's very easy to make this strawman argument in hindsight but the fact of the matter is in the majority of cases children don't turn up dead. Often there can be bad blood because of a messy divorce which biases children towards one parent or the other and has reflects in no way on their parenting skills/love of their child and the child goes on to have a positive relationship with both parents. Also you're forgetting that often in situations like this one parent can poison the child against the other.
Then there are other considerations, does the child not want to visit the other parent for superficial reasons? (maybe one parent is wealthier and has more 'fun' things like computer games/cars/pools etc). What if one parent is just stricter and the other lets them get away with bad behaviour?
      It's a complicated issue.

However, it really bothered me when it was revealed that he was the one that found the pictures on his dads laptop and then showed Dylan. Obviously that made him hate his dad more and he chose not to go see him. I wish that for kids who didn't want to see a parent, that judges would take this into account. I understand that parents may try to bias their child against the other parent to try to get sole custody, but if a child says they don't want to go then it should be supervised visits instead of sending the child alone (especially if said parent has a history of abuse). Boggles my mind that kids are so ignored in favour of the parents when the kids are the most vulnerable of the two.

I know he was 18 but if he was living with the mom she should have absolutely forced him to go or at the very least stay in town. Of course a child should always have the right to two safe parents when available - but is it a human right to get to parent a child just because they happen to be biologically yours? Now, nearly 10 years later I’ve seen cases like this play out in real life, outside of the textbooks and law exams and I still strongly feel that in order to protect the rights of the child, more emphasis should be placed on the child’s preference and reasons for not feeling safe with a parent or a legal guardian.

IMO if a child hates their parent THAT much- that should be taken for consideration in custody cases. A child shouldn't be forced to spend time with a parent they can't stand being around. That's not ok. Especially if the other parent's home is safe and happy and they enjoy being there.

Exactly. Parents seem to think they own their children.

Exactly he was obviously very fearful of him & begged not to go. What a horrible situation for the mother to have to send him. And then the horrific way he died. This story haunts me. I love my children so much. Whosever “made” that court order should be partly held accountable to imo. That poor child thinking of the terror haunts me.

I just want to know where he got it. Not that it would have been any better, but he didn't have a baby. He would have to go out and actively seek one.
