कोर्ट यह कह दे की वकील की वजह से केस खारिज हुआ तो। उस वकील से दी गई फीस की दस गुना वसुली क्लाइंट को मिले ऐसा कानून होना चाहिए या फिर वकील की वजह से कोई केस खारिज हो रहा है यह कोर्ट जानती है तो तुरंत उस केस को बहाल कर देना चाहिए।

मतलब होना चाहिए क्योंकि किसी पिटीशनर को सपना नहीं आयेगा कि जो वकील वो कर रहे हैं वो उनका केस चौपट कर देगा। बल्कि ऐसे में तो जज को पिटीशनर के प्रति और भी संवेदनशील होना चाहिए।
जज का एकमात्र उद्देश्य होना चाहिए हर हाल में दुखी और पीड़ित को न्याय दिलाना।
जब कभी भी कोई केस किसी अधिवक्ता की लापरवाही के कारण खारिज हो जाए या फिर क्लाइंट को न्याय न मिले तो क्लाइंट उसकी शिकायत बार काउंसिल ऑफ द स्टेट या फिर बार काउंसिल ऑफ इंडिया में कर सकता है
You are talking nonsense.There was no urgency in the petition, yet this lady chose to appear herself and argue when lawyers were abstaining from work. Had she not appeared, then her case would have been adjourned like all other cases. Heavens would not have fallen if case got adjourned but clients like her who do not heed what their lawyers tell them and play oversmart, deserve this fate. Even in the beginning when she began arguing her case the judge warned her that if she opts to argue her own case in the absence of her lawyer then he will not adjourn the case, yet she persisted in arguing. She destroyed her own case, and deserved what she got.

20 August 2008 appointment letter issued & was supposed to join work... She did not join & after 12 years she woke up.. Right judgment given.. Also the lawyers deserve to be jailed for leaving the client at the crunch movement...
Not at all......appointment letter was issued but she never had the knowledge about it and she never got one through post or anything like that.......when she got to know about it then she filed a case for her rights...I can be wrong as there must be more facts related to this but she failed to explain her point thoroughly to the court due to her advocate.The notice of contempt by the lordship was 100% right as due to these advocates, their clients suffer....
वकीलों को विशेष सुरक्षा का कानून चाहिए जिससे कि वो और मनमानी करें और क्लाइंट कुछ बोले तो उस पर भी जुल्म करने की छूट मिले
Vakil ab khud criminal ban gaye hai..advance fees vasul lete hai..fir man mani karte hai..negligency rakhte hai..fon nahi uthate, ham kuch keh nhi skte unka ego hurt hota hai to case chhod dete hai paise vapas bhi nahi dete. Koi vakil to only time leta rehta hai case kharab kar ne k liye.

The Honorable Judge has given the right judgement following the law.
1) The lady was not aware of the facts of her own case.
2) She could not explain, what was she doing for 8 years.
3) It appears she wanted to play emotional and women's cards which won't work at the high court.
4) Generally some people feel overconfident and appear PIP (party in person), hence they also ask their lawyers not to appear for the matter. Such things backfire.
Your point No. 3 is the most valid one. They want to play that card first.

शर्मनाक निर्णय। जज महोदय ने शिकायतकर्ता को वकील की अनुपस्थिति में अपना पक्ष ठीक से रखने का अवसर ही नहीं दिया। इन महिला को विभिन्न निर्देशों के साथ अपने पक्ष रखने के लिए अगली तारीख दी जानी चाहिए थी।
बस ऐसे ही न्यायपालिका निर्णय लेती रहे और शीघ्र ही लोग कोर्ट का मुंह देखना बंद कर देंगे। शिकायतकर्ता को संबंधित वरीय के पास रजिस्टर्ड डाक से स्वयं को उचित अवसर न दिए जाने की शिकायत करनी चाहिए। जो न्यायपालिका पर विश्वास रखते हुए उसके दरवाजे पर जाए उसको वकीलों के हांथ का खिलौना नही बन ने देना चाहिए।

People who are saying that judgement is wrong then just know that you got fooled by your emotions. If you think from logic you can see why judge passed the judgement.

The law is very much clear that impugned order can be challenged within period of 1 year. Its well settled that person cannot sleep over his rights. People in India still hesistate in moving to the courts. If contract employee approaches to the court, the authorities decline to extend their contract

We do not know what happened and She has the right to sue the advocate in case he failed in his job Probably he was not paid his fees. In any case the problem is the lobby which defends such lawyers. We do not want to fight the lobby but we want to fight an individual. Until the whole lobby is punished no individual would be.

One who has to take job should be proactive. Probably she did not wanted to joint at that time and now creating ruckus with 12 year old order. Till 12 year she was in deep sleep, with not with even single correspondence with authorities. And seeing the job of medical/paramedics, which is highly medicolegal and involve so much of documentation now a days , she is unfit for that job.

The petition should not have been dismissed, and amicus curiae must have been appointed to assist the court and the petitioner. Justice should not have been denied just because a lawyer missed the hearing of the client.
Our legal system is sometimes not practical. Justice should be given even when not requested. A person should not have to take efforts to get justice. We have a very stupid justice system. Shame on us that we have failed basic logic.

@@raghavuchil2098 Let me explain to you what non sense I am talking about with a caveat that my comment was not made specifically for this case but it was a general comment on the state of affairs of legal system of our country.
A person who is already struggling and lacks funds and knowledge of legal system is forced to hire a lawyer and then that lawyer fails to do his job completely. The lady may or may not have won the case, I am not going into the merits of this case but the mere fact that she has no idea what's happening simply because her lawyer failed her and now she has no chance to get justice (either in her favor or against her) is problematic. My issue is with the fact that justice is easily available to rich people who can hire expensive lawyers but not to a middle class person or poor person who are even scared of going to courts.
A person has to suffer so much in getting justice that most of the times people are not even able to claim their basic rights.
Also simple procedural compliances should not cause trouble to people but what we see is completely different. Equality is important and we seldom see such equality in our justice system.
@@mickeyagrawal2001 well it is true that her lawyer failed her and because of that the court issued contempt notice to the lawyers. But there is another side to this, after all this is her case, she is the party and its perfectly fine for her to not to know the law, but it can very well be expected that she at least know the facts of her own case. The judge repeatedly asked her to represent the facts she couldn't even say how she was wronged or at least the very incident from start to finish, he even asked specific questions, but she couldn't even answer those. The judge also gave her husband a chance to argue but the husband seemed pretty reluctant, so it will be very wrong to say that the legal system failed her.

@@rupaksanyal1309 What you are saying is completely logical but sometimes people are not able enough to do things which may appear very basic to us. We can both agree that she genuinely believed she was wronged and that she must have been aware of the issues and facts but she still failed to argue those which means that for whatever reason she was incapable to stand in the court and argue her case. For example should we deny justice to a person simply cause they are not intellectually smart enough to answer basic factual questions ! If she had more money and could hire a bigger lawyer perhaps she might have even won the case. This differentiation shouldn't be there in the field of law and justice. But my comment was also made considering general state of affairs. People guilty of high level crimes are being given bail or are being allowed to go free simply cause the state attorney is either corrupt or the guilty person is able to use the weakness of the system to get himself out of the mess. Most people believe that system is more supportive of criminals than victims and no one can blame these people either. Its indeed hard to get justice.
