    A contract should be Something formally Binding (Something Like through pattern use or firm handshaking so that the PROMISE is seriously taken) say the offer ist accepted as both Parties agreed on that Type of specific Exchange in Common Sense say both Parties understand what they buy Into and agreed on the specific price for that Type of PROMISE in Common otherwise IT IS not a bargain or legally Binding promise and IT would rather be considered AS a favour instead. ITS all about understanding the very Nature of the MUTUAL PROMISE EXCHANGE on your Part. If you dont know what you are buying into at all so IT IS nonsense. IT must be Something specific, in Common and also formally Binding between the Parties in Order for Them to enter into a legally Binding contract. For example, no contract is created If you Just View a porno Site on the Internet with unknown characters in play and have No understanding of what you are into and havent paid for It. ITS rather a favour or No bargain at all.

      Yes, marriages are considered contracts. They also fall under what is known as the statute of frauds which in order to be enforceable at law must be solidified in writing as a completely integrated document. A marriage license will suffice. Any prenuptial agreements also have to be in writing in order to be enforceable at law in a marriage situation.
