A judge can't make a judgement unless he's heard the case. This principle goes back thousands of years to ancient law codes. What this judge is trying to do is to get the litigants to present their claims in proper legal form so that the court can judge the the claims in accordance with the law. If one or other of the litigants fails to do this, I think the judge can refuse to do the impossible. He 'throws the case out' - unheard, probably charging court costs against the litigant(s) who failed to follow the court's instructions by presenting their case in legal form. Cue a round of appeals and more of the litigants' money wasted when the appeals are in turn rejected.
Question for Daniel....is it possible for citizens to join together and file a class action lawsuit against the judiciary for continuing to allow frivolous lawsuits by an entitled person? For it is now the courts that are allowing these never ending frivolous lawsuits to clog the courts and continue to cost the taxpayers. Barristers and solicitors are fully capable of dragging cases on indefinitely irrespective of what the issues are. If the argument was over the shade of orange on a tangerine I am confident the ability is available to argue legal arguments for 100 years absorbing millions of pounds. Now, the ordinary man in the street finds this level of ability disgraceful and not promoting fair and efficient application of justice. The courts need to take a lead in making the court procedures and litigation faror efficient and have maximum time scales and maximum costs incurred. The system is not fit for purpose?
Clients should always be warned by their lawyers about litigation risks but if the clients are determined to continue and the lawyers' advice has been confirmed in writing, they do so at their risk.

But this is a civil.case and Prince Harry has to pay his own costs...unless the judge awards his costs to be paid by the defendant. He is bringing this case as a private citizen and his costs will not be covered by the taxpayer. He no longer receives any payment from the Civil List following the Sandringham Summit of 2020.

This brought back memories and not good ones. After almost 32 years in the glorious Met, I decided on a second career as I was fairly young. Teaching looked good so I went to Greenwich University, grabbing myself a PGCE (they insisted on this) and by late August I was ready to go.
By late September I was introduced to disputes between groups of children, often fuelled by social media comments outside school but impossible to resolve with lists of allegations, counter allegations, claims and counterclaims. Hours, days and weeks were spent trying to deal with, well, nothing really. But an important nothing. A nothing demanding time.
Have their Lordships considered detention?

Hasbeen is paying his own costs in this case. The case where the British taxpayers are paying is the one concerning his suing of HM's Government for his IPP status being reinstated. He will lose that and will have to pay all our costs plus his own.

How about...making a JUDGEMENT? That's what a judge is for right? This judge needs to stop pissing around and make a decision.
This is part of the preliminary stages prior to a civil case proceeding, so it's clear what actually needs to be decided on. . Did you listen to the video? The barrister explained exactly when the case will go to actual judgement.

A judge can't make a judgement unless he's heard the case. This principle goes back thousands of years to ancient law codes. What this judge is trying to do is to get the litigants to present their claims in proper legal form so that the court can judge the the claims in accordance with the law. If one or other of the litigants fails to do this, I think the judge can refuse to do the impossible. He 'throws the case out' - unheard, probably charging court costs against the litigant(s) who failed to follow the court's instructions by presenting their case in legal form. Cue a round of appeals and more of the litigants' money wasted when the appeals are in turn rejected.

Don't be stupid, you can't strip a born citizen of their citizenship UNLESS they are also entitled to citizenship from another country. Remember the huge fuss about the terrorist who lost her citizenship because Bangladesh - a country she wasn't from and where she had never visited but from whom she could claim citizenship by descent - didn't want her either. It was determined the UK wasn't breaking international law but they would be if they stripped Harry of his because he ISN'T entitled to any citizenship elsewhere, UNLESS he takes out US citizenship in which case they MIGHT be able to legally strip him of British citizenship.

Barristers and solicitors are fully capable of dragging cases on indefinitely irrespective of what the issues are. If the argument was over the shade of orange on a tangerine I am confident the ability is available to argue legal arguments for 100 years absorbing millions of pounds. Now, the ordinary man in the street finds this level of ability disgraceful and not promoting fair and efficient application of justice. The courts need to take a lead in making the court procedures and litigation faror efficient and have maximum time scales and maximum costs incurred. The system is not fit for purpose?
Clients should always be warned by their lawyers about litigation risks but if the clients are determined to continue and the lawyers' advice has been confirmed in writing, they do so at their risk.

Why doesn’t the court just accelerate the case and get it over done with. If he drags his heel , make a judgement, if he deleted evidence, make a judgment, if Sparry and his lawyers showed are deliberate stalling make a judgment. It’s a waste of time. Let whoever stalled, be fined.

In fairness, Harry has been awfully busy. He had to go to Colombia (a place level 2 warned as a dangerous country to visit) to, well, we don’t know why. Then, he had to go buy a couple of awards in Las Vegas. He had to go to see Kevin Costner for photo ops. He had to go to NYC to be on Jimmy Fallon and then go to a tattoo parlor. He surely can’t be expected to take seriously this lawsuit that costs the UK taxpayers money.

One of my favourite channels. Here in South Africa we operate under Roman-Dutch law, also known as South African common law.
Roman-Dutch law indeed, and a fine system it is - which may surprise lawyers of the First World. However I strongly believe our Constitution is the finest codified piece of legislation in any modern democracy. Of course we still have our problems, but that's a different matter. Always interesting to hear BB explaining how the laws of England and Wales function.
