Brother Brian, your the best. I've Never heard this kind of explanation before, either within the Navy or outside of the service. I've been struggling with service connected multiple disabilities for over two decades as a Gulf War Veteran Desert Storm. I've lost jobs and even my own transportation business due to my injuries I've been medically diagnosed with just about everything under the sun. As a husband and father, I feel extremely useless.
Example 2, veteran had a SCD for back injury and now was chronic pain that impacts his life style walking standing etc. when you file for such a claim, what happens next, does the va then do another evaluation of your back ? Or do they look at other medical records and base it on them? I for one can’t ride or walk behind a lawnmower it is much too painful and must hire someone to cut the lawn. Lawn care was one thing that I enjoyed.
Love the video, I do need help to see if I qualify, I currently have a long pending claim dated back to 2006 where I complained my service connected right knee and bakers cyst (sc) rated at 10 percent apiece was getting worse, after many appeals and 3 or 4 demands and a letter stating the judge is no longer working for the VA ( more time waiting) until now where I have had 3 additional surgeries to rt knee from a high tibia iui a osteotomy to a total knee replacement to now needing a revised to tighten objects as they failed me, but oh original claim in 2006 was due to severe pain associated with my rt knee. During that time I have had my full bladder removed, diagnosed with sleep apnea, depression, anxiety, and now am suffering from back problems from the stiffening of right knee where MRI states my l1-l5 is severe and my l1-S1 is also. It also states I have a bulging disk and sciatica which suffers me today. Do you see anything I can do, almost forgot as of my 2015 tkr screw up they awarded me 70 percent with 10 percent bakers cyst and up it to 100 percent tdiu and only back dates pay on 2015 but stated nothing else, did they not see I was in pain as they did the high tibia osteotomy and year later determined to remove the 8 screws and tbar due to the pain and discomfort it was giving me as I had another surgery. what code is that chronic pain under? I have service connect rating of 40% for L4 L5 Lamenectomy for the last 20 years. 10% straight out of the army, the surgery was under military time.
When filing a secondary claim do you file one claim for each thing or can you put all into one submittal? If all in one will they grant all or none or will there be a way that some could be denied and some granted. I have several injuries PTSD, knee, back and ankle and all cause functional loss. Either chronic pain or loss of enjoyment of life and actually contributed to my divorce and poor relationships in general.
You can file for multiple conditions as a secondary on a single 21-526ez. Depending on the issues, the VA may send you to a C/P exam for each specific issue. The VA may grant one, grant them all, or deny them all depending on if the medical examiner determines if your conditions are related to your primary condition.
You can file a claim for all conditions separately but they can and will combine into one claim. You can check the status of this in your Open Claims on www.va.gov.
I had family and a friend do a buddy statement. I couldn't get ahold of anyone I served with. Especially a very good friend of mine. I've had the worst luck on trying to contact him. I should say no luck at all. Hopefully everything will still work out.

I was diagnosed with hypertension in the service. I was never treated for it. Now the long term effects of hypertension has caused obstructive sleep apnea, among other dysfunctions I don’t care to mention because of the extent of it. How would I pursue this.
Based on your video, I feel like I would be eligible to file a claim under this new law. I had major back surgery while on active duty that included a spinal fusion at L4-L5. I have since had another surgery about 3 years ago but continue to struggle with chronic pain on a daily basis. It has taken me 20 years to get to my most recent rating of 90%. What are your thoughts about this? Reason I ask is because I am not having any luck getting the VSO rep to return email or phone calls to aide me with submitting my new claim and disagreements of the portions of my recent claim that the VA recently denied. Can you tell me how the Bilateral Factor works in the following examples? If you have a 20% left foot rating, a 10% left knee rating and a 10% right knee rating, what % is used for the left side 10%, 20% or 30% or something different ?

I injured my ankle while I was in on Active Duty in 2008 was rushed to a civilian hospital was put to sleep woke up with a cast on my left ankle took Percocet while going to physical therapy for about 6 months. I was able to complete my contract from 2008 - 2011 received my honorable discharge started workeing in construction in 2018 now I'm unemployed and my Ankle is bothering me since (I lost range of motion about 10 - 20%in the Army after receiving treatment). I also recently got diagnosed by the VA with Obstructive Sleep Apnea I have the CPAP Machine which is very difficult to sleep with. I'm gonna need help putting in my VA claims. If anyone here has dealt with these issues please let me know how to go about getting compensation from the VA for my disabilities so I can get them both as "service-connected"?

I was awarded 10% for foot pain back in 2013. They never actually diagnosed me. It literally says chronic foot pain. I had to refile for it but I was seen for it over and over while in the army and they gave me a PT profile for it. The outside doc said it's plantar fasciitis but that is not in the record and now I have neuropathy with most of the pain being in that same foot. They refuse to diagnose me properly at the VA. I'm trying an outside doctor.
They told me i would suffer my entire life in pain. And they won't cut off my rebuilt leg. I call them both pain sticks now. Hurts 24/7 no sleep for long, feel exhausted. Diagnosed in service. PTSD first friday.

You'll need an Independent Psych Eval, DBQ, and Nexus for Other Mental Health Conditions. Also, have you ever been treated for those conditions? I will like to know if its worthed to appeal, I do need the medical and yes maybe compensation but they make so hard and the examiner its like heartless you , I felt that she was trying to see or find out if I was lying about it. I told her how painful it was and that never bothered me until I joined the armed forces .
Most of the chronic pain claims I've seen , have received either 10-20%. Look at all of your rated conditions, and then search for any secondary conditions to help get you to the 95%

Im service connected with Multiple Cervical/Thoracic Scoleosis and lower back problems. I'm in a lot of chronic pain everyday, I have to see chiropractors weekly/monthky and take muscle relaxers. My question is I have Multiple events happening. They linked up to 10 discs that were included in the but only rated me on the lowest rating for have Scoleosis. Do I have to make individual claims for each secondary claim or do I put in one claim for everything I'm trying to claim? Thank you for serving and helping veterans! Great video.

Hi Steven, Chronic Pain Syndrome does have a rating for the physical pain and Somatic Symptom Disorder is a mental health claim associated with Chronic Pain. Its kind of confusing!
@@VAClaimsInsider thanks Brian...and to be completely honest, It would be a secondary disability bc the scars stem from my mental health service connection disability. I already recieve 50% for mental health but never thought to claim the scars I have from self-harm.
Oh great i begged them to chop off my leg after the surgery. They put it in my medical records that i had severe permanent pain. But the VA didn't pay for pain even if it keeps you awake 3 days at a time until you pass out. I have drugs that help but without the drugs....
V.A. has screwed me royal. I'm 80% with 20% unemployment to be at 100%. I get an extra hundred a month for my nut. I'm missing a right kidney. I've got diabetes, peripheral neuropathy with terrible pain, high blood pressure, and rated 50% PTSD, nuts. I have constant shoulder pains. I do Dallas. I'm a Republic of Vietnam combat vet. Matter of fact, Dallas fired some woman for performing tricks at the V.A. I'm in terrible pain. I took myself off of opioids and got a TENS Unit. It worked for me. It broke in September 2018. V.A. offered Choice. I said I wanted an appointment. So I got one for February 2019 even though I'm in awful pain. V.A. refused me dental care for 3 years. No teeth cleaning. Finally in September of 2017, I got a letter from V.A. for CHOICE with bogus phone numbers. I finally got to see a private dentist in February of 2018. After running up a V.A. approved bill for $9,000, the private dentist cut me off in August 2018. Choice ain't paid the bill. V.A. sent me another letter after my complaining and tells me to get a new provider. I was on the Dallas V.A. operating table last week. The V.A. aborted the surgery on my nut. I was groggy. I didn't understand why. So yesterday I told my V.A. primary care doctor. He said we'll look in the computer and see why it was aborted. The doctor was shocked because it didn't tell him why the surgery was aborted. My meds didn't come. I called the pharmacy. The pharmacy said my meds were on back order. I'm past 70. I'm on the V.A. death list. My congressman doesn't give a schitt. My senators don't give a schitt. My patients advocates don't give a schitt. One died and one retired. The administration don't give a schitt. I've talked to em all. I know em all on a first name basis. My VFW VSO don't give a schitt. My DAV VSO don't give a schitt. My docs don't really give a schitt. They put in a referral and I get jerked around. I've played the game for 50 years. In September 2017, I called the crisis hotline number. I was put on hold. Dave called me back and gives me hell. He says I called them, he didn't call me. Only reason I ain't killed myself is I want to see how long I last. My 2 bothers experience the same thing. One lives in Michigan and 1 lives in Florida. The Trump hotline complaint get sent to patient advocate anyway. What a treat. Next month the games start. These vets with RAMP gets denied. Gonna be a show. I'm rated at 60 percent for my back and redulapathy in both legs get 20 for each and I go to dr every month and take pain meds on a daily bases would that be a different claim
Hey Brian, how come there's no rating or criteria for MST (Military Sexual Trauma)? Or is it to be filed under something else? I couldn't find it on ebenefits page. When I had my last C&P about the mental aspect of my disability, I added it, so it's documented, but I was curious if you know anything else, thanks! I also have chronic pain so thanks for this vid, because they won't rate me for it! They keep telling me 'Everything is fine or okay or normal!" I sure the hell don't feel okay, fine or normal!
Brian, I've a claim in "pending status" for over a year (they cannot find my records at records management). How long can the VA delay this rating/decision?
BTW, is there anywhere we can go if the VA is not treating our medical problems correctly? For instance, an endocrinologist diagnosed me with Hashimoto's back in 2009 which is service connected because I got 10% for hypothyroid. Now I am having live issues with lesions and I was in the hospital for tests but for some odd reason they did not do a biopsy when even the radiologist said it needs to be done. They saw this in a past cat scan as well. There are other issues that could be related to my Hashimoto's but I had to find the results of tests on MyHealthe Vet and was never told by my PCP or any other doctor from the VA.

After I got back from combat, I hurt my back on duty. The doctor said I couldn't lift more than 5 pounds so I couldn't do my job. I was in physical therapy for my back injury and psychological therapy for some PTSD issues. My first sergeant said he would do me a favor and let me out early with my honorable discharge and my gi bill. I later found out he gave me an under honorable conditions(general) discharge and I should've gotten an honorable medical discharge with a disability rating and I didn't get my gi bill. That was over 20 years ago. Since then, I have developed several conditions as a result of my in service issues like sleep disorders, sleep apnea, anxiety and depression. What can I do to right this wrong? Can you please help me?
What would qualify as in service connection or stressor. I have chronic neck and upper back pain since I got out of the military 20 years ago. It has been getting progressively worse and have been getting treatment from the va for last couple years with pain and muscle relaxers regularly also. Or should I try secondary to lower back or sleep apnea already connected. I was seen in sick calls regularly for leg and back issues

You would first need to have a current diagnosis of Radiculopathy before you file. You'd also need to have an Independent Medical Opinion Nexus letter to help tie it in to an already service connected disability. WRIISC diagnosed me with CFS and paralysis of the popliteal nerve. VBA turned the later into idiopathic neuropathy of the lower extremities. All due to GW91 Environmental Exposures. I am 40% connected for neuropathy and 60% for CFS among other things.. I have widespread joint and muscle pain and have been on pain meds with pain shots since 2012. My knees are killing me and walking is almost impossible. I have been going to PT since Mar 18, 2019 due to shoulder, arm and knee pain. The chronic pain and chronic inflammation is well documented with C reactive protein being 13 to 17. I'm Tired! What DBQ do I use for Chronic Pain please?
Brian Reese thanks! I just asked my PCP about that last week and he said SSD was for people who believe they have pain - where as, my pain is REAL. He said SSD was like a fake pain people imagine. What do you think?
Karen M. Karen M. I would steer clear of your PCP when it comes to building your SSD claim. They just don’t seem to understand. Get a diagnosis, file your claim and you can also continue to see your PCP but I would not discuss your claim with him.

Hi , I just had a VA medical exam for an injury that it got during boot camp. But i got denied. I twisted my ankle when i was 12 years old and it never bothered me until i went to boot camp in 2000 I twisted during a pt run , I spent around a week or so on crushes and i got a discharge (miscellaneous) ,I filled a claim for my ankle and knee get swollen when I walk. I just got denied that claim. What should I do, should I appeal for it ?
yes...appeal appeal appeal....they usually deny everything. I was denied for both knees in 1977...I just let it go...but in 2007 I became disabled and had the time to fight the VA and I did....In 2015 I was service connected with a huge check going back to 1977....now I'm at 60% and more more claims are coming. Don't give up....I did it and doing it myself. VSO's really don't give a damn...

I just got denied for chronic pain secondary to my service connected ptsd (70%). When I have episodes due to my ptsd I get these pains in my arms and lower back but I still was denied. This sometimes cause me to miss work. Can you assist?

LoJack Poker They are both mental health disorders, you can be rated for both but only the highest one will be able to be used in calculating your scheduler rating.
LoJack Poker is ptsd the only thing you’re currently rated for? I’d recommend signing up and let one of our Veteran Coaches help you find the correct plan of action. Possibly even submitting an increase for your ptsd if it’s gotten worse.
Brian Reese even with a dbq from an independent doctor for somatic symptom disorder and at 70% it sounds like va is going to deny that claim because it’s listed as secondary to PtSD

mikeb don’t use a vso they are worthless. Use these guys or just learn yourself. YOU are your best advocate, no one wants your claim to be approved more than you, so learn how to do it right. It can be as hard as you want it to be or as easy.

I injured my ankle while I was in on Active Duty in 2008 was rushed to a civilian hospital was put to sleep woke up with a cast on my left ankle took Percocet while going to physical therapy for about 6 months. I was able to complete my contract from 2008 - 2011 received my honorable discharge started workeing in construction in 2018 now I'm unemployed and my Ankle is bothering me since (I lost range of motion about 10 - 20%in the Army after receiving treatment). I also recently got diagnosed by the VA with Obstructive Sleep Apnea I have the CPAP Machine which is very difficult to sleep with. I'm gonna need help putting in my VA claims. If anyone here has dealt with these issues please let me know how to go about getting compensation from the VA for my disabilities so I can get them both as "service-connected"?

What's the difference between nexus statement and nexus letter?
I was awarded 10% for foot pain back in 2013. They never actually diagnosed me. It literally says chronic foot pain. I had to refile for it but I was seen for it over and over while in the army and they gave me a PT profile for it. The outside doc said it's plantar fasciitis but that is not in the record and now I have neuropathy with most of the pain being in that same foot. They refuse to diagnose me properly at the VA. I'm trying an outside doctor.

They told me i would suffer my entire life in pain. And they won't cut off my rebuilt leg. I call them both pain sticks now. Hurts 24/7 no sleep for long, feel exhausted. Diagnosed in service. PTSD first friday.

I will like to know if its worthed to appeal, I do need the medical and yes maybe compensation but they make so hard and the examiner its like heartless you , I felt that she was trying to see or find out if I was lying about it. Most of the chronic pain claims I've seen , have received either 10-20%. Look at all of your rated conditions, and then search for any secondary conditions to help get you to the 95%

Im service connected with Multiple Cervical/Thoracic Scoleosis and lower back problems. I'm in a lot of chronic pain everyday, I have to see chiropractors weekly/monthky and take muscle relaxers.
My question is I have Multiple events happening. They linked up to 10 discs that were included in the but only rated me on the lowest rating for have Scoleosis. Do I have to make individual claims for each secondary claim or do I put in one claim for everything I'm trying to claim?

Hi Steven, Chronic Pain Syndrome does have a rating for the physical pain and Somatic Symptom Disorder is a mental health claim associated with Chronic Pain. Its kind of confusing!

Oh great i begged them to chop off my leg after the surgery. They put it in my medical records that i had severe permanent pain. But the VA didn't pay for pain even if it keeps you awake 3 days at a time until you pass out. I have drugs that help but without the drugs....

V.A. has screwed me royal. I'm 80% with 20% unemployment to be at 100%. I get an extra hundred a month for my nut. I'm missing a right kidney. I've got diabetes, peripheral neuropathy with terrible pain, high blood pressure, and rated 50% PTSD, nuts. I have constant shoulder pains. I do Dallas. I'm a Republic of Vietnam combat vet.
Matter of fact, Dallas fired some woman for performing tricks at the V.A. I'm in terrible pain. I took myself off of opioids and got a TENS Unit. It worked for me. It broke in September 2018. V.A. offered Choice. I said I wanted an appointment. So I got one for February 2019 even though I'm in awful pain.
V.A. refused me dental care for 3 years. No teeth cleaning. Finally in September of 2017, I got a letter from V.A. for CHOICE with bogus phone numbers. I finally got to see a private dentist in February of 2018. After running up a V.A. approved bill for $9,000, the private dentist cut me off in August 2018. Choice ain't paid the bill. V.A. sent me another letter after my complaining and tells me to get a new provider.
I was on the Dallas V.A. operating table last week. The V.A. aborted the surgery on my nut. I was groggy. I didn't understand why. So yesterday I told my V.A. primary care doctor. He said we'll look in the computer and see why it was aborted. The doctor was shocked because it didn't tell him why the surgery was aborted.
My meds didn't come. I called the pharmacy. The pharmacy said my meds were on back order.
I'm past 70. I'm on the V.A. death list. My congressman doesn't give a schitt. My senators don't give a schitt. My patients advocates don't give a schitt. One died and one retired. The administration don't give a schitt. I've talked to em all. I know em all on a first name basis. My VFW VSO don't give a schitt. My DAV VSO don't give a schitt. My docs don't really give a schitt. They put in a referral and I get jerked around. I've played the game for 50 years. In September 2017, I called the crisis hotline number. I was put on hold. Dave called me back and gives me hell. He says I called them, he didn't call me. Only reason I ain't killed myself is I want to see how long I last. My 2 bothers experience the same thing. One lives in Michigan and 1 lives in Florida. The Trump hotline complaint get sent to patient advocate anyway. What a treat. Next month the games start. These vets with RAMP gets denied. Gonna be a show. I had half my left lung removed on active duty, due to TB I got while in the army. 30% for a lung seams a little low. What do you think?

BTW, is there anywhere we can go if the VA is not treating our medical problems correctly? For instance, an endocrinologist diagnosed me with Hashimoto's back in 2009 which is service connected because I got 10% for hypothyroid. Now I am having live issues with lesions and I was in the hospital for tests but for some odd reason they did not do a biopsy when even the radiologist said it needs to be done. They saw this in a past cat scan as well. There are other issues that could be related to my Hashimoto's but I had to find the results of tests on MyHealthe Vet and was never told by my PCP or any other doctor from the VA.

After I got back from combat, I hurt my back on duty. The doctor said I couldn't lift more than 5 pounds so I couldn't do my job. I was in physical therapy for my back injury and psychological therapy for some PTSD issues. My first sergeant said he would do me a favor and let me out early with my honorable discharge and my gi bill. I later found out he gave me an under honorable conditions(general) discharge and I should've gotten an honorable medical discharge with a disability rating and I didn't get my gi bill. That was over 20 years ago. Since then, I have developed several conditions as a result of my in service issues like sleep disorders, sleep apnea, anxiety and depression. What can I do to right this wrong? Can you please help me?

What would qualify as in service connection or stressor. I have chronic neck and upper back pain since I got out of the military 20 years ago. It has been getting progressively worse and have been getting treatment from the va for last couple years with pain and muscle relaxers regularly also. Or should I try secondary to lower back or sleep apnea already connected. I was seen in sick calls regularly for leg and back issues

hey Brian how do you get a rating for radiculopathy I got 70% disability and I wanted to put in for radiculopathy for both legs
You would first need to have a current diagnosis of Radiculopathy before you file. You'd also need to have an Independent Medical Opinion Nexus letter to help tie it in to an already service connected disability. WRIISC diagnosed me with CFS and paralysis of the popliteal nerve. VBA turned the later into idiopathic neuropathy of the lower extremities. All due to GW91 Environmental Exposures. I am 40% connected for neuropathy and 60% for CFS among other things.. I have widespread joint and muscle pain and have been on pain meds with pain shots since 2012. My knees are killing me and walking is almost impossible. I have been going to PT since Mar 18, 2019 due to shoulder, arm and knee pain. The chronic pain and chronic inflammation is well documented with C reactive protein being 13 to 17. I'm Tired! What DBQ do I use for Chronic Pain please?

Brian Reese thanks! I just asked my PCP about that last week and he said SSD was for people who believe they have pain - where as, my pain is REAL. He said SSD was like a fake pain people imagine. What do you think?
Karen M. Karen M. I would steer clear of your PCP when it comes to building your SSD claim. They just don’t seem to understand. Get a diagnosis, file your claim and you can also continue to see your PCP but I would not discuss your claim with him.

Hi , I just had a VA medical exam for an injury that it got during boot camp. But i got denied. I twisted my ankle when i was 12 years old and it never bothered me until i went to boot camp in 2000 I twisted during a pt run , I spent around a week or so on crushes and i got a discharge (miscellaneous) ,I filled a claim for my ankle and knee get swollen when I walk. I just got denied that claim. What should I do, should I appeal for it ?
yes...appeal appeal appeal....they usually deny everything. I was denied for both knees in 1977...I just let it go...but in 2007 I became disabled and had the time to fight the VA and I did....In 2015 I was service connected with a huge check going back to 1977....now I'm at 60% and more more claims are coming. Don't give up....I did it and doing it myself. VSO's really don't give a damn...

I just got denied for chronic pain secondary to my service connected ptsd (70%). When I have episodes due to my ptsd I get these pains in my arms and lower back but I still was denied. This sometimes cause me to miss work. Can you assist?

Can you claim SOmatic symptom disorder secondary to PTSD?
LoJack Poker They are both mental health disorders, you can be rated for both but only the highest one will be able to be used in calculating your scheduler rating.
Brian Reese so at 70% PtSD I’m guessing it’s going to be impossible. I will have to go a different route to get that last 30%

Brian Reese even with a dbq from an independent doctor for somatic symptom disorder and at 70% it sounds like va is going to deny that claim because it’s listed as secondary to PtSD

mikeb don’t use a vso they are worthless. Use these guys or just learn yourself. YOU are your best advocate, no one wants your claim to be approved more than you, so learn how to do it right. It can be as hard as you want it to be or as easy.
