What about getting married with green card holder
Can a immigrant spouse/fiancé of a US citizen come to the US with a work visa instead of a I-130 or a K1, but adjust status through marriage? My fiancé has a job (internship type job) lined up and that’s great! But we don’t know if it’s allowed for him to come in with the work visa instead of the spouse or fiancé visa. Should we apply for the fiancé visa too just to be safe? Or is that also a problem? Should we get married outside of the US and have both the work visa and the spouse visa to avoid problems? Or is THAT a problem?

I am in this same situation as well. My mom filed for me back in 2016. That was as soon as she received her GC but that was a few months after turning 21. She past in 2019 an my case got approved February of 2021. I was told I may have to go back to my countries consular. This is scaring me.

Hi Ms. McBeam, Can a green card holder file for a child that is over 21, and on an over stayed visa? Thank you!
Yes BUT hence the child is over 21 with no status, that child will have to leave the United States FIRST to his country of origin, then the parent can THEN file the child. It is advisable for the child to apply for a waiver of unlawful presence in the US first before leaving or else the child will be banned by the US Embassy in his original country because of overstaying in the US the first time. The thing is, if a parent becomes a green card holder, if he or she wants to petition for his or her child, that child ( it doesn't even matter the age of the child even if the child is two years old!) must return to it's country of origin first before a green card petition can be done. But if parent is a US citizen, then parent can petition for a child to get green card before child gets to the age of 21 years. The child does not need then need to leave the US.
