It does not matter how smoothly and fluently the arguments were posed. It breaks down on the simple and stark fact that the victim was a minor, therefore not in a position to extend consent. The advocate's argument that the parents were not witnesses is weak and unconvincing, as it has nothing to do with the act or with the consent to that act by the victim. Good pleading wasted on a bad case. The continued and extended argument that the relatives and the parents were aware of the situation, and therefore in some way complicit, is preposterous. If that argument is to be heeded, there is no need for laws at all; merely social judgement can decide the matter.

This strict letters of law is bull shit specially in case of women defence. Just think of the logic the guy is in custody that 1. he had been relationship with girl with the assurance of marrying. Now this means that girl also gave the consent that she would be marrying that's why she went ahead with physical relationship. Now she is married to someone else having kids can boy go and say breach of trust. 2. The other argument is girl was minor and didn't had the age limit of giving consent for physical relationship but willingness was there. Who is incharge of the girl to check whether she is willing going in good or bad relationship specially she is minor. Should the guardian be also prosecuted and charged why only the boy have all burden. The girl is going in relationship willing to have physical relationship but the only guilty party is the boy. One side the women can have adultery and not a crime even if being in marriage. This law we have made. On other side we are saying that if girl is in relationship and it sour she can go ahead and file complaint that relationship was with a assurance of marrying and now it's a breach of trust since the relationship has gone ba. As per IPC & Many Judgements of SC & HC,physical relations with a minor girl is illegal and amounts to rape. Even Consent of Minor Girl is irrelevant. But this rule is not applicable in case of Husband & wife if their marriage is valid as per law

I think the people of India (including Indian court/judiciary system) misunderstand what consensual sex means in the rest of the world. If you read details of the proceedings of any country, you will find that it is talking about will and consent. Will is a mere want or desire to do an act. It usually reflects a yearning or longing to enter into a sexual act. On the other hand, consent relates to the active showcasing of willingness, a manifestation of the actual will to do an act. A person can not have the will to do a particular act but still may consent to it and vice-versa. Even if a person has consented to engage in sexual activity but he/she may not have a will for it, the person entering into a sexual act with him would be liable for a crime. More precisely A girl can give consent because she believes in that false promise of marriage it does not mean that she is willing to do it. Now the question is what is the false promise of marriage? Most of the times, girls keep quiet. They don't talk about it cze they think it'll make them characterless in the eyes of the society.
In my 4 male friend circles, I've seen 70% of the guys continuously objectify women, pass comments nd discuss about what they do with them if they get a chance. It's a harsh truth. I prefer to stay alone because of this thing only.
Boys do make false promises to gain sexual favours sir. You must haven't done that but guys actually do that. For teenage boys, relationship is just a way to make sexual relationships. Whereas girl of the same age are more matured by that age nd they don't think much about getting sexual favours. Yes, some individuals may do it but on an overall basis, wmoen form relationships to marry. Just think of the logic the guy is in custody that

I think the people of India (including Indian court/judiciary system) misunderstand what consensual sex means in the rest of the world. If you read details of the proceedings of any country, you will find that it is talking about will and consent. Will is a mere want or desire to do an act. It usually reflects a yearning or longing to enter into a sexual act. On the other hand, consent relates to the active showcasing of willingness, a manifestation of the actual will to do an act.
A person can not have the will to do a particular act but still may consent to it and vice-versa. Even if a person has consented to engage in sexual activity but he/she may not have a will for it, the person entering into a sexual act with him would be liable for a crime.
More precisely A girl can give consent because she believes in that false promise of marriage it does not mean that she is willing to do it.
Now the question is what is the false promise of marriage? The answer is - If you promise to marry the girl and refuse to marry after sex just because you promised it to get sex. It is different than you promise to marry and differences got created over the time.

It was not rape. They had consensual relationship. It was termed as rape because girl was under 18 as per the laws of the land. Sometimes being a lakeer ka fakeer hinders the process of justice.
