Problem in India is that senior advoctes mostly are hired by rich and they get bail easily but poor people due to not able to hire seniors they get delayes justice or most times justice is denied. Sad reality of our judiciary
And another problem is that people don't know there's a free legal aid available for people who earn less that 8 lacs per annum in every state in India. The lack of information and knowledge is what a major problem.

It's a Violation of fundamental rights, you are absolutely correct he had that ground which was not taken, but anyways justice would have said that let the cross examination of IO and forensic team take place. He should have applied for bail after the statements of IO and forensic team are taken on record by the Sessions Court then there could have been a possibility of releasing the accused on bail.

Sir एक case है। एक दोस्त है एक नाबालिग लड़की से उसकी बात चीत थी। वो उससे मिलने आई। जब मिल कर वापिस घर गयी तो लड़की के घर वालो ने लड़की को छुपा दिया और नाबालिग के अपहरण, रेप , और उसे गायब कर देने का case कर दिया। लड़का jail में है। 2.5 months से और अब लड़की वापिस अपने घर वालो के पास है, ये police के संज्ञान में आ चुका है कि लड़की सही सलामत घर पे है अब अपने। पहले कहाँ थी ये जांच का विषय है (जो कि आरोपी पक्ष ने खुद जांच करके पता किया था कि लड़की अपने घर आने से पहले अपने दादा दादी के पास छुपा कर रख दी गयी थी) इस case में आगे कैसे proceed करना है लड़का 100% निर्दोष है लड़की का rape हुआ होता तो लड़की वाले पहले मेडिकल जरूर करवाते, 164 के बयान होते। अपना सम्पर्क भी सुझाव के साथ साझा करें...

In my humbled view, Very nice bail was argued by the Advocate and this bail application was fit for the grant, as the case is doubtful and required further enquiry, but judge only consider the age of deceased and not consider the Law and factual position of the case. Absolutely correct. While applying bail, he questioned the evidence and manner of obtaining evidence whereas the requirement was to demonstrate the that by granting bail, the accused wouldn’t cause any harm to the procedure and will not abscond. Though articulate yet useless. Many people are praising him in the comments but do not know a cent of what is being said by the Hon’ble lordship. it's not possible to come prepared for something that is technical and true.
They wouldn't be able to defend the 100 % burn and swab collection , delay and many other technical aspects .
