      A judge cannot (and should not) be held accountable for signing a search warrant based on the content of the sworn declaration (probable cause affidavit) submitted to them by a detective unless that judge knows or reasonably should know the information in the affidavit is false. It ultimately falls on the submitting detective if there was false information submitted in support of the warrant. Judges do not have the time to conduct their own investigations into a case in order to independently fact-check all the statements written by the detective seeking the warrant. Same goes for the deputy DA reviewing it before it's submitted to the judge. A judge can only be charged with perjury or a 4th Amendment violation if the judge KNEW the information in the warrant was false. Otherwise, the judge can reasonably say he granted the warrant "on good faith" that the information submitted, and sworn to under penalty of perjury by the detective, in support of the warrant was true and correct.

      Before simplistically letting the judge of the him based on vague assumptions regarding the initializing affidavit, a full investigation must examine the affidavit to determine if the claims made would support the issuance of the warrants. Among the issues to be examined is whether such extreme remedies are themselves justified. What you seen to suggest is that judges don't have to consider if the remedies sought are supported. Maybe cops get ask those free donuts because vm judges can randomly decide to issues warrants to seize them is better than waiting their turn.

    The more I hear about this case the more I am concerned that in obtaining the search warrants and freezing order for the bank accounts the police have not, as they are required to do, tell the full story to the relevant judges. This video simply adds yet more evidence to the allegations of police and prosecutorial misconduct

    The abuse of power in this case is unacceptable. A full investigation and people losing their jobs over this is a very necessary step to stop the abuse of power from our unlawful government officials and police. And the man that initiated all of this needs to be charged as well.

    A crime or a civil matter. This all started when the customer did not make his payment and went MIA on the business. The business has a right to protect their interest when a customer defaults on payment. But let's not get it twisted this is not a criminal action this is civil and what they did violated this company and this man's rights and the turnaround and freeze his assets is outrageous

    Throw them all in prison, ffs. Hardly an investigation is needed, they committed fraud, illegally obtained a warrant, misuse of public funds, illegal cross-county and state lines conducted raid, corruption, assault, harassment, and 15 other serious federal laws that keep local law enforcement from doing such things. The judge, the rich scumbag, and every officer involved needs to be throw in prison yesterday. This is massive corruption on a scale that should make the justice system go into warp speed to prosecute every involved.

    Disgraceful! This is obviously a civil case. How could the sheriff justify freezing the shop's account for such bull charges. Why didn't the DA drop all charges and unfreeze the account as soon as he figured out what's happening?

      Well, he did pay for it eventually, but he lost his spot in line because he didn't send a payment for 8 MONTHS. But now he feels entitled to get his car now, eventhough the other 8 people also waiting for cars did everything they were asked to do on time.

    The sad thing is this is probably the tip of the iceberg when it comes to this sheriff’s corruption. Given that county sheriffs are primarily responsible for property seizures and evictions, there should be an investigation to see if the sheriff misused his authority on behalf of his realtor friend. If so, this story instantly becomes something much bigger and something that should lead to prison sentences for both the sheriff and the realtor.

      100% agree. That was the first thing I thought after first hearing this story. If that corrupt sheriff did this favor for a wealthy friend, how many more times has he arbitrarily given himself or his police force "the right" to intimidate, harass, ticket, arrest or otherwise mess with civilians to force an outcome that is beneficial to himself or someone he knows?
      This is just the one case that went viral, because the Batmobile angle makes it media worthy. Does anyone really believe this is the one and only time the sheriff has abused his position? Of course not; it's just the first time his actions have gone viral. Chances are there are hundreds of cases where he got away with it.

This case should be brought to the Dept of justice as a massive corruption case if appropriate. Not only did the sheriff misuse his authority . He also misused tax funds from the tax payers. Went on a lavish manhunt for a civil matter out of his jurisdiction based on the butt hurt feelings of a financial donor in San Mateo and traveled out of state to IN to arrest a man his friend had a business dispute with . I would include fraud , alteration of legal documents to get the warrant . Lying in said documents . Falsifying records. Extortion , torture and misuse of tort law (sounds right ?) .. they all better be breaking rocks at Alcatraz by 2023 or San Mateo residents need to hold massive recall of the AG

    I hope this businessman sues the pants off of every individual involved especially the customer who did not make his installment payment and then went MIA. Because of his actions he was put at the end of the line which is acceptable he missed his installment payment but to turn around and do such a criminal act required him to lie to law enforcement to have them do what they did. And for them to go out of state to do all of this when it is a civil matter is beyond abusive power. They all need to go down for this. What's really sad is the taxpayers are going to be the ones to pay for this rich man's abusive actions. There ought to be a charge for that as well 😠💩🤡

    I’ve been a police officer for 19 years and the level of impropriety in this looks astounding. I’d like to see the response from the judge who signed the search warrant. In the search warrant the lieutenant lists training totally unrelated to the investigation. The news station should do a freedom of information act request for emails from the sheriff to the lieutenant about this case.

      -The sheriff's investigation (albeit, bogus investigation) had not yet been turned over to the DA office for prosecution. The DA claims he did not know anything about the case until after it was in the news. As far as I can tell, the DA has no responsibility for this embarrassing travesty.-
      *_Edit:_* The DA claims to not have been aware of the arrest planning or the trip to Indiana, but the DA's office was indeed involved in filing the charges (I originally thought the DA had claimed to not be aware of anything).

      Its ok, the 4th amendment protects us from unreasonable searches and seizures without due process! It's not like the cops can just run around stealing your stuff without repercussions!
      And if somehow the government and especially cops were abusing their powers (I know, absurd to think of) everyone involved will pay a steep price. And by everyone involved I mean the taxpayers. The cops, judges who signed the warrants, and the DA who won't drop the charges will really learn their lesson after they retire with their full pensions and medical care.     We are over here in Indiana wondering why our Sheriff’s office even facilitated this clear overreach of power in a state that honestly doesn’t take much of anything from California serious.       I suspect the Cass County Sheriff's deputies who assisted the San Mateo County deputies on this didn't pay a lot of attention to the specific merits (or lack thereof) of the case or even read the probable cause statement in the Search Warrant. I'm sure they are regretting that decision in hindsight.

      @@dragonflydolemite Yup. The case was already filed in a California court. The judge dismissed it, saying the proper jurisdiction was Indiana. Rather than suing in Indiana, he pulled some strings.
      There’s some interesting questions: Did the realtor file a false report with the sheriff? That’s a crime. Did he conspire with the sheriff to file the false report? That’s a second crime.

    All they had to do is send one man there and speak with this working man and his staff, and all would have been brought to light in a 30 minute conversation. What a prime example of abuse of power. Over stepping your duties on behalf of a "friend". the entire case should be thrown out, the sheriff either resigns on his own or is forced out, all those involved face some sort of disciplinary action, the judges relationship investigated and removed from the bench, and this man should sue their paints off, every last one....

      so guy missed a payment for his car to be built and stoped contact the builder for mouth, the builder tired to contact him with no response, so he put him at bottom of list, the builder told him it would be year an heft or two year wait to finish his car , buyer was upset and went to the sheriff. the buyer did finish making payments for his car. The wait will now be longer cus he couldn't wait two years for a custom car. this civil matter not criminal matter. The builder is incident , maybe dont missed a payment and vanish than cry about a up to two year wait

    The sheriff department violated this individual civil rights. More than just a resignation should be sought. E.g.; No retirement pension with some time behind bars.
    Seeing this type of behavior leads me to believe this isn't their
    first rodeo, maybe other individuals will come forward after seeing this incident. The U.S. AG and the FBI should be involved at this point too.

    Actions speak louder than words. That said this proves beyond a shadow of a doubt that San Mateo County has a two tiered justice system. The only way to right this wrong is to fire and arrest the Sheriff on corruption charges, fire the DA, fire the deputies that terrorized this poor man, and severely reprimand anyone involved in this act of disgrace.

      Everyone involved hasn't committed any crimes. If your boss tells you to transfer $$$ to a specific account, you haven't committed any crime unless you have explicit knowledge there is something fishy about the request.
      So if the Lt says "tomorrow I need you to follow me to arrest someone", then the police that is asked to join has no reason to suspect that there is something wrong.
      As of right now, it's the sheriff and a lieutenant and maybe a local DA (the female DA from the first video) and maybe some local judge that might have actually been naughty. The final judge in the other state had no reason to suspect the police was lying.

      I don't know if the car maker will sue for anything over immediate damages of lost wages, penalties and things like that. Then said that they have chosen not to persue it in Indiana. As such there won't be anyone paying for anything and this will flame out like everything of this nature always does.

    A judge should immediately order the bank to unfreeze the batmobile maker's bank account!
    The guy who ordered the batmobile should be required to pay compensatory and punitive damages to the batmobile maker, his employees, everyone else who ordered a batmobile, and the California taxpayers. And also be ordered to publicly apologize, and be on probation, and take counseling to counter his narcissism.
    The police officers also need to be held accountable for their actions!

      -The sheriff's investigation (albeit, bogus investigation) had not yet been turned over to the DA office for prosecution. The DA claims he did not know anything about the case until after it was in the news. As far as I can tell, the DA has no responsibility for this embarrassing travesty.-
      _Edit:_ The DA claims to not have been aware of the arrest planning or the trip to Indiana, but the DA's office was indeed involved in filing the charges (I originally thought the DA had claimed to not be aware of anything).

    This matter involves government employees in two states and needs to be thoroughly investigated by the U.S. Attorney General and the FBI. The California Attorney General doesn't have the authority to run an investigation in Indiana and to avoid officials in California and Indiana each claiming that the problem lies with the other state this matter would be better handled through the U.S. Attorney General's office.

    This is truly a civil matter. You know where the car is, you know who has your car, you know the location of the car. You missed a car payment and didn't contact the guy for 8 months. What do you expect? Sounds like the guy that missed a car payment was in breach of contract. I am a Real Estate Investor. If I were to miss a renovation payment with the contractor the contractor would simply go to the next contract and I would have to be rescheduled as soon as I made a payment!

    The most troubling aspect of all is that the sheriff thought he could do all of this *without any repercussions.* He basically stole $10,000+ of taxpayer dollars to do a personal favor for a buddy...isn't that Embezzlement???

      He DID do all of this without repercussions. At least none anywhere in sight yet. He's a lame duck, so "firing" him or "voting him out" is irrelevant. He's deeply embedded in the local political scene so his buddies will cover for him so no criminal charges will ever appear. He knows if he keeps "investigating" the situation eventually attention will focus on a war or shooting or plane crash or toxic spill and it will all blow over.

      If any of the investigators knowingly provided false information in support of the search warrants or the arrest warrant, they are guilty of perjury, filing a false police report, and violating the car maker's civil rights. That could result in termination, criminal charges and a federal lawsuit for both a 4th Amendment violation and deprivation of rights under color of authority. If they did that, they deserve every bit of punishment the law can give them.
