      BTW Mike- Speaking of SovCit Chili. I rewatched a short clip of his case, right before it actual began. I don't think any of the Lawyer type channels brought it up but Chili wanted to go Pro Se and plead his own case. THAT would have been ' entertaining '.Before Judge took the bench he took a paper up to Clerk. Later, Judge takes the bench. She said she is denying his motion for Lawyer Mee to be His " Stand-by Counsel " Then case immediately proceeds with His Lawyer.

      Maybe I'm wrong but a lot of these gang cases involve witness intimidation. The judge pulls a witness aside, asks them about potential intimidation. He gets mad because that means there is a leak in his department.

    I got pulled over a couple of days ago for speeding. When the cop said I was speeding, I looked at him and said sir I'm traveling, not driving. Then I said I'm just joking. I'm not a sov cit. He laughed and gave me a waring 😀

      It must be so exhausting for judges and police officers to have to listen to this SovCit nonsense. It's remarkable to hear this psycho-babble and realize the SovCits have no clue about the legal terms they are trying to use.

    The final result of this hearing was that Steele will serve 10 weekends in Jail and be available for court each weekday. The Judge also said that Steele can meet with Young Thug on weekends to prepare for the following week. Steele did get two attorneys who spoke on his behalf and had some really good arguments. In Georgia, when someone is held in criminal contempt the person can only be held in jail for 20 days at most. Initially, the Judge was going to hold Steele until he gave up the info requested. This isn't over yet, but that's it so far.

      The judge seems to be seeing red. Listen to his breathing in the microphone- he is steaming angry. I think he is crooked. He needs to step down from this case. He cannot be impartial anymore. He's not being honest or fair. The judge got caught and now he wants to blame someone else for his actions... he is a bad apple.

      @@peggyriordan9857 that’s why the judge was acting a tad bit nicer yesterday. He knows the Supreme Court didn’t rule in his favor. I think they’re starting later today and he was probably hoping to throw steel in jail afterwards. And you’re welcome, this is a huge deal, so I love to have discussions about it.

    Do I have this right:
    The lawyer is saying ex parte meeting wasn't right. The judge is saying you should not have known about it and shouldn't be asking and who told you. That's weird.

      I haven’t seen it yet, but there ARE a few laws, in a handful of states where either party CAN have a lawful ex parte meeting with a judge. It takes a whole lot of criteria to justify the special circumstance, but it’s done confidentiality, so no one but the people in the room should know about it. If the judge is hounding someone who knew but shouldn’t, the special circumstance likely had something to do with the judge’s office (Ie, clerks taking bribes or talking out of the office).
      Again, I haven’t seen it yet, but I see lots of comments, so I’m kinda excited.

    (b) the judge makes provision promptly to notify all other parties of the substance of the ex parte communication, and gives the parties an opportunity to respond.

    Sorry if this comes up and I just haven't gotten to it Mike but:
    The Georgia Code of Judicial Conduct allows ex parte communications in emergencies that do not deal with substantive matters or issues on the merits BUT the judge must promptly notify all other parties of the substance of the communication and give them an opportunity to respond.

      Yeah. It's possible the reason for the communication was legitimate, but the fact the judge's response to this meeting being brought up was the question how the defense attorney found out about it seems like a REALLYbad look.

    The judge not only stepped in it, he is swimming in it. Ex parte meeting without notifying defense, confusing direct contempt and criminal contempt, intimidating a witness outside the presence of the defence, intimidating a defence lawyer to give up privileged work product, refusing to provide the substance of the ex parte with the defense, refusing access to the court to lawyers who protect lawyers found in contempt.

    The YSL case has been absolutely insane the entire time. The judge is either totally incompetent (which I don't think is the case, other lawyers seem to view him positively) or just stupendously biased in this case in favor of the prosecution. He has made some absurd calls, reprimanded the defense for things they literally did not do, letting the prosecutors get away with gross misconduct, etc. I don't know if he's trying to guarantee a successful appeal of any conviction or what. I do wonder if this case might actually have broken records in terms of how many motions for mistrial the judge has denied, because there have been dozens, probably all of them reasonable (that I have seen). I don't know why the judge doesn't just declare the defendant guilty and say "I just feel that he's super guilty."

      In Georgia ex parte is allowed on scheduling issues and the such but never on substantive issues of the case. Here it seems like the judge met with the prosecution and a witness and didn’t tell the defense. The defense found out and the judge realized he got found out and wanted to know how. If that’s true the judge should grant the mistrial and he should be removed from the bench immediately.

    Corruption and incompetence. Extremely disturbing events. This judge is more interested in finding the mole than following the law and a serious ethical breach and denial of constitutional rights. The prosecutor's office also has some explaining to do. The laws are very clear on ex parte hearings. What the hell is going on in Fulton County???!!!😮

      A mistrial is not a 'win' for either side, it just means this has to start all over again. Knowing nothing about what actually happened, that seems like it would be the fair thing to do.. to avoid _any_ sense of impropriety. Maybe the judge is biased here , maybe he isn't.. same for the prosecution.. but as painful as it is, it could be enough plausible suspicion of wrongdoing at play here that it needs to be avoided. I haven't been following this trial at all so this is really crazy to see!

I know nothing about the details of the case at all, but I can clearly see that the prosecution and the court has thrown proper court procedure in the garbage over and over again, and they don't seem to care one bit about it being broadcasted to the world... With that said, I AM on the side of the defense "at this point"... They deserve a fair trial. As far as them actually being guilty of crimes... 🤷

    In my opinion the judge is upset because the truth is out. He wants the lawyer to be a Fink.

    The judge held an ex party conference with the prosecution and a sworn witness without notifying the defense, who should have been there. It is reversible error. It’s a mistrial. The judge is angry he got caught being unethical and breaking the judicial code of conduct. He should be at the very least removed from the case and probably disbarred.

    The other problem with having an Ex Parte meeting with a witness that has been sworn in or not, whether you get the transcript or not, or even an audio recording, is there is plenty of body language signals that don't get picked up, such as the way the judge, prosecutors are looking at each other, or the witness, the look of don't have this on the record or not etc also you do not know if pressure was being put on the witness, pro or con the defendant/. It also seems a difficult situation when the defense attorneys seemed oblivious to the meeting, why? The same reason the Mr Steel would've been ineffective counsel, he could not read the jury, body language others involved in the trial, sensing the feel of the court etc.

    The fact the judge wouldn't ask the 2nd attorney who told them, even though he admitted he knew, so as to press the trial ahead, knowing he was withholding the same information is telling.

    What I think complicates things is, the witness had their attorney in the room. So, the prosecutor and the witness' lawyer wrre in the room. How dos that apply to pleading the fifth in a case? Let's all pretend we know the answer.

      If the prosecution agreed to not prosecute - you can’t plead the 5th. If you still try and refuse to answer questions you get contempt. That’s my guess what happened here. Defense would have no role in that conversation - hence why it was ex parte.

    It’s rumored that the judge threatened a reluctant witness who he had held in contempt, with 2 yrs jail time if the witnessed didn’t testify. And the meeting was held without notifying the defense, or including them in the meeting.

I also agree, with the video we dont know all the facts so a determination would be uninformed. But its good to see you arent afraid to disagree with a judges behavior.     I liked the part where the judge was asked if he was holding Steel in civil contempt or criminal contempt. He said CRIMINAL contempt. Then the lawyer from the defense attorney strike force schooled him that if it was criminal contempt charge that Steel was entitled to a hearing by another court, since this judge was a witness. Then, and only then, this judge changed his contempt charge as civil contempt. Amazing ineptness on part of this judge. He should retire and the case should be deemed a mistrial.

      People are acting like this isn't a RICO case full of murderers. Anything can be happening behind the scenes and beyond the courtroom.
      Also, defense did the same thing with a female investigator earlier in the trial.

    There are situations where ex parte conversations during trial are allowed. However, this was with a witness who was put under oath and it was related to “civil contempt”, per the DA. At the very least, this meeting could have affected this witness’attitude about testifying. Were they threatened into a particular version of events? Who knows.
    The judge and the DA wanting to know how the information was leaked is understandable. And that’s all they care about - who else can we get into trouble or intimidate or threaten?
    This is very unusual. I don’t know if the meeting was proper. We still don’t know what it was about. But all the judge and DA care about is finding out who they can blame for the truth coming out.

    The portion just before the ysl clip you showed Steele explains what was said behind closed doors with the "sworn" witness, the judge and prosecutor after the witness had already said he was taking the 5th! Then after the meetung the witness suddenly changed his mind to testify. 😅

    1:10:05 Mr Steele is absolutely correct here. Judges especially in a massive RICO state case like this , the judge unless talking about scheduling , emergencies, etc he should not be talking with witnesses outside of court without legal council.

      It's not that the witness didn't have counsel present ( i think he did have his lawyer there). It's that opposing counsel was not present or notified of the meeting

    What do you think of a judge, prosecutor, and defense attorney car sharing too and from the courthouse?
    I've been told of a remote county where they would do just that. They would hold court maybe once or twice in that county and the judge, prosecutor, and defense attorney would ride together for the approximately 100 mile ride each direction.

    100% mistrial - this judge admitted to having this meeting while this case is in trial which shouldn’t be happening. He was sticking up for his client and this will definitely make more defense attorneys afraid for sticking up for their clients

    Yeah, that is the problem. The ex parte meeting with just the witness and the prosecutor with the judge and not the defense. You are right it was with the prosecutor and a witness. The defense was not notified or told of the meeting.

    The judge admits this ex parte took place while he's ordering Brian Steele to jail for not revealing how he found out about it. Literally court started two hours late so the judge, the entire prosecution team, and a sworn witness who was mid testimony could have a secret meeting. The only thing we don't know is if the Brady violation really occurred in the meeting. It's insane.

    The prosecutor asked to meet exparte when the witness plead the 5th after being given immunuty. Apparently the meeting was to force his testimony or be held in contempt. The witness had already been called and sworn in and had begun testifying.

    I looked up Georgia law on this. Nope! It’s not allowed. My hunch, based on what little I know about the basis of this trial, the meeting was with a sworn in witness that was arrested for pleading the fifth after being granted immunity, I think. What on God’s flat earth is going on in Fulton County - don’t answer this, it’s rhetorical,I know the answer. 😂😂

    So a brief look back showed that the key witness for the state plead the fifth in front of the jury despite being given immunity. Apparently there were concerns of possible witness intimidation, or at least those are the speculations going around the web at the moment which seems plausible given the nature of the trial and defendants, which led to the ex parte hearing excluding the defense. Which is apparently allowed for under Georgia law under an emergency clause. Seems sketch, but hopefully all comes to light.

    Criminal defense attorney from MA here-in complete agreement with Mike re the YSL attorney contempt issue. Setting aside the judge’s poor understanding of 1.6, most troubling to me is the judge’s refusal to let counsel to even make a record.
    One thing I wanted to point out is that this is NOT a case where knowing the source might have any effect on the propriety of the ex parte communication or the motion for mistrial. If, for example, there was a question as to whether it actually happened or what was said during the communication, then the judge likely would have been warranted in saying ‘I can’t make a preliminary determination without some means of assessing the credibility of the information.’ That said, even in that scenario, the judge would have no basis to hold counsel in contempt if he (counsel) then decided, in good faith, that the identity of source was privileged and should not be waived.
