Sheriffs are sworn in; this means they take an oath to uphold and defend the constitution of the United States. Politicians also take this same oath. When politicians try to strip rights from the people, they should be removed from office.
Municipal police and federal enforcement officers also take the same oath. Much like the one I first took in '03 "...I will support and defend the CONSTITUTION against all enemies foreign and domestic and bear true faith and allegiance to the same..." BEFORE officers appointed over me or the office of thr President. When government becomes tyrannical, become ungovernable. I wont enforce anything unconstitutional either.

There are many laws which are constitutionally dubious and then there are some laws which are blatantly unconstitutional but the legislators don’t care. One example is California passing a law which restricts concealed carry to be basically impossible in any public setting. There is absolutely no way that will not get rightly struck down by SCOTUS. California is doing this because the judicial process for finding a law unconstitutional is slow, especially with the 9th Circuit Appeals Court in CA staffed by far left ideologues running interference for their preferred policies. But more importantly, there is zero personal accountability for the politicians involved in passing unconstitutional laws, and therefore zero incentive for them not to do so. They can just keep spamming unconstitutional laws and some of them will always be on the books because the courts just haven’t gotten to them yet. When a law is taken to court and found to be blatantly unconstitutional, the legislators who voted for that law, the executive who signed the law, and any writers of the law need to be held accountable by at the very least being on the hook financially for the costs accrued defending that law in court. That would very quickly put an end to such legislative spamming.

I like this sheriff. He refutes the governor's solution to a non-existent problem, presents the real problem, and follows up with a proposed course of action to the real problem.
And he will be deeply ignored as the Supreme Court refuses to take the case or lacks any authority to punish or remove from office those that commit treason.
The ONLY successful course of action is eradication of the oppressive entity causing the oppression, primarily by organized guerilla warfare and tactics. Period.

@@LuccaAndretti We don't need servants from the executive branch of the government (e.g. sheriffs) to question the laws enacted by the legislative powers. That's the judicative powers' job (=in the end the Supreme Court). What this sheriff does is basically violating the separation of power - one of the major cornerstones of US society, laid down in the US constitution itself (and by far more central in there than the 2nd Amendment). But he's obviously pro guns, so many people go "yay, great sheriff!". For me that's absolutely hypocritical - the sheriff is trying to show off as a defender of the constitution - but is also only picking out the parts that suits his needs and is popular (=the 2nd Amendment). He probably just wants to position himself to be re-elected as sheriff. And what better way to do this than showing off by opposing this law and ensure the support of the powerful gun lobby and all its supporters?

Interpreting it is not. If Sheriffs can just sort of be their own judicial branch, what's to stop them, and maybe the prosecutors and judges in liberal states from deciding "you know what, we don't believe the 2A confers any right of individual gun ownership. We hold the Supreme Court to be illegitimate."
The 1st Amendment seems pretty self-evident too: "Congress shall make no law respecting an establishment of religion or prohibiting its free exercise." No law. Seems to me if we take that at face value, Warren Jeffs has an argument that his "marrying" 12 year old girls was an absolute right. His exercise of religion after all. Even if you could vote them out their unconstitutional laws are still in place while it takes years of going through the court system to ever undo the damage. They pass laws knowing that they are unconstitutional but they don’t care because they know their voter base will protect them, it will take years if not decades to undo these unconstitutional laws, and in the mean time there is no repercussions for their actions. Legislator's writing unconstitutional laws need to pay for the cost of the litigation to overturn them, otherwise they just flood the courts with this garbage and tie up the courts time with frivolous legislation that targets law abiding citizens !

People are making too much out of this. It's important to note that all of these sheriffs are only saying they will not enforce one specific provision of the law. That's the part that requires you to register firearms and magazines that fall under the grandfather exception. None of them are saying that they won't enforce any other part of the law or that they won't enforce the law as a whole. And there is likely a more selfish motivation for them not wanting to enforce that particular provision of the law. In order to do that they would need to implement and maintain a system to be able to catalog all of that data. That would involve a huge amount of money and manhours most of them simply don't have.

There is a very limited number of transferable machine guns that private citizens are eligible to buy, but Illinois has already banned its residents from buying one. However, law enforcement is allowed to buy machine guns just by filing some simple paperwork.

As of yesterday there were 67 County Sheriff's (and counting) in Illinois out of 102 counties who have said they will not enforce this law due to it being unconstitutional.

Our sherrifs are the last line against unconstitutional laws. Two recent US supreme court cases codified the right to own and bear arms and Illinois has been thumbing its nose ever since.

@@jerrymason7887in light of Bruen and a large body of existing case law, there is no way to reasonably argue that lawmakers, particularly those with law degrees, are unaware of the constitutionality of a gun law (or lack thereof) when they pass a gun bill.
Sheriffs are sworn in; this means they take an oath to uphold and defend the constitution of the United States. Politicians also take this same oath. When politicians try to strip rights from the people, they should be removed from office.

There are many laws which are constitutionally dubious and then there are some laws which are blatantly unconstitutional but the legislators don’t care.
One example is California passing a law which restricts concealed carry to be basically impossible in any public setting. There is absolutely no way that will not get rightly struck down by SCOTUS.
California is doing this because the judicial process for finding a law unconstitutional is slow, especially with the 9th Circuit Appeals Court in CA staffed by far left ideologues running interference for their preferred policies. But more importantly, there is zero personal accountability for the politicians involved in passing unconstitutional laws, and therefore zero incentive for them not to do so. They can just keep spamming unconstitutional laws and some of them will always be on the books because the courts just haven’t gotten to them yet.
When a law is taken to court and found to be blatantly unconstitutional, the legislators who voted for that law, the executive who signed the law, and any writers of the law need to be held accountable by at the very least being on the hook financially for the costs accrued defending that law in court.
That would very quickly put an end to such legislative spamming.

@@LuccaAndretti We don't need servants from the executive branch of the government (e.g. sheriffs) to question the laws enacted by the legislative powers. That's the judicative powers' job (=in the end the Supreme Court).
What this sheriff does is basically violating the separation of power - one of the major cornerstones of US society, laid down in the US constitution itself (and by far more central in there than the 2nd Amendment). But he's obviously pro guns, so many people go "yay, great sheriff!".
For me that's absolutely hypocritical - the sheriff is trying to show off as a defender of the constitution - but is also only picking out the parts that suits his needs and is popular (=the 2nd Amendment). Even if you could vote them out their unconstitutional laws are still in place while it takes years of going through the court system to ever undo the damage. They pass laws knowing that they are unconstitutional but they don’t care because they know their voter base will protect them, it will take years if not decades to undo these unconstitutional laws, and in the mean time there is no repercussions for their actions. There must be a better way. I have a few ideas……

As of about 3:00 pm today over 67 County's say they are against the law. it's not just a few, and its growing.

People are making too much out of this. It's important to note that all of these sheriffs are only saying they will not enforce one specific provision of the law. That's the part that requires you to register firearms and magazines that fall under the grandfather exception. None of them are saying that they won't enforce any other part of the law or that they won't enforce the law as a whole.
And there is likely a more selfish motivation for them not wanting to enforce that particular provision of the law. In order to do that they would need to implement and maintain a system to be able to catalog all of that data. That would involve a huge amount of money and manhours most of them simply don't have.

There is a very limited number of transferable machine guns that private citizens are eligible to buy, but Illinois has already banned its residents from buying one. However, law enforcement is allowed to buy machine guns just by filing some simple paperwork.

State Police have jurisdiction over local Sheriffs. Fatty is planning to enlist State Police to randomly check shooting ranges and events to look for offenders. You can try all you want but you will NOT win a fight against the Fourth Reich.

Our sherrifs are the last line against unconstitutional laws. Two recent US supreme court cases codified the right to own and bear arms and Illinois has been thumbing its nose ever since.

Every citizen is a "law abiding citizen" until they aren't. Guns make killing easy. You have failed to understand the human condition if all you know is "law". Hate to break it to you pal, but criminals get their weapons from "law abiding citizens", or at least law abiding as far as their record goes.
