  • IMRO Music Industry Seminar by Todd Brabec
The online/digital world has changed many of the ways that music is licensed as well as the amount of royalties that songwriters, composers and music publishers receive.
This new world has created many new areas of exploitation and opportunity including music in apps, video games, e-cards, digital jukeboxes and interactive dolls and toys, to name but a few. In addition, many new forms of mechanical licensing and performances have come into existence - locker services, downloads, bundled services, ringtones and ringbacks, subscription and streaming services - all with new royalty rates.
This seminar will discuss the types of deals, the negotiating process and the actual royalties being generated by songwriters and publishers in the online world. It will also cover many of the traditional areas of music licensing (radio, tv and live performances; film, television and advertising song licensing; record sales; songs in musicals, etc.) and tell you how the online world has changed the structure and royalties of all types of music licensing deals.
    Todd Brabec
Todd Brabec, former ASCAP Executive Vice President and Worldwide Director of Membership, is an Entertainment Law attorney, a Deems Taylor Award winning author of the best selling music business book "Music, Money and Success: the Insider's Guide to Making Money in the Music Business" (7th edition, 560 pages), an Adjunct Associate Professor at USC where he teaches the course on Music Licensing, Music Publishing and Film, Television and Video Game scoring and song contracts and a Governing Committee member of the American Bar Association Forum on the Entertainment and Sports Industries.
During his 37 year career at ASCAP, he was responsible for signing most of ASCAP 's successful songwriters, songwriter/artists and film and television composers in addition to significantly changing ASCAP's payment and distribution systems resulting in an increase in annual license fees from 60 million dollars to 995 million dollars and a market share increase from 20% to market share dominance in all major media.

***** It's about music money and success..lol! That's what the title of the book is. I can't possibly sum up 530+ pages in a sentences or two. All I'll say is it talks about record companies, publishing, copyrighting, how to collect royalties if you are a songwriter, putting songs in tv, commercials, & motion pictures, who the PROs (performing rights organizations) are, what the Harry Fox Agency is, who the music users are, how to examine contracts/licenses, etc. It's a pretty good read. Or maybe you know that and just wanted to test me to see if I read the book..lol

Hi there, do you also offer courses or private lessons regarding music marketing? I'd like to start as a freelancer as it seems to be the fastest way to earn money right off the bat to get clients instead of slow building the fan base which sadly can't afford on that now.
    Best regards,
    Paul

Who pays for the small venue royalties? The club owner or the performers? Bands STILL only get $50 to $100 a man a night. That is the same as they were getting paid in the '70s and '80s. I can't see the band being able to afford to pay. Think there will ever be support for live musicians as far as how much they get paid?

+Lauren Blaine BAM Spot on...i tried to write with a guy in England a while back(about three years ago) and sadly, part of the reason he found it hard to concentrate and eventually our partnership fell to pieces was because he was £15,000 in debt due to not making enough money from pubs and clubs and running acoustic evenings. In the end England lost this guy(he had a vocal identical to Seal..and was a superb writer) as he moved to Spain to play in the bars out there. Basically, by selling up and moving over there he got rid of the tail end of his mortgage...and could survive due to Spain paying more money for talent.
His songs were amazing. I once asked a co-writer to tell me who he thought the artist was and won me a bet of £10 because my co-writer had been told that the singer was not famous or known....yet couldn't name him although citing him as FABULOUS!!
What has happened when we go to see a developing artist and song writer play a gig and not only does he HAVE to play covers(unless "I'M" in the building..i request them!!) but he is denied the great pleasure of a singer of quality, in singing his own creations....SPAIN is a lucky country to have this man.
You are right Lauren. As far as artists getting paid to play their own material, look no further than two new artists plying their trade today...one is JASMINE LAMPORT(a vocally gifter singer/songwriter) and the other is Mara Simpson....Jesus Christ WORLD....help these talented ladies out...and buy there downloads. Last time i looked Mara was trying to raise funds to support her future album and Jasmine....she's currently on a sponsored Music Production course(and focusing on songwriting)....BOTH ARE SUPERB....THE WORLD HAS TURNED UPSIDE DOWN!!!!....hope it turns and rights itself soon so these ladies and many new up and coming artists break through....without having to go into massive debt for their craft.

The small venues who put on live music regularly should have a license at the national PRS, paying a yearly or monthly fee. In my country artists can submit their own performance data (venue, date, set-list and the fee paid by the venue) and the PRS pays 10% of the performance fee in royalties. So if the venue paid you €100, your PRS would pay out (an extra) €10,- at the end of the year for that show, theoretically funded by the license fees paid by small venues (it may come out of a larger pile of licenses and contributions).
More paid gigs at PRS-licensed venues would thus mean a bigger royalty pay-outs at year's end. 20 gigs @ €100 would be a gross performance royalty pay-out of €200,-. provided you submit your data of course, so it does involve some admin on your part. I'm not aware of the venue being required to do anything else besides pay the live music license.
of course, this is for artists who write their own material. coverbands/artists do not have to pay anything nor do they need to do the admin (and thus get no extra money from a PRS).

Surely the key to all of this "getting the artist/writer paid a living wage" is to...
      A. Write better songs.
      B. WRITE BETTER SONGS.
      C. If you can't write better songs, bring in co-writers to help you.
      D. Get those songs heard online and build up more of a following...so that if you put a gig on the attendees know YOUR music...and are coming to experience YOUR "live" music.
      E. Book a small but comfortable Village Hall(200-250 capacity).
      F. Provide YOUR OWN beer, wine, crisps nuts etc...as in my experience outside bars have an "if we don't sell enough beer..you owe us" policy..don't get burned by that.
      G. Do some local advertising(lots..and as cheap as poss)..especially a leaflet drop in the village you are playing in.I once went to a Village Hall gig to see a band called EMBER in a village called Priddy, Somerset, England...that hall filled in ten minutes and was rammed with locals..they were out in the sticks and appreciated every band or act that turned up..
      H. ..... play your HEARTS out!!!!
      I. ...ohhh...i missed one...sell some cd's to folk on the way IN to the hall. They are coming to see YOU "live"...and that is the moment the wallets and purses come out...to pay entrance fees.
      J. Make sure everyone in the hall knows that the bar is supplied by you and any profit goes to the band/artist...if they are musos, they'll buy more drinks to support YOU...don't make the drinks blindingly expensive..folk will remember being ripped off with drinks before they remember your great songs.
K....THANK THEM ALL FOR MAKING THE NIGHT SPECIAL BY BEING THERE...and try and get every last one of them on your mailing list....the night is all about that group of people having a great night in an amazing atmosphere....SHAKE THEIR HANDS..every last one of them..they just gave you a living wage!!!
...and make damned sure you have two phone numbers to whoever runs the Hall...otherwise you can be stuck there with a KEY...and nobody to collect it.
      OH YES...it happens...to me once..NEVER AGAIN.
