- A Chinese citizen living in Newark was arrested and charged Wednesday morning with stealing confidential AI files from Google while he was employed as a software engineer.

This is not a new thing, China has had a very active industrial espionage program going on in the US for decades. Companies like Motorola, DuPont, Dow have all been hit. It makes one wonder why any company would hire any Chinese national here on a work permit. If Google had only Googled “Chinese industrial espionage”. (Oh, the irony). They would have seen the risks.
Because not hiring them over the fact they're Chinese leads to lawsuits and causes investors who care about this sort of thing (like blackrock) to pull out. It's all driven by greed.
Some of these are personal greed and lack of moral values. The other ones do get approached by Chinese government handlers.
DEI and woke-ism forces these companies into horrible situations.

Chinese, no. They have to come in through special immigration work contracts. They are not entering on foot like the immigrants coming in through our borders. We have documentation for all people with work permits coming in on airplanes etc. Their passports are being noted. They have their special work permits on them with the expiration date or a renewal year. Plus, Google has to vouch for each foreign national for reasons just like this. Google didn't inform the FBI because of a moral standpoint, but a legal one. They can be shut down for this shit.
If you think IT software engineers are coming in illegally from Mexico you’re next level dumb. These guys are coming in on $15k first class airline tickets from China or Hong Kong. They are recruited by these tech giants and it’s up to the company to do their due diligence when hiring foreign nationals. There’s risk involved and Google, meta, Apple, etc all have security teams and need to weigh risk vs reward when hiring.
If you enter illegally you can't access anything valuable. These spies enter on a H1B visa intended for skilled migrants.
40 years seems fair. Now, let's talk about murder sentences in this country. Who believes that killing a child should only be a sentence of 7-10 years or think that 40 years minimum should be a federal law. Who believes that the life of a human being should be atleast the same sentence as someone stealing intellectual property?
US has an overly hard sentences scheme, in comparison with almost any other advanced country. And yet, the crimes rate is , comparatively , pretty high.
Something does not work in the popular recipe of the harsher the sentence, the better.
Perhaps, the USA should, finally, take note of other older, possibly wiser, countries in this field where they are performing better.
I mean objectively this IP is probably way more valuable than someone's life as probably tens of thousands of man hours went into it and it will have an impact on millions of lives.

Technically the 40 years is because of four charges. This means each charge can carry 10 years maximum. Generally speaking, whether to make the time served concurrent (that is, each of the 10 years stacked together) is based on the severity of the crime. Stacking charges is also at times done to lower the chances of early parole. Its important to note that while the observation at first looks like intellectual property is worth more than a human life it is really just a consequence of how our law works when multiple charges are levied against a person or group.

All Google foreign employees are screened before coming into our country. But, it is not Google who does it. It is our state department that first does the back ground check and then handsi it off to immigration. Immigration then, if all criteria is met, authorizes a work permit and gives the employee a work expiration date. The FBI of course didn't make that clear and the reporting didn't speak of it. I would like for that to sink in for a minute.
At least it's not a National Lab this time. Every yr. one or two get pinched for theft.

It's not that they never learn, it's that they just don't care. If you've ever watched the movie The Big Short, it's kind of like that. The actual damage this spy has caused is nowhere near as critical to google as it is to google's users/clients. But because it doesn't affect google's core business, they see it as a mitigated risk. Much like a lot of the news about Boeing lately, stockholders/managment doesn't care about the quality of their aircraft and the employees would no longer feel comfortable flying in a MAX or 787, but it's the air travelers who have nothing to do with Boeing that end up becoming the victims and therefore paying the cost.
And I could go all day on providing such examples; that Experian hack few years ago, that one Madison website, etc don't care about their customers identities being revealed or their SSN's being leaked on the dark web, they only care about their own core businesses and operations.

Well if India wanted to it can steal Trade Secrets without using HUMINT. There are multiple Indian cybersecurity companies that have helped certain oil companies in US to break into the phones of Native Americans and steal info regarding negotiations. There are news articles regarding these things in Politico, New york Magazine, and multiple British media outlets.

I worked for consulting firms in India and trust me they don't even let you take a piece of paper into the cubicle. You have to lock everything in your locker before entering through 3 gates atleast.

I am a white American (for context) and I work with many Chinese nationals on H1B visas who are nice people and hard working. Sure there are also many people who are cold and won't speak to you if you aren't in their team/department but that's true for any group of people. Do not let the actions of a few define many.

I am retired from law and worked out a several firms throughout the United States. I still get legal news almost every week and I belong to several organizations which have information on forums on the web. it is getting around fast and some major corporations subscribe to these newsletters that represent some corporations that have now made it mandatory that they do not hire Chinese nationals at any expense. This is total ignorance from your HR departments to hire these people there have been tons of incidences where this is happen an intellectual property being stolen from Chinese nationals it’s just that you don’t hear very much about it in the news because it’s not coming from a big company. Also some of these companies don’t like to report it because it’s alarming to their stockholders.

This is serious, once the intellectual property lands in China we cannot do much about it. We must implement strict policies when dealing with white-collar workers from other countries (Especially China/Russia). We must also have an eye on foreign students doing Ph.D.'s in U.S. colleges, we must make sure the research done by these students benefits the U.S. by providing them necessary opportunities, and at the same time, we need to make sure these IPs are not shared with other countries.
What difference would it make if they bought these secrets from a US national? Or a Chinese could always acquire British Citizenship before entering the US. This has been going on for many many decades. You may be able to reduce it by a tad bit but to think a US citizen won't ever turn rogue is really naive. PRC agencies pay well, and that changes the whole scenario.
And our governor bows down to his Chinese overlords. As does Mayor breed.
